55 AN ACT concerning crimes, punishment and criminal procedure; relating
66 to crimes involving government functions; creating the crimes of
77 interference with a security camera in a correctional facility and
88 aggravated interference with a security camera in a correctional facility
99 and providing criminal penalties therefor.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. (a) Interference with a security camera in a correctional
1212 facility is intentionally covering a security camera in a correctional facility
1313 without authority from the correctional facility.
1414 (b) Aggravated interference with a security camera in a correctional
1515 facility is intentionally:
1616 (1) Removing, damaging or rendering inoperable a security camera in
1717 a correctional facility without authority from the correctional facility; or
1818 (2) covering, removing, damaging or rendering inoperable a security
1919 camera in a correctional facility during a riot at the correctional facility
2020 without authority from the correctional facility.
2121 (c) (1) Interference with a security camera in a correctional facility is
2222 a class A nonperson misdemeanor; and
2323 (2) aggravated interference with a security camera in a correctional
2424 facility as defined in:
2525 (A) Subsection (b)(1) is a severity level 9, nonperson felony; and
2626 (B) subsection (b)(2) is a severity level 6, nonperson felony.
2727 (d) As used in this section:
2828 (1) "Correctional facility" means a:
2929 (A) Jail or correctional facility operated by a city, county or
3030 consolidated law enforcement agency;
3131 (B) correctional institution as defined in K.S.A. 75-5202, and
3232 amendments thereto; or
3333 (C)  juvenile detention facility as defined in K.S.A. 38-2302, and
3434 amendments thereto; and
3535 (2) "security camera" means an analog or digital photographic or
3636 video camera or other device capable of recording or transmitting a
3737 photograph, motion picture or other digital image.
3838 (e) This section shall be a part of and supplemental to the Kansas
3939 criminal code.
