55 AN ACT concerning children and minors; relating to child labor;
66 increasing the penalty for unlawful employment of any person or child;
77 amending K.S.A. 38-612 and repealing the existing section.
88 Be it enacted by the Legislature of the State of Kansas:
99 Section 1. K.S.A. 38-612 is hereby amended to read as follows: 38-
1010 612. That (a) Any person, firm or corporation employing any person or
1111 child in violation of any provision of this act, or permitting or conniving at
1212 such violation, shall be deemed guilty of a misdemeanor, and upon
1313 conviction thereof shall be fined in a sum not less than twenty-five dollars
1414 nor more than one hundred dollars, or by imprisonment in the county jail
1515 for a period of not less than thirty days nor more than ninety days:
1616 (1) Class A person misdemeanor, except as provided in subsections
1717 (a)(2) and (a)(3);
1818 (2) severity level 7, person felony upon a second conviction; and
1919 (3) severity level 5, person felony upon a third or subsequent
2020 conviction.
2121 (b) In addition to any other criminal penalties provided by law, any
2222 person convicted of a violation of this section for a second time shall pay a
2323 fine in an amount of $25,000 and any person convicted of a violation of
2424 this section for a third or subsequent time shall pay a fine in an amount of
2525 $50,000.
2626 Sec. 2. K.S.A. 38-612 is hereby repealed.
2727 Sec. 3. This act shall take effect and be in force from and after its
2828 publication in the statute book.
