| 6 | 6 | | with or participating in immigration enforcement by the United States |
|---|
| 7 | 7 | | immigration and customs enforcement in places of worship, schools |
|---|
| 8 | 8 | | and hospitals. |
|---|
| 9 | 9 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 10 | 10 | | Section 1. (a) Notwithstanding any provision of law to the contrary, |
|---|
| 11 | 11 | | no law enforcement agency or officer shall assist United States |
|---|
| 12 | 12 | | immigration and customs enforcement in the: |
|---|
| 13 | 13 | | (1) Apprehension or arrest of persons for alleged or suspected |
|---|
| 14 | 14 | | immigration violations in or on the premises of a place of religious |
|---|
| 15 | 15 | | worship, school or hospital; or |
|---|
| 16 | 16 | | (2) service of warrants for removal of persons from the United States |
|---|
| 17 | 17 | | in or on the premises of a place of religious worship, school or hospital. |
|---|
| 18 | 18 | | (b) Any current or future memorandum, agreement or contract made |
|---|
| 19 | 19 | | between a law enforcement agency or any state agency or officer and |
|---|
| 20 | 20 | | United States immigration and customs enforcement shall be void to the |
|---|
| 21 | 21 | | extent that the performance of the memorandum, agreement or contract |
|---|
| 22 | 22 | | would violate subsection (a). |
|---|
| 23 | 23 | | (c) Knowingly violating subsection (a) by a law enforcement officer |
|---|
| 24 | 24 | | may be used as grounds for the suspension, revocation or denial of the |
|---|
| 25 | 25 | | certification of such law enforcement officer required by state law. |
|---|
| 26 | 26 | | (d) Nothing in this section shall be construed to prohibit law |
|---|
| 27 | 27 | | enforcement agencies or law enforcement officers from enforcing the laws |
|---|
| 28 | 28 | | of this state to the extent authorized by law. |
|---|
| 29 | 29 | | (e) For purposes of this section: |
|---|
| 30 | 30 | | (1) "Law enforcement agency" means any public agency that |
|---|
| 31 | 31 | | employs law enforcement officers. For purposes of this paragraph, "public |
|---|
| 32 | 32 | | agency" includes any state or local agency as defined in K.S.A. 75-5274, |
|---|
| 33 | 33 | | and amendments thereto. |
|---|
| 34 | 34 | | (2) "Law enforcement officer" means the same as defined in K.S.A. |
|---|
| 35 | 35 | | 22-2202, and amendments thereto. |
|---|
| 36 | 36 | | (3) "Hospital" means a medical care facility, as defined in K.S.A. 65- |
|---|
| 37 | 37 | | 425, and amendments thereto, and any facility that provides medical or |
|---|
| 38 | 38 | | healthcare services, including, but not limited to, a medical clinic, |
|---|
| 39 | 39 | | emergency medical service, urgent care facility, mental health center, |
|---|

|---|
| 77 | 77 | | (4) "Place of religious worship" includes, but is not limited to, a |
|---|
| 78 | 78 | | church, chapel, meetinghouse, synagogue, temple, mosque or any other |
|---|
| 79 | 79 | | building that is regularly used and clearly identifiable as a place for |
|---|
| 80 | 80 | | religious worship. |
|---|
| 81 | 81 | | (5) "School" means: |
|---|
| 82 | 82 | | (A) Any preschool, elementary school or secondary school |
|---|
| 83 | 83 | | maintained and operated by a school district; |
|---|
| 84 | 84 | | (B) any nonpublic organization that regularly offers preschool |
|---|
| 85 | 85 | | educational or other programs or education satisfying the compulsory |
|---|
| 86 | 86 | | school attendance laws of this state at the elementary or secondary level, |
|---|
| 87 | 87 | | whether or not accredited by the state board of education; |
|---|
| 88 | 88 | | (C) the site of any trade, technical or vocational training offered by a |
|---|
| 89 | 89 | | school, whether or not located on school property; or |
|---|
| 90 | 90 | | (D) the site of any school-sponsored function, event or activity, |
|---|
| 91 | 91 | | whether or not located on school property. |
|---|
| 92 | 92 | | Sec. 2. This act shall take effect and be in force from and after its |
|---|
| 93 | 93 | | publication in the statute book. |
