13	13	A PROPOSITION to amend section 4 of the bill of rights of the
14	14	constitution of the state of Kansas to recognize the right to bear arms
15	15	as a natural and fundamental right; clarifying that such right includes
16	16	the possession and use of ammunition, firearm accessories and firearm
17	17	components; making restrictions on such right subject to strict
18	18	scrutiny.

20	20	Be it resolved by the Legislature of the State of Kansas, two-thirds of the
21	21	members elected (or appointed) and qualified to the House of
22	22	Representatives and two-thirds of the members elected (or appointed)
23	23	and qualified to the Senate concurring therein:
24	24	Section 1. The following proposition to amend the constitution of
25	25	the state of Kansas shall be submitted to the qualified electors of the state
26	26	for their approval or rejection: Section 4 of the bill of rights of the
27	27	constitution of the state of Kansas is hereby amended to read as follows:
28	28	"§ 4. Individual right to bear arms; armies. (a) A person
29	29	has the right to keep and bear arms for the defense of self, family,
30	30	home and state, for lawful hunting and recreational use, and for
31	31	any other lawful purpose, and such right includes the possession
32	32	and use of ammunition, firearm accessories and firearm
33	33	components; but standing armies, in time of peace, are dangerous
34	34	to liberty, and shall not be tolerated, and the military shall be in
35	35	strict subordination to the civil power.
36	36	(b) The right to keep and bear arms is a natural and
37	37	fundamental right. This right shall not be infringed. Any restriction
38	38	of such right shall be subject to the strict scrutiny standard."
39	39	Sec. 2. The following statement shall be printed on the ballot with
40	40	the amendment as a whole:
41	41	"Explanatory statement. This amendment recognizes that the

71	71	right of the people of Kansas to keep and bear arms shall not
72	72	be infringed and clarifies that the right includes the
73	73	possession and use of ammunition, firearm accessories and
74	74	firearm components. This amendment further recognizes that
75	75	the right to keep and bear arms is a natural and fundamental
76	76	right deserving the highest protection. Any restriction of the
77	77	right to keep and bear arms shall be subject to the strict
78	78	scrutiny standard.
79	79	"A vote for this proposition would recognize that the right of the
80	80	people of Kansas to keep and bear arms shall not be
81	81	infringed and clarify that the right includes the possession
82	82	and use of ammunition, firearm accessories and firearm
83	83	components. Such vote would also recognize the right to
84	84	keep and bear arms as a natural and fundamental right. Any
85	85	restrictions of such right would be subject to the strict
86	86	scrutiny standard.
87	87	"A vote against this proposition would make no changes to the
88	88	constitution of the state of Kansas with respect to the right to
89	89	keep and bear arms."
90	90	Sec. 3. This resolution, if approved by two-thirds of the members
91	91	elected (or appointed) and qualified to the House of Representatives and
92	92	two-thirds of the members elected (or appointed) and qualified to the
93	93	Senate, shall be entered on the journals, together with the yeas and nays.
94	94	The secretary of state shall cause this resolution to be published as
95	95	provided by law and shall cause the proposed amendment to be submitted
96	96	to the electors of the state at a special election, which is hereby called on
97	97	August 4, 2026, pursuant to section 1 of article 14 of the constitution of
98	98	the state of Kansas, to be held in conjunction with the primary election
99	99	held on such date.
