| 5 | 5 | | AN ACT concerning children and minors; relating to child labor; |

| 6 | 6 | | increasing the penalty for unlawful employment of any person or child; |

| 7 | 7 | | amending K.S.A. 38-612 and repealing the existing section. |

| 8 | 8 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 9 | 9 | | Section 1. K.S.A. 38-612 is hereby amended to read as follows: 38- |
|---|
| 10 | 10 | | 612. That (a) Any person, firm or corporation employing any person or |
|---|
| 11 | 11 | | child in violation of any provision of this act, or permitting or conniving at |
|---|
| 12 | 12 | | such violation, shall be deemed guilty of a misdemeanor, and upon |
|---|
| 13 | 13 | | conviction thereof shall be fined in a sum not less than twenty-five dollars |
|---|
| 14 | 14 | | nor more than one hundred dollars, or by imprisonment in the county jail |
|---|
| 15 | 15 | | for a period of not less than thirty days nor more than ninety days: |
|---|
| 16 | 16 | | (1) Class A person misdemeanor, except as provided in subsections |
|---|
| 17 | 17 | | (a)(2) and (a)(3); |
|---|
| 18 | 18 | | (2) severity level 7, person felony upon a second conviction; and |
|---|
| 19 | 19 | | (3) severity level 5, person felony upon a third or subsequent |
|---|
| 20 | 20 | | conviction. |
|---|
| 21 | 21 | | (b) In addition to any other criminal penalties provided by law, any |
|---|
| 22 | 22 | | person convicted of a violation of this section for a second time shall pay a |
|---|
| 23 | 23 | | fine in an amount of $25,000 and any person convicted of a violation of |
|---|
| 24 | 24 | | this section for a third or subsequent time shall pay a fine in an amount of |
|---|
| 25 | 25 | | $50,000. |
|---|
| 26 | 26 | | Sec. 2. K.S.A. 38-612 is hereby repealed. |
|---|
| 27 | 27 | | Sec. 3. This act shall take effect and be in force from and after its |
|---|
| 28 | 28 | | publication in the statute book. |
