55 AN ACT concerning retirement and pensions; relating to the Kansas public
66 employees retirement system; providing for a postretirement cost-of-
77 living adjustment for certain retirants; making and concerning
88 appropriations for the fiscal year ending June 30, 2026, for the Kansas
99 public employees retirement system.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. 
1212 KANSAS PUBLIC EMPLOYEES
1313 RETIREMENT SYSTEM
1414 (a) There is appropriated for the above agency from the state general
1515 fund for the fiscal year ending June 30, 2026, the following:
1616 Cost-of-living adjustment payment..........................................$136,400,000
1717 Provided, That all expenditures from the cost-of-living adjustment
1818 payment account shall be made by the above agency for the purpose of
1919 paying the actuarial cost to the retirement system for the cost-of-living
2020 adjustment authorized by section 2, and amendments thereto.
2121 Sec. 2. (a) The retirement benefit, pension or annuity payments
2222 accruing after June 30, 2025, to each retirant shall be increased by a cost-
2323 of-living adjustment in an amount as provided in subsection (b). Such
2424 payments shall be paid by the retirement system to the retirant.
2525 (b) (1) Except as provided in paragraph (2), each retirant who is
2626 entitled to receive a retirement benefit, pension or annuity payment from
2727 the retirement system on July 1, 2025, shall have such retirement benefit,
2828 pension or annuity increased in accordance with the following schedule.
2929 For those retirants whose date of retirement is:
3030 (A) On or before July 1, 2015, such benefit, pension or annuity
3131 payment shall be increased 1% of the retirement benefit, pension or
3232 annuity payment in effect on July 1, 2025;
3333 (B) on or before July 1, 2011, such benefit, pension or annuity
3434 payment shall be increased 2% of the retirement benefit, pension or
3535 annuity payment in effect on July 1, 2025;
3636 (C) on or before July 1, 2007, such benefit, pension or annuity
3737 payment shall be increased 3% of the retirement benefit, pension or
3838 annuity payment in effect on July 1, 2025;
3939 (D) on or before July 1, 2003, such benefit, pension or annuity

7676 payment shall be increased 4% of the retirement benefit, pension or
7777 annuity payment in effect on July 1, 2025; and
7878 (E) on or before July 1, 1999, such benefit, pension or annuity
7979 payment shall be increased 5% of the retirement benefit, pension or
8080 annuity payment in effect on July 1, 2025.
8181 (2) In no event shall the increase in the monthly benefit amount
8282 provided by this subsection exceed $100.
8383 (c) As used in this section:
8484 (1) "Insured disability benefit recipient" means any person who is a
8585 member or special member of the retirement system pursuant to the
8686 provisions of K.S.A. 74-4911 or 74-49,203, and and amendments thereto,
8787 and receiving an insured disability benefit under K.S.A. 74-4927, and
8888 amendments thereto;
8989 (2) "retirement system" means the Kansas public employees
9090 retirement system; and
9191 (3) "retirant" means any:
9292 (A) Person who is a member or special member of the retirement
9393 system pursuant to the provisions of K.S.A. 74-4911 or 74-49,203, and
9494 amendments thereto, and who has been retired for at least 10 years;
9595 (B) person who is a joint annuitant or beneficiary of any member
9696 described in subparagraph (A); and
9797 (C) insured disability benefit recipient.
9898 (e) This section shall be a part of and supplemental to K.S.A. 74-4901
9999 et seq., and amendments thereto.
100100 Sec. 3. This act shall take effect and be in force from and after its
101101 publication in the statute book.
