5	5	AN ACT concerning wildlife; relating to hunting; prohibiting nonresidents
6	6	from hunting migratory waterfowl during the hunting season except on
7	7	Sundays, Mondays and Tuesdays; applying such restriction to
8	8	department lands and waters, federal lands and waters managed by the
9	9	United States army corps of engineers at specified reservoirs, the
10	10	bureau of reclamation at certain reservoirs and the United States fish
11	11	and wildlife service at designated refuges; exempting properties
12	12	designated as walk-in hunting access areas, navigable rivers in Kansas
13	13	and the conservation order for light geese season from such restriction;
14	14	reducing fees for migratory waterfowl habitat stamps; amending K.S.A.
15	15	32-939 and K.S.A. 2024 Supp. 32-988 and repealing the existing
16	16	sections.
17	17	Be it enacted by the Legislature of the State of Kansas:
18	18	Section 1. K.S.A. 32-939 is hereby amended to read as follows: 32-
19	19	939. (a) As used in this section,:
20	20	(1) "Department lands and waters" means lands, waters and facilities
21	21	that are under the jurisdiction and control of the secretary through
22	22	ownership, lease, license, cooperative agreement, memorandum of
23	23	understanding or other arrangement, including, but not limited to, state
24	24	parks, state lakes, recreational grounds, wildlife areas, sanctuaries, fish
25	25	hatcheries, natural areas and historic sites;
26	26	(2) "migratory waterfowl" means any wild goose, duck or merganser;
27	27	and
28	28	(3) "nonresident" means any person who has not been a bona fide
29	29	resident of this state for the immediately preceding 60 days. "Nonresident"
30	30	does not include:
31	31	(A) A nonresident lifetime license holder pursuant to K.S.A. 32-930,
32	32	and amendments thereto; or
33	33	(B) a nonresident entitled to resident licenses, permits, stamps and
34	34	other issues as authorized by K.S.A. 32-980, and amendments thereto.
35	35	(b) (1) Except as otherwise provided by law or rules and regulations
36	36	of the secretary and in addition to any other license, permit or stamp
37	37	required by law or rules and regulations of the secretary, a valid state
38	38	migratory waterfowl habitat stamp is required to hunt any migratory
39	39	waterfowl in this state.

76	76	(c)(2) The provisions of subsection (b) paragraph (1) do not apply to
77	77	hunting, by legal means, by a person not required by K.S.A. 32-919, and
78	78	amendments thereto, to hold a hunting license.
79	79	(d)(c) The stamp required by this section is valid throughout the state.
80	80	(e)(d) The stamp required by this section is valid from the date of
81	81	issuance and expires at 12 midnight on June 30 following its the issuance
82	82	of such stamp.
83	83	(f)(e) Each migratory waterfowl habitat stamp shall be validated by
84	84	the signature of the stamp holder written across the face of such stamp.
85	85	(f) The fee for a waterfowl stamp shall be the amount prescribed
86	86	pursuant to K.S.A. 32-988, and amendments thereto.
87	87	(g) Nonresidents shall not hunt or take migratory waterfowl except
88	88	on Sundays, Mondays and Tuesdays during any established hunting
89	89	season for migratory waterfowl.
90	90	(h) The restriction set forth by subsection (g) shall apply to:
91	91	(1) Department lands and waters;
92	92	(2) federal lands and waters owned by the United States and
93	93	administered by:
94	94	(A) The secretary of the army, United States army corps of engineers
95	95	at:
96	96	(i) The Big Hill, Clinton, Council Grove, El Dorado, Elk City, Fall
97	97	River, Hillsdale, John Redmond, Kanopolis, Marion, Melvern, Milford,
98	98	Perry, Pomona, Toronto, Tuttle Creek and Wilson reservoirs; and
99	99	(ii) Missouri river fish and wildlife mitigation lands, including, but
100	100	not limited to, Benedictine Bottoms, Burr Oak, Dalbey, Elwood and Oak
101	101	Mills;
102	102	(B) the United States department of the interior, bureau of
103	103	reclamation at Cedar Bluff, Cheney, Glen Elder, Lovewell, Norton and
104	104	Webster reservoirs; and
105	105	(C) the United States department of the interior, United States fish
106	106	and wildlife service at Flint Hills national wildlife refuge, Quivira
107	107	national refuge, Marais Des Cygnes national wildlife refuge and Kirwin
108	108	national wildlife refuges.
109	109	(i) The restriction set forth by subsection (g) shall not apply to:
110	110	(1) Property enrolled and designated as either a walk-in hunting
111	111	access area or an interactive walk-in hunting access area;
112	112	(2) navigable rivers in Kansas; or
113	113	(3) the conservation order for light geese season as provided in 50
114	114	C.F.R. § 21.180.
115	115	Sec. 2. K.S.A. 2024 Supp. 32-988 is hereby amended to read as
116	116	follows: 32-988. (a) The secretary is authorized to adopt, in accordance
117	117	with K.S.A. 32-805, and amendments thereto, rules and regulations fixing
118	118	the amount of fees for the following items, subject to the following

335	335	(c) The fee for a big game or wild turkey hunting permit for a resident
336	336	under 16 years of age shall be an amount not to exceed

359	359	(f) Any person who is a resident of this state and satisfies the
360	360	requirements to be considered a disabled veteran under K.S.A. 2024 Supp.
361	361	32-934, and amendments thereto, shall be exempt from the hunting and
362	362	fishing license fees listed in subsection (a).
363	363	(g) The secretary may establish, by rules and regulations adopted in
364	364	accordance with K.S.A. 32-805, and amendments thereto, different fees for
365	365	various classes and types of licenses, permits, stamps and other issuances
366	366	of the department which may occur within each item as described under
367	367	subsection (a).
368	368	Sec. 3. K.S.A. 32-939 and K.S.A. 2024 Supp. 32-988 are hereby
369	369	repealed.
370	370	Sec. 4. This act shall take effect and be in force from and after its
371	371	publication in the statute book.
