| 7 | 7 | | contains a neonicotinoid unless otherwise ordered by the governor |

| 8 | 8 | | under certain conditions. |
|---|
| 9 | 9 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 10 | 10 | | Section 1. (a) Except as otherwise provided in chapter 2, article 47 of |
|---|
| 11 | 11 | | the Kansas Statutes Annotated, and amendments thereto, and subsection |
|---|
| 12 | 12 | | (b), on and after January 1, 2028, it shall be unlawful for any person to |
|---|
| 13 | 13 | | sell, offer for sale or use or distribute within the state any seed that has |
|---|
| 14 | 14 | | been coated or treated with a pesticide that has one or more of the |
|---|
| 15 | 15 | | following active ingredients: Clothianidin, imidacloprid, thiamethoxam, |
|---|
| 16 | 16 | | dinotefuran or acetamiprid. |
|---|
| 17 | 17 | | (b) The governor may, by executive order, suspend the prohibition in |
|---|
| 18 | 18 | | subsection (a) for a period of not more than one year, if the governor |
|---|
| 19 | 19 | | determines, after consulting with the secretary of agriculture, that there is a |
|---|
| 20 | 20 | | lack of commercially available seed that has not been coated or treated |
|---|
| 21 | 21 | | with a pesticide that has such active ingredient or the purchase of a seed |
|---|
| 22 | 22 | | that has not been coated or treated with a pesticide that has such active |
|---|
| 23 | 23 | | ingredient would result in undue financial hardship to agricultural |
|---|
| 24 | 24 | | producers. Any such executive order shall specify the type of seed for |
|---|
| 25 | 25 | | which the prohibition is suspended. |
|---|
| 26 | 26 | | (c) This section shall be a part of and supplemental to chapter 2, |
|---|
| 27 | 27 | | article 47 of the Kansas Statutes Annotated, and amendments thereto. |
|---|
| 28 | 28 | | Sec. 2. This act shall take effect and be in force from and after its |
|---|
| 29 | 29 | | publication in the statute book. |
