| 6 | 6 | | to crimes involving government functions; creating the crimes of |

| 7 | 7 | | interference with a security camera in a correctional facility and |
|---|
| 8 | 8 | | aggravated interference with a security camera in a correctional facility |
|---|
| 9 | 9 | | and providing criminal penalties therefor. |
|---|
| 10 | 10 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 11 | 11 | | Section 1. (a) Interference with a security camera in a correctional |
|---|
| 12 | 12 | | facility is intentionally covering a security camera in a correctional facility |
|---|
| 13 | 13 | | without authority from the correctional facility. |
|---|
| 14 | 14 | | (b) Aggravated interference with a security camera in a correctional |
|---|
| 15 | 15 | | facility is intentionally: |
|---|
| 16 | 16 | | (1) Removing, damaging or rendering inoperable a security camera in |
|---|
| 17 | 17 | | a correctional facility without authority from the correctional facility; or |
|---|
| 18 | 18 | | (2) covering, removing, damaging or rendering inoperable a security |
|---|
| 19 | 19 | | camera in a correctional facility during a riot at the correctional facility |
|---|
| 20 | 20 | | without authority from the correctional facility. |
|---|
| 21 | 21 | | (c) (1) Interference with a security camera in a correctional facility is |
|---|
| 22 | 22 | | a class A nonperson misdemeanor; and |
|---|
| 23 | 23 | | (2) aggravated interference with a security camera in a correctional |
|---|
| 24 | 24 | | facility as defined in: |
|---|
| 25 | 25 | | (A) Subsection (b)(1) is a severity level 9, nonperson felony; and |
|---|
| 26 | 26 | | (B) subsection (b)(2) is a severity level 6, nonperson felony. |
|---|
| 27 | 27 | | (d) As used in this section: |
|---|
| 28 | 28 | | (1) "Correctional facility" means a: |
|---|
| 29 | 29 | | (A) Jail or correctional facility operated by a city, county or |
|---|
| 30 | 30 | | consolidated law enforcement agency; |
|---|
| 31 | 31 | | (B) correctional institution as defined in K.S.A. 75-5202, and |
|---|
| 32 | 32 | | amendments thereto; or |
|---|
| 33 | 33 | | (C) juvenile detention facility as defined in K.S.A. 38-2302, and |
|---|
| 34 | 34 | | amendments thereto; and |
|---|
| 35 | 35 | | (2) "security camera" means an analog or digital photographic or |
|---|
| 36 | 36 | | video camera or other device capable of recording or transmitting a |
|---|
| 37 | 37 | | photograph, motion picture or other digital image. |
|---|
| 38 | 38 | | (e) This section shall be a part of and supplemental to the Kansas |
|---|
| 39 | 39 | | criminal code. |
