55 AN ACT prohibiting law enforcement agencies or officers from assisting
66 with or participating in immigration enforcement by the United States
77 immigration and customs enforcement in places of worship, schools
88 and hospitals.
99 Be it enacted by the Legislature of the State of Kansas:
1010 Section 1. (a) Notwithstanding any provision of law to the contrary,
1111 no law enforcement agency or officer shall assist United States
1212 immigration and customs enforcement in the:
1313 (1) Apprehension or arrest of persons for alleged or suspected
1414 immigration violations in or on the premises of a place of religious
1515 worship, school or hospital; or
1616 (2) service of warrants for removal of persons from the United States
1717 in or on the premises of a place of religious worship, school or hospital.
1818 (b) Any current or future memorandum, agreement or contract made
1919 between a law enforcement agency or any state agency or officer and
2020 United States immigration and customs enforcement shall be void to the
2121 extent that the performance of the memorandum, agreement or contract
2222 would violate subsection (a).
2323 (c) Knowingly violating subsection (a) by a law enforcement officer
2424 may be used as grounds for the suspension, revocation or denial of the
2525 certification of such law enforcement officer required by state law.
2626 (d) Nothing in this section shall be construed to prohibit law
2727 enforcement agencies or law enforcement officers from enforcing the laws
2828 of this state to the extent authorized by law.
2929 (e) For purposes of this section:
3030 (1) "Law enforcement agency" means any public agency that
3131 employs law enforcement officers. For purposes of this paragraph, "public
3232 agency" includes any state or local agency as defined in K.S.A. 75-5274,
3333 and amendments thereto.
3434 (2) "Law enforcement officer" means the same as defined in K.S.A.
3535 22-2202, and amendments thereto.
3636 (3) "Hospital" means a medical care facility, as defined in K.S.A. 65-
3737 425, and amendments thereto, and any facility that provides medical or
3838 healthcare services, including, but not limited to, a medical clinic,
3939 emergency medical service, urgent care facility, mental health center,

7676 facility or clinic or a public health department.
7777 (4) "Place of religious worship" includes, but is not limited to, a
7878 church, chapel, meetinghouse, synagogue, temple, mosque or any other
7979 building that is regularly used and clearly identifiable as a place for
8080 religious worship.
8181 (5) "School" means:
8282 (A) Any preschool, elementary school or secondary school
8383 maintained and operated by a school district;
8484 (B) any nonpublic organization that regularly offers preschool
8585 educational or other programs or education satisfying the compulsory
8686 school attendance laws of this state at the elementary or secondary level,
8787 whether or not accredited by the state board of education;
8888 (C) the site of any trade, technical or vocational training offered by a
8989 school, whether or not located on school property; or
9090 (D) the site of any school-sponsored function, event or activity,
9191 whether or not located on school property.
9292 Sec. 2. This act shall take effect and be in force from and after its
9393 publication in the statute book.
