1313 A PROPOSITION to amend section 4 of the bill of rights of the
1414 constitution of the state of Kansas to recognize the right to bear arms
1515 as a natural and fundamental right; clarifying that such right includes
1616 the possession and use of ammunition, firearm accessories and firearm
1717 components; making restrictions on such right subject to strict
1818 scrutiny.

2020 Be it resolved by the Legislature of the State of Kansas, two-thirds of the
2121 members elected (or appointed) and qualified to the House of
2222 Representatives and two-thirds of the members elected (or appointed)
2323 and qualified to the Senate concurring therein:
2424 Section 1. The following proposition to amend the constitution of
2525 the state of Kansas shall be submitted to the qualified electors of the state
2626 for their approval or rejection: Section 4 of the bill of rights of the
2727 constitution of the state of Kansas is hereby amended to read as follows:
2828 "§ 4. Individual right to bear arms; armies. (a) A person
2929 has the right to keep and bear arms for the defense of self, family,
3030 home and state, for lawful hunting and recreational use, and for
3131 any other lawful purpose, and such right includes the possession
3232 and use of ammunition, firearm accessories and firearm
3333 components; but standing armies, in time of peace, are dangerous
3434 to liberty, and shall not be tolerated, and the military shall be in
3535 strict subordination to the civil power.
3636 (b) The right to keep and bear arms is a natural and
3737 fundamental right. This right shall not be infringed. Any restriction
3838 of such right shall be subject to the strict scrutiny standard."
3939 Sec. 2. The following statement shall be printed on the ballot with
4040 the amendment as a whole:
4141 "Explanatory statement. This amendment recognizes that the

7171 right of the people of Kansas to keep and bear arms shall not
7272 be infringed and clarifies that the right includes the
7373 possession and use of ammunition, firearm accessories and
7474 firearm components. This amendment further recognizes that
7575 the right to keep and bear arms is a natural and fundamental
7676 right deserving the highest protection. Any restriction of the
7777 right to keep and bear arms shall be subject to the strict
7878 scrutiny standard.
7979 "A vote for this proposition would recognize that the right of the
8080 people of Kansas to keep and bear arms shall not be
8181 infringed and clarify that the right includes the possession
8282 and use of ammunition, firearm accessories and firearm
8383 components. Such vote would also recognize the right to
8484 keep and bear arms as a natural and fundamental right. Any
8585 restrictions of such right would be subject to the strict
8686 scrutiny standard.
8787 "A vote against this proposition would make no changes to the
8888 constitution of the state of Kansas with respect to the right to
8989 keep and bear arms."
9090 Sec. 3. This resolution, if approved by two-thirds of the members
9191 elected (or appointed) and qualified to the House of Representatives and
9292 two-thirds of the members elected (or appointed) and qualified to the
9393 Senate, shall be entered on the journals, together with the yeas and nays.
9494 The secretary of state shall cause this resolution to be published as
9595 provided by law and shall cause the proposed amendment to be submitted
9696 to the electors of the state at a special election, which is hereby called on
9797 August 4, 2026, pursuant to section 1 of article 14 of the constitution of
9898 the state of Kansas, to be held in conjunction with the primary election
9999 held on such date.
