10 | 10 | | Be it enacted by the Legislature of the State of Kansas: |
---|
11 | 11 | | Section 1. K.S.A. 25-4147 is hereby amended to read as follows: 25- |
---|
12 | 12 | | 4147. (a) (1) Every treasurer shall keep detailed accounts of all |
---|
13 | 13 | | contributions and other receipts received and all expenditures made by or |
---|
14 | 14 | | on behalf of the treasurer's candidate or committee. |
---|
15 | 15 | | (2) In addition to any other accounts or records required by law, |
---|
16 | 16 | | every treasurer of a political committee that receives one or more |
---|
17 | 17 | | contributions for the purpose of making independent expenditures, as |
---|
18 | 18 | | defined in K.S.A. 25-4148c, and amendments thereto, shall keep an |
---|
19 | 19 | | account of any contribution received for the purpose of making such |
---|
20 | 20 | | expenditures. In addition to any other requirements, such account shall |
---|
21 | 21 | | contain the name of the contributor and the total contributions from each |
---|
22 | 22 | | contributor. |
---|
23 | 23 | | (b) (1) Accounts of any treasurer may be inspected under conditions |
---|
24 | 24 | | determined by the commission, and shall be preserved for a period to be |
---|
25 | 25 | | designated by the commission. |
---|
26 | 26 | | (2) In addition to inspections pursuant to paragraph (1), accounts of |
---|
27 | 27 | | any treasurer of any political committee that receives one or more |
---|
28 | 28 | | contributions for the purpose of making independent expenditures shall be |
---|
29 | 29 | | subject to an annual audit at a time to be determined by the commission. |
---|
30 | 30 | | The audit shall be conducted by a Kansas auditor approved by the |
---|
31 | 31 | | commission at the political committee's expense. The scope and method of |
---|
32 | 32 | | the audit shall be approved by the commission and shall include, but not |
---|
33 | 33 | | be limited to, the compliance by the political committee with the |
---|
34 | 34 | | provisions of K.S.A. 25-4153(j), and amendments thereto. |
---|
35 | 35 | | (c) An individual may serve as treasurer for a candidate, candidate |
---|
36 | 36 | | committee, party committee or political committee or of any two or more |
---|
37 | 37 | | such committees or candidates. |
---|
38 | 38 | | (d) Every person who receives a contribution for a candidate, |
---|
39 | 39 | | candidate committee, party committee or political committee more than |

77 | 77 | | required by K.S.A. 25-4148, and amendments thereto, on demand of the |

78 | 78 | | treasurer, or in any event on or before the ending date of the reporting |

79 | 79 | | period, shall remit the same and render to the treasurer an account thereof, |
---|
80 | 80 | | including the amount, the name and address of the person, if known, |
---|
81 | 81 | | making the contribution and the date received. |
---|
82 | 82 | | (e) No contribution or other receipt received by a candidate, |
---|
83 | 83 | | candidate committee, party committee or political committee shall be |
---|
84 | 84 | | commingled with personal funds of the candidate or the treasurer or other |
---|
85 | 85 | | officers or members of such committee. |
---|
86 | 86 | | (f) No candidate, candidate committee, party committee or political |
---|
87 | 87 | | committee shall receive any contribution or other receipt from a political |
---|
88 | 88 | | committee unless accompanied by the full name of the organization with |
---|
89 | 89 | | which the political committee is connected or affiliated or, name or |
---|
90 | 90 | | description sufficiently describing the affiliation or, if the political |
---|
91 | 91 | | committee is not connected or affiliated with any one organization, the |
---|
92 | 92 | | trade, profession or primary interest of the political committee as reflected |
---|
93 | 93 | | by the statement of purpose of such organization. |
---|
94 | 94 | | Sec. 2. K.S.A. 25-4148 is hereby amended to read as follows: 25- |
---|
95 | 95 | | 4148. (a) Every treasurer shall file a report prescribed by this section. |
---|
96 | 96 | | Reports filed by treasurers for candidates for state office, other than |
---|
97 | 97 | | officers elected on a state-wide basis, shall be filed in both with the office |
---|
98 | 98 | | of the secretary of state. Reports filed by treasurers for candidates for |
---|
99 | 99 | | state-wide office shall be filed electronically and only with the secretary of |
---|
100 | 100 | | state. Reports filed by treasurers for candidates for local office shall be |
---|
101 | 101 | | filed in the office of the county election officer of the county in which the |
---|
102 | 102 | | name of the candidate is on the ballot. Except as otherwise provided by |
---|
103 | 103 | | subsection (h), all such reports shall be filed in time to be received in the |
---|
104 | 104 | | offices required on or before each of the following days: |
---|
105 | 105 | | (1) The eighth day preceding the primary election, which report shall |
---|
106 | 106 | | be for the period beginning on January 1 of the election year for the office |
---|
107 | 107 | | the candidate is seeking and ending 12 days before the primary election, |
---|
108 | 108 | | inclusive; |
---|
109 | 109 | | (2) the eighth day preceding a general election, which report shall be |
---|
110 | 110 | | for the period beginning 11 days before the primary election and ending 12 |
---|
111 | 111 | | days before the general election, inclusive; |
---|
112 | 112 | | (3) January 10 of the year after an election year, which report shall be |
---|
113 | 113 | | for the period beginning 11 days before the general election and ending on |
---|
114 | 114 | | December 31, inclusive; |
---|
115 | 115 | | (4) for any calendar year when no election is held, a report shall be |
---|
116 | 116 | | filed on the next January 10 for the preceding calendar year; |
---|
117 | 117 | | (5) a treasurer shall file only the annual report required by subsection |
---|

---|
164 | 164 | | (1) Cash on hand on the first day of the reporting period; |
---|
165 | 165 | | (2) the name and address of each person who has made one or more |
---|
166 | 166 | | contributions in an aggregate amount or value in excess of $50 during the |
---|
167 | 167 | | election period together with the amount and date of such contributions, |
---|
168 | 168 | | including the name and address of every lender, guarantor and endorser |
---|
169 | 169 | | when a contribution is in the form of an advance or loan and, in the case |
---|
170 | 170 | | of political committees that receive one or more contributions for the |
---|
171 | 171 | | purpose of independent expenditures, as defined in K.S.A. 25-4148c, and |
---|
172 | 172 | | amendments thereto, the aggregate amount contributed by each |
---|
173 | 173 | | contributor; |
---|
174 | 174 | | (3) the aggregate amount of all proceeds from bona fide sales of |
---|
175 | 175 | | political materials such as, but not limited to, political campaign pins, |
---|
176 | 176 | | buttons, badges, flags, emblems, hats, banners and literature; |
---|
177 | 177 | | (4) the aggregate amount of contributions for which the name and |
---|
178 | 178 | | address of the contributor is not known; |
---|
179 | 179 | | (5) each contribution, rebate, refund or other receipt not otherwise |
---|
180 | 180 | | listed; |
---|
181 | 181 | | (6) the total of all receipts; |
---|
182 | 182 | | (7) the name and address of each person to whom expenditures have |
---|
183 | 183 | | been made in an aggregate amount or value in excess of $50, with the |
---|
184 | 184 | | amount, date, and purpose of each;, the names and addresses of all persons |
---|
185 | 185 | | to whom any loan or advance has been made; and when an expenditure is |
---|
186 | 186 | | made by payment to an advertising agency, public relations firm or |
---|
187 | 187 | | political consultants for disbursement to vendors, the report of such |
---|
188 | 188 | | expenditure shall show in detail the name of each such vendor and the |
---|
189 | 189 | | amount, date and purpose of the payments to each; |
---|
190 | 190 | | (8) the name and address of each person from whom an in-kind |
---|
191 | 191 | | contribution was received or who has paid for personal services provided |
---|
192 | 192 | | without charge to or for any candidate, candidate committee, party |
---|
193 | 193 | | committee or political committee, if the contribution is in excess of $100 |
---|
194 | 194 | | and is not otherwise reported under subsection (b)(7), and the amount, date |
---|
195 | 195 | | and purpose of the contribution; |
---|
196 | 196 | | (9) the aggregate of all expenditures not otherwise reported under this |
---|
197 | 197 | | section; and |
---|
198 | 198 | | (10) the total of expenditures. |
---|
199 | 199 | | (c) In addition to the requirements of subsection (b), every treasurer |
---|
200 | 200 | | for any political committee and party committee shall report the following: |
---|
201 | 201 | | (1) (A) The name and address of each candidate for state or local |
---|
202 | 202 | | office for whom an expenditure in the form of an in-kind contribution has |
---|
203 | 203 | | been made in an aggregate amount or having a fair market value in excess |
---|
204 | 204 | | of $300, with the amount, date and purpose of each. The report shall show |
---|

---|
249 | 249 | | (B) the name and address of each candidate for state or local office |
---|
250 | 250 | | who is the subject of an expenditure which that: |
---|
251 | 251 | | (i) Is made without the cooperation or consent of a candidate or |
---|
252 | 252 | | candidate committee; |
---|
253 | 253 | | (ii) expressly advocates the nomination, election or defeat of such |
---|
254 | 254 | | candidate; and |
---|
255 | 255 | | (iii) is an aggregate amount or having a fair market value in excess of |
---|
256 | 256 | | $300. |
---|
257 | 257 | | (2) The report shall state the amount, date and purpose of the |
---|
258 | 258 | | expenditure in the form of an in-kind contribution. The report shall show |
---|
259 | 259 | | in detail the specific service or product provided. The reporting |
---|
260 | 260 | | requirements imposed by this subsection shall be in addition to all other |
---|
261 | 261 | | requirements required by this section. |
---|
262 | 262 | | (d) Treasurers of candidates and of candidate committees shall |
---|
263 | 263 | | itemize the purchase of tickets or admissions to testimonial events by a |
---|
264 | 264 | | person who purchases such tickets or admissions in an aggregate amount |
---|
265 | 265 | | or value in excess of $50 per event, or who purchases such a ticket or |
---|
266 | 266 | | admission at a cost exceeding $25 per ticket or admission. All other |
---|
267 | 267 | | purchases of tickets or admissions to testimonial events shall be reported |
---|
268 | 268 | | in an aggregate amount and shall not be subject to the limitations specified |
---|
269 | 269 | | in K.S.A. 25-4154, and amendments thereto. |
---|
270 | 270 | | (e) If a contribution or other receipt from a political committee is |
---|
271 | 271 | | required to be reported under subsection (b), the report shall include the |
---|
272 | 272 | | full name of the organization with which the political committee is |
---|
273 | 273 | | connected or affiliated or, a description of the connection to or affiliation |
---|
274 | 274 | | with such organization. If, the committee is not connected or affiliated |
---|
275 | 275 | | with any one organization, the report shall state the trade, profession or |
---|
276 | 276 | | primary interest of the political committee as reflected by the statement of |
---|
277 | 277 | | purpose of such organization. |
---|
278 | 278 | | (f) The commission may require any treasurer to file an amended |
---|
279 | 279 | | report for any period for which the original report filed by such treasurer |
---|
280 | 280 | | contains material errors or omissions. The notice of the errors or omissions |
---|
281 | 281 | | shall be part of the public record. The amended report shall be filed within |
---|
282 | 282 | | 30 days after notice by the commission. |
---|
283 | 283 | | (g) The commission may require any treasurer to file a report for any |
---|
284 | 284 | | period for which the required report is not on file. The notice of the failure |
---|
285 | 285 | | to file shall be part of the public record. Such report shall be filed within |
---|
286 | 286 | | five days after notice by the commission. |
---|
287 | 287 | | (h) For the purpose of any report required to be filed pursuant to |
---|
288 | 288 | | subsection (a) by the treasurer of any candidate seeking nomination by |
---|
289 | 289 | | convention or caucus or by the treasurer of the candidate's committee or by |
---|
290 | 290 | | the treasurer of any party committee or political committee, the date of the |
---|

338 | 338 | | in lieu of the candidate's treasurer or the treasurer of the candidate's |
---|

340 | 340 | | Sec. 3. K.S.A. 25-4153 is hereby amended to read as follows: 25- |
---|
341 | 341 | | 4153. (a) The aggregate amount contributed to a candidate and such |
---|
342 | 342 | | candidate's candidate committee and to all party committees and political |
---|
343 | 343 | | committees and dedicated to such candidate's campaign, by any political |
---|
344 | 344 | | committee or any person except a party committee, the candidate or the |
---|
345 | 345 | | candidate's spouse, shall not exceed the following: |
---|
346 | 346 | | (1) For the pair of offices of governor and lieutenant governor or for |
---|
347 | 347 | | other state officers elected from the state as a whole, $2,000 for each |
---|
348 | 348 | | primary election (or, in lieu thereof, a caucus or convention of a political |
---|
349 | 349 | | party) and an equal amount for each general election. |
---|
350 | 350 | | (2) For the office of member of the house of representatives, district |
---|
351 | 351 | | judge, district magistrate judge, district attorney or a candidate for local |
---|
352 | 352 | | office, $500 for each primary election (or, in lieu thereof, a caucus or |
---|
353 | 353 | | convention of a political party) and an equal amount for each general |
---|
354 | 354 | | election. |
---|
355 | 355 | | (3) For the office of state senator or member of the state board of |
---|
356 | 356 | | education, $1,000 for each primary election (or, in lieu thereof, a caucus or |
---|
357 | 357 | | convention of a political party) and an equal amount for each general |
---|
358 | 358 | | election. |
---|
359 | 359 | | (b) For the purposes of this section, the face value of a loan at the end |
---|
360 | 360 | | of the period of time allocable to the primary or general election is the |
---|
361 | 361 | | amount subject to the limitations of this section. A loan in excess of the |
---|
362 | 362 | | limits herein provided may be made during the allocable period if such |
---|
363 | 363 | | loan is reduced to the permissible level, when combined with all other |
---|
364 | 364 | | contributions from the person making such loan, at the end of such |
---|
365 | 365 | | allocable period. |
---|
366 | 366 | | (c) For the purposes of this section, all contributions made by |
---|
367 | 367 | | unemancipated children under 18 years of age shall be considered to be |
---|
368 | 368 | | contributions made by the parent or parents of such children. The total |
---|
369 | 369 | | amount of such contribution shall be attributed to a single custodial parent |
---|
370 | 370 | | and 50% of such contribution to each of two parents. |
---|
371 | 371 | | (d) The aggregate amount contributed to a state party committee by a |
---|
372 | 372 | | person other than a national party committee or a political committee shall |
---|
373 | 373 | | not exceed $15,000 in each calendar year; and the aggregate amount |
---|
374 | 374 | | contributed to any other party committee by a person other than a national |
---|
375 | 375 | | party committee or a political committee shall not exceed $5,000 in each |
---|
