55 AN ACT concerning wildlife; relating to hunting; prohibiting nonresidents
66 from hunting migratory waterfowl during the hunting season except on
77 Sundays, Mondays and Tuesdays; applying such restriction to
88 department lands and waters, federal lands and waters managed by the
99 United States army corps of engineers at specified reservoirs, the
1010 bureau of reclamation at certain reservoirs and the United States fish
1111 and wildlife service at designated refuges; exempting properties
1212 designated as walk-in hunting access areas, navigable rivers in Kansas
1313 and the conservation order for light geese season from such restriction;
1414 reducing fees for migratory waterfowl habitat stamps; amending K.S.A.
1515 32-939 and K.S.A. 2024 Supp. 32-988 and repealing the existing
1616 sections.
1717 Be it enacted by the Legislature of the State of Kansas:
1818 Section 1. K.S.A. 32-939 is hereby amended to read as follows: 32-
1919 939. (a) As used in this section,:
2020 (1) "Department lands and waters" means lands, waters and facilities
2121 that are under the jurisdiction and control of the secretary through
2222 ownership, lease, license, cooperative agreement, memorandum of
2323 understanding or other arrangement, including, but not limited to, state
2424 parks, state lakes, recreational grounds, wildlife areas, sanctuaries, fish
2525 hatcheries, natural areas and historic sites;
2626 (2) "migratory waterfowl" means any wild goose, duck or merganser;
2727 and
2828 (3) "nonresident" means any person who has not been a bona fide
2929 resident of this state for the immediately preceding 60 days. "Nonresident"
3030 does not include:
3131 (A) A nonresident lifetime license holder pursuant to K.S.A. 32-930,
3232 and amendments thereto; or
3333 (B) a nonresident entitled to resident licenses, permits, stamps and
3434 other issues as authorized by K.S.A. 32-980, and amendments thereto.
3535 (b) (1) Except as otherwise provided by law or rules and regulations
3636 of the secretary and in addition to any other license, permit or stamp
3737 required by law or rules and regulations of the secretary, a valid state
3838 migratory waterfowl habitat stamp is required to hunt any migratory
3939 waterfowl in this state.

7676 (c)(2) The provisions of subsection (b) paragraph (1) do not apply to
7777 hunting, by legal means, by a person not required by K.S.A. 32-919, and
7878 amendments thereto, to hold a hunting license.
7979 (d)(c) The stamp required by this section is valid throughout the state.
8080 (e)(d) The stamp required by this section is valid from the date of
8181 issuance and expires at 12 midnight on June 30 following its the issuance
8282 of such stamp.
8383 (f)(e) Each migratory waterfowl habitat stamp shall be validated by
8484 the signature of the stamp holder written across the face of such stamp.
8585 (f) The fee for a waterfowl stamp shall be the amount prescribed
8686 pursuant to K.S.A. 32-988, and amendments thereto.
8787 (g) Nonresidents shall not hunt or take migratory waterfowl except
8888 on Sundays, Mondays and Tuesdays during any established hunting
8989 season for migratory waterfowl.
9090 (h) The restriction set forth by subsection (g) shall apply to:
9191 (1) Department lands and waters;
9292 (2) federal lands and waters owned by the United States and
9393 administered by:
9494 (A) The secretary of the army, United States army corps of engineers
9595 at:
9696 (i) The Big Hill, Clinton, Council Grove, El Dorado, Elk City, Fall
9797 River, Hillsdale, John Redmond, Kanopolis, Marion, Melvern, Milford,
9898 Perry, Pomona, Toronto, Tuttle Creek and Wilson reservoirs; and
9999 (ii) Missouri river fish and wildlife mitigation lands, including, but
100100 not limited to, Benedictine Bottoms, Burr Oak, Dalbey, Elwood and Oak
101101 Mills;
102102 (B) the United States department of the interior, bureau of
103103 reclamation at Cedar Bluff, Cheney, Glen Elder, Lovewell, Norton and
104104 Webster reservoirs; and
105105 (C) the United States department of the interior, United States fish
106106 and wildlife service at Flint Hills national wildlife refuge, Quivira
107107 national refuge, Marais Des Cygnes national wildlife refuge and Kirwin
108108 national wildlife refuges.
109109 (i) The restriction set forth by subsection (g) shall not apply to:
110110 (1) Property enrolled and designated as either a walk-in hunting
111111 access area or an interactive walk-in hunting access area;
112112 (2) navigable rivers in Kansas; or
113113 (3) the conservation order for light geese season as provided in 50
114114 C.F.R. § 21.180.
115115 Sec. 2. K.S.A. 2024 Supp. 32-988 is hereby amended to read as
116116 follows: 32-988. (a) The secretary is authorized to adopt, in accordance
117117 with K.S.A. 32-805, and amendments thereto, rules and regulations fixing
118118 the amount of fees for the following items, subject to the following

335335 (c) The fee for a big game or wild turkey hunting permit for a resident

359359 (f) Any person who is a resident of this state and satisfies the
360360 requirements to be considered a disabled veteran under K.S.A. 2024 Supp.
361361 32-934, and amendments thereto, shall be exempt from the hunting and
362362 fishing license fees listed in subsection (a).
363363 (g) The secretary may establish, by rules and regulations adopted in
364364 accordance with K.S.A. 32-805, and amendments thereto, different fees for
365365 various classes and types of licenses, permits, stamps and other issuances
366366 of the department which may occur within each item as described under
367367 subsection (a).
368368 Sec. 3. K.S.A. 32-939 and K.S.A. 2024 Supp. 32-988 are hereby
369369 repealed.
370370 Sec. 4. This act shall take effect and be in force from and after its
371371 publication in the statute book.
