5	5	AN ACT concerning retirement and pensions; relating to the Kansas public
6	6	employees retirement system; providing for a postretirement cost-of-
7	7	living adjustment for certain retirants; making and concerning
8	8	appropriations for the fiscal year ending June 30, 2026, for the Kansas
9	9	public employees retirement system.
10	10	Be it enacted by the Legislature of the State of Kansas:
11	11	Section 1.
12	12	KANSAS PUBLIC EMPLOYEES
13	13	RETIREMENT SYSTEM
14	14	(a) There is appropriated for the above agency from the state general
15	15	fund for the fiscal year ending June 30, 2026, the following:
16	16	Cost-of-living adjustment payment..........................................$136,400,000
17	17	Provided, That all expenditures from the cost-of-living adjustment
18	18	payment account shall be made by the above agency for the purpose of
19	19	paying the actuarial cost to the retirement system for the cost-of-living
20	20	adjustment authorized by section 2, and amendments thereto.
21	21	Sec. 2. (a) The retirement benefit, pension or annuity payments
22	22	accruing after June 30, 2025, to each retirant shall be increased by a cost-
23	23	of-living adjustment in an amount as provided in subsection (b). Such
24	24	payments shall be paid by the retirement system to the retirant.
25	25	(b) (1) Except as provided in paragraph (2), each retirant who is
26	26	entitled to receive a retirement benefit, pension or annuity payment from
27	27	the retirement system on July 1, 2025, shall have such retirement benefit,
28	28	pension or annuity increased in accordance with the following schedule.
29	29	For those retirants whose date of retirement is:
30	30	(A) On or before July 1, 2015, such benefit, pension or annuity
31	31	payment shall be increased 1% of the retirement benefit, pension or
32	32	annuity payment in effect on July 1, 2025;
33	33	(B) on or before July 1, 2011, such benefit, pension or annuity
34	34	payment shall be increased 2% of the retirement benefit, pension or
35	35	annuity payment in effect on July 1, 2025;
36	36	(C) on or before July 1, 2007, such benefit, pension or annuity
37	37	payment shall be increased 3% of the retirement benefit, pension or
38	38	annuity payment in effect on July 1, 2025;
39	39	(D) on or before July 1, 2003, such benefit, pension or annuity

76	76	payment shall be increased 4% of the retirement benefit, pension or
77	77	annuity payment in effect on July 1, 2025; and
78	78	(E) on or before July 1, 1999, such benefit, pension or annuity
79	79	payment shall be increased 5% of the retirement benefit, pension or
80	80	annuity payment in effect on July 1, 2025.
81	81	(2) In no event shall the increase in the monthly benefit amount
82	82	provided by this subsection exceed $100.
83	83	(c) As used in this section:
84	84	(1) "Insured disability benefit recipient" means any person who is a
85	85	member or special member of the retirement system pursuant to the
86	86	provisions of K.S.A. 74-4911 or 74-49,203, and and amendments thereto,
87	87	and receiving an insured disability benefit under K.S.A. 74-4927, and
88	88	amendments thereto;
89	89	(2) "retirement system" means the Kansas public employees
90	90	retirement system; and
91	91	(3) "retirant" means any:
92	92	(A) Person who is a member or special member of the retirement
93	93	system pursuant to the provisions of K.S.A. 74-4911 or 74-49,203, and
94	94	amendments thereto, and who has been retired for at least 10 years;
95	95	(B) person who is a joint annuitant or beneficiary of any member
96	96	described in subparagraph (A); and
97	97	(C) insured disability benefit recipient.
98	98	(e) This section shall be a part of and supplemental to K.S.A. 74-4901
99	99	et seq., and amendments thereto.
100	100	Sec. 3. This act shall take effect and be in force from and after its
101	101	publication in the statute book.
