55 AN ACT concerning industrial hemp; relating to hemp-derived
66 cannabinoid products; prohibiting the transfer of such products to any
77 person under the age of 21; establishing packaging and labeling
88 requirements for such products; amending the definition of industrial
99 hemp and hemp products; amending K.S.A. 2-3908 and K.S.A. 2024
1010 Supp. 2-3901, 21-5701 and 65-4101 and repealing the existing sections.
1111 Be it enacted by the Legislature of the State of Kansas:
1212 New Section 1. (a) As used in this section:
1313 (1) "Approved source" means:
1414 (A) A person authorized to produce industrial hemp under a state or
1515 federal plan in accordance with 7 U.S.C. § 1621 et seq., and amendments
1616 thereto;
1717 (B) a person registered as an industrial hemp processor by the state
1818 fire marshal; or
1919 (C) a person authorized by another state to process industrial hemp or
2020 manufacture hemp products if such state has been approved by the Kansas
2121 department of agriculture as having equivalent state standards for
2222 processing, laboratory testing and labeling requirements;
2323 (2) "cartoon" means any drawing or other depiction of an object,
2424 person, animal, creature or any similar caricature that satisfies any of the
2525 following criteria:
2626 (A) The use of comically exaggerated features;
2727 (B) the attribution of human characteristics to animals, plants or other
2828 objects, or the similar use of anthropomorphic technique; or
2929 (C) the attribution of unnatural or extra-human abilities, such as
3030 imperviousness to pain or injury, X-ray vision, tunneling at very high
3131 speeds or transformation;
3232 (3) "child-resistant" means packaging that is:
3333 (A) Designed or constructed to be significantly difficult for children
3434 under five years of age to open yet not difficult for adults to use properly;
3535 and
3636 (B) resealable for any product intended for more than a single use or
3737 containing multiple servings;
3838 (4) "cosmetic" means the same as defined in K.S.A. 65-656, and
3939 amendments thereto;

7676 (5) "department" means the Kansas department of agriculture;
7777 (6) "hemp-derived cannabinoid product" means an ingestible,
7878 inhalable or cosmetic product that is processed or derived from industrial
7979 hemp; and
8080 (7) "industrial hemp" means the same as defined in K.S.A. 2-3901,
8181 and amendments thereto.
8282 (b) All hemp-derived cannabinoid products sold in a retail
8383 establishment shall:
8484 (1) Be from an approved source;
8585 (2) be packaged and labeled in accordance with this section; and
8686 (3) have a valid printed certificate of analysis available upon request.
8787 (c) A hemp-derived cannabinoid product, excluding cosmetics, shall
8888 not be sold, gifted or otherwise transferred to any person under the age of
8989 21.
9090 (d) (1) Each hemp-derived cannabinoid product sold or otherwise
9191 distributed in the state shall bear labeling to allow the consumer to access
9292 information on the product, including a certificate of analysis for the
9393 product, the location where the hemp was grown and the address and
9494 phone number of the manufacturer or distributor. Such labeling shall
9595 utilize the following:
9696 (A) A scanning bar code, including the batch number or serial
9797 number of the product;
9898 (B) a quick-response code; or
9999 (C) a web address linked to a document or website.
100100 (2) No product labeling or advertising material for any hemp-derived
101101 cannabinoid product sold or otherwise distributed in the state shall bear
102102 any claims stating that the product can diagnose, treat, cure or prevent any
103103 disease.
104104 (3) Each container or package of hemp-derived cannabinoid product,
105105 excluding cosmetics, shall:
106106 (A) Have a tamper-evident seal; and
107107 (B) be in child-resistant packaging.
108108 (4) Each container or package of hemp-derived cannabinoid product
109109 that is a cosmetic shall have a tamper-evident seal.
110110 (5) Hemp-derived cannabinoid product packaging shall not include:
111111 (A) Any cartoon images;
112112 (B) likeness to images, characters or phrases that are popularly used
113113 to advertise to children;
114114 (C) likeness to or imitation of any commercially available candy,
115115 snack, baked good or beverage packaging or labeling;
116116 (D) the terms "candy" or "candies", or any variation in the spelling of
117117 these words; or
118118 (E) the logo of the department, or any seal, flag, crest, coat of arms or

162162 other insignia that could reasonably mislead any person to believe the
163163 product has been endorsed, manufactured or used by any state, county, or
164164 municipality or any agency thereof, excluding the use of seals associated
165165 with state or federal programs used in accordance with state or federal law.
166166 Sec. 2. K.S.A. 2024 Supp. 2-3901 is hereby amended to read as
167167 follows: 2-3901. (a) K.S.A. 2-3901 et seq., and amendments thereto, shall
168168 be known and may be cited as the commercial industrial hemp act.
169169 (b) As used in the commercial industrial hemp act:
170170 (1) "Commercial" means the cultivation or production of industrial
171171 hemp for any purpose authorized under K.S.A 2-3906, and amendments
172172 thereto.
173173 (2) "Delta-9 tetrahydrocannabinol concentration" means the
174174 combined percentage of delta-9 tetrahydrocannabinol and its optical
175175 isomers, their salts and acids, and salts of their acids, reported as free
176176 THC:
177177 (A) On a dry weight basis, of any part of the plant cannabis sativa L.;
178178 or
179179 (B) on a percentage by weight basis in hemp products, waste or
180180 substances resulting from the production or processing of industrial hemp.
181181 (3) "Effective disposal" includes, but is not limited to:
182182 (A) Destruction; or
183183 (B) any other method of disposing of industrial hemp or hemp
184184 products found to be in violation of this act that is permitted under the
185185 provisions of 7 U.S.C. § 1621 et seq. and any rules and regulations
186186 adopted thereunder.
187187 (4) "Hemp products" means all products made from industrial hemp,
188188 including, but not limited to, cloth, cordage, fiber, food, fuel, hemp-
189189 derived cannabinoid products, paint, paper, particleboard, plastics, seed,
190190 seed meal and seed oil for consumption and any extract from industrial
191191 hemp intended for further processing. Final "hemp products" may contain
192192 a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a
193193 dry weight basis. As used in this paragraph, "tetrahydrocannabinol
194194 concentration" means the same as in K.S.A. 65-6235(b)(3), and
195195 amendments thereto.
196196 (5) "Hemp producer" means any individual, licensed or otherwise,
197197 engaging in the cultivation or production of industrial hemp for
198198 commercial purposes pursuant to K.S.A. 2-3906, and amendments thereto.
199199 (6) "Hemp processor" means a person registered under K.S.A. 2-
200200 3907, and amendments thereto, to process and manufacture industrial
201201 hemp and hemp products.
202202 (7) "Industrial hemp" or "hemp" means all parts and varieties of the
203203 plant cannabis sativa L., and any part of that plant, including the seeds
204204 thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts,

248248 and salts of isomers, whether growing or not, that contain with a delta-9
249249 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight
250250 basis.
251251 (8) "Person" means an individual, corporation, partnership,
252252 association, joint stock company, trust, unincorporated organization or any
253253 similar entity or any combination of the foregoing acting in concert.
254254 (9) "State educational institution" means the university of Kansas,
255255 Kansas state university, Wichita state university, Emporia state university,
256256 Pittsburg state university, Fort Hays state university, or any other
257257 accredited college, university, technical college or community college
258258 within Kansas.
259259 (10) "Authorized seed or clone plants" means a source of industrial
260260 hemp seeds or clone plants that:
261261 (A) Has been certified by a certifying agency, as defined by K.S.A. 2-
262262 1415, and amendments thereto;
263263 (B) has been produced from plants that were tested during the active
264264 growing season and were found to produce industrial hemp having a
265265 tetrahydrocannabinol concentration that does not exceed 0.3% on a dry
266266 weight basis and has been certified in writing by the grower or distributor
267267 of such seeds or clone plants to possess such qualities; or
268268 (C) meets any other authorized standards approved by the Kansas
269269 department of agriculture through rules and regulations, except that no
270270 seed or clone plants shall be considered authorized seed or clone plants if
271271 they do not meet any standard adopted by the United States department of
272272 agriculture pursuant to 7 U.S.C. § 1621 et seq., and amendments thereto.
273273 (11) "Hemp employee" means a person who has applied for
274274 employment or is currently employed with the Kansas department of
275275 agriculture who oversees or regulates industrial hemp.
276276 (12) "Applicant" means a person who has submitted an application
277277 for licensure as a hemp producer or registration as a hemp processor.
278278 (13) "Hemp destruction employee" means an employee or agent of
279279 the Kansas department of agriculture who participates in the effective
280280 disposal of industrial hemp.
281281 Sec. 3. K.S.A. 2-3908 is hereby amended to read as follows: 2-3908.
282282 (a) (1) It shall be unlawful for any of the following hemp products product
283283 to be manufactured, marketed, sold or distributed by any person in the
284284 state of Kansas:
285285 (A) Cigarettes containing industrial hemp;
286286 (B) cigars containing industrial hemp;
287287 (C) chew, dip or other smokeless material containing industrial hemp;
288288 (D) teas containing industrial hemp;
289289 (E) liquids, solids or gases containing industrial hemp for use in
290290 vaporizing devices; and

334334 (F) any other hemp product that is intended for human or animal
335335 consumption containing any ingredient derived from industrial hemp that
336336 is prohibited pursuant to the Kansas food, drug and cosmetic act, K.S.A.
337337 65-636 et seq., and amendments thereto, and the commercial feeding stuffs
338338 act, K.S.A. 2-1001 et seq., and amendments thereto. This subparagraph
339339 shall not otherwise prohibit the use of any such ingredient, including
340340 cannabidiol oil, in such hemp products.
341341 (2) A dietary supplement, food, beverage or cosmetic product is not
342342 adulterated by the inclusion of industrial hemp as long as the industrial
343343 hemp in such product meets the requirements in K.S.A. 2-3901 et seq., and
344344 amendments thereto. The sale of a dietary supplement, food, beverage or
345345 cosmetic that includes industrial hemp shall not be restricted or prohibited
346346 based solely on the inclusion of industrial hemp, provided that the
347347 industrial hemp in the product meets the requirements in K.S.A. 2-3901 et
348348 seq., and amendments thereto.
349349 (2)(3) As used in this subsection:
350350 (A) "Human or animal consumption" means:
351351 (i) Ingested orally; or
352352 (ii) applied by any means such that an ingredient derived from
353353 industrial hemp enters the human or animal body.
354354 (B) "Intended for human or animal consumption" means:
355355 (i) Designed by the manufacturer for human or animal consumption;
356356 (ii) marketed for human or animal consumption; or
357357 (iii) distributed with the intent that it be used for human or animal
358358 consumption.
359359 (b) (1) It shall be unlawful for any of the following hemp products to
360360 be marketed, sold or distributed to any person in Kansas who is not
361361 registered as a hemp processor pursuant to K.S.A. 2-3907, and
362362 amendments thereto, or who does not possess a license by the Kansas
363363 department of agriculture under any commercial plan established pursuant
364364 to K.S.A. 2-3906, and amendments thereto, or the research program
365365 established pursuant to K.S.A. 2-3902, and amendments thereto:
366366 (A) Industrial hemp buds;
367367 (B) ground industrial hemp floral material;
368368 (C) ground industrial hemp leaf material; or
369369 (D) any extract from industrial hemp with a delta-9
370370 tetrahydrocannabinol concentration greater than 0.3% that will be further
371371 processed.
372372 (2) No license or registration shall be required for the transport of
373373 hemp products described in paragraph (1) if such products are transported
374374 between hemp producers and hemp processors or between more than one
375375 hemp processor. Any such transportation of hemp products shall be subject
376376 to rules and regulations promulgated by the state fire marshal pursuant to

421421 (c) (1) Upon a first conviction for a violation of this section, a person
422422 shall be guilty of a class A nonperson misdemeanor.
423423 (2) On a second or subsequent conviction for a violation of this
424424 section, a person shall be guilty of a severity level 9, nonperson felony.
425425 (d) Nothing in this section shall prohibit:
426426 (1) The use of any hemp product for research purposes by a state
427427 educational institution or affiliated entity; or
428428 (2) the production, use or sale of any hemp product that is otherwise
429429 not prohibited by state or federal law.
430430 (e) This section shall be a part of and supplemental to the commercial
431431 industrial hemp act, K.S.A. 2-3901 et seq., and amendments thereto.
432432 Sec. 4. K.S.A. 2024 Supp. 21-5701 is hereby amended to read as
433433 follows: 21-5701. As used in K.S.A. 21-5701 through 21-5717, and
434434 amendments thereto:
435435 (a) "Controlled substance" means any drug, substance or immediate
436436 precursor included in any of the schedules designated in K.S.A. 65-4105,
437437 65-4107, 65-4109, 65-4111 and 65-4113, and amendments thereto.
438438 (b) (1) "Controlled substance analog" means a substance that is
439439 intended for human consumption, and at least one of the following:
440440 (A) The chemical structure of the substance is substantially similar to
441441 the chemical structure of a controlled substance listed in or added to the
442442 schedules designated in K.S.A. 65-4105 or 65-4107, and amendments
443443 thereto;
444444 (B) the substance has a stimulant, depressant or hallucinogenic effect
445445 on the central nervous system substantially similar to the stimulant,
446446 depressant or hallucinogenic effect on the central nervous system of a
447447 controlled substance included in the schedules designated in K.S.A. 65-
448448 4105 or 65-4107, and amendments thereto; or
449449 (C) with respect to a particular individual, such individual represents
450450 or intends the substance to have a stimulant, depressant or hallucinogenic
451451 effect on the central nervous system substantially similar to the stimulant,
452452 depressant or hallucinogenic effect on the central nervous system of a
453453 controlled substance included in the schedules designated in K.S.A. 65-
454454 4105 or 65-4107, and amendments thereto.
455455 (2) "Controlled substance analog" does not include:
456456 (A) A controlled substance;
457457 (B) a substance for which there is an approved new drug application;
458458 or
459459 (C) a substance with respect to which an exemption is in effect for
460460 investigational use by a particular person under section 505 of the federal
461461 food, drug, and cosmetic act, 21 U.S.C. § 355, to the extent conduct with
462462 respect to the substance is permitted by the exemption.

506506 (c) "Cultivate" means the planting or promotion of growth of five or
507507 more plants that contain or can produce controlled substances.
508508 (d) "Distribute" means the actual, constructive or attempted transfer
509509 from one person to another of some item whether or not there is an agency
510510 relationship. "Distribute" includes, but is not limited to, sale, offer for sale
511511 or any act that causes some item to be transferred from one person to
512512 another. "Distribute" does not include acts of administering, dispensing or
513513 prescribing a controlled substance as authorized by the pharmacy act of the
514514 state of Kansas, the uniform controlled substances act or otherwise
515515 authorized by law.
516516 (e) (1) "Drug" means:
517517 (A) Substances recognized as drugs in the official United States
518518 pharmacopeia, official homeopathic pharmacopoeia of the United States or
519519 official national formulary or any supplement to any of them;
520520 (B) substances intended for use in the diagnosis, cure, mitigation,
521521 treatment or prevention of disease in humans or animals;
522522 (C) substances, other than food, intended to affect the structure or any
523523 function of the body of humans or animals; and
524524 (D) substances intended for use as a component of any article
525525 specified in subparagraph (A), (B) or (C).
526526 (2) "Drug" does not include devices or their components, parts or
527527 accessories.
528528 (f) (1) "Drug paraphernalia" means all equipment and materials of
529529 any kind that are used, or primarily intended or designed for use in
530530 planting, propagating, cultivating, growing, harvesting, manufacturing,
531531 compounding, converting, producing, processing, preparing, testing,
532532 analyzing, packaging, repackaging, storing, containing, concealing,
533533 injecting, ingesting, inhaling or otherwise introducing into the human body
534534 a controlled substance and in violation of this act.
535535 (2) "Drug paraphernalia" includes, but is not limited to:
536536 (A) Kits used or intended for use in planting, propagating, cultivating,
537537 growing or harvesting any species of plant that is a controlled substance or
538538 from which a controlled substance can be derived;
539539 (B) kits used or intended for use in manufacturing, compounding,
540540 converting, producing, processing or preparing controlled substances;
541541 (C) isomerization devices used or intended for use in increasing the
542542 potency of any species of plant that is a controlled substance;
543543 (D) testing equipment used or intended for use in identifying or in
544544 analyzing the strength, effectiveness or purity of controlled substances;
545545 (E) scales and balances used or intended for use in weighing or
546546 measuring controlled substances;
547547 (F) diluents and adulterants, including, but not limited to, quinine
548548 hydrochloride, mannitol, mannite, dextrose and lactose that are used or

592592 intended for use in cutting controlled substances;
593593 (G) separation gins and sifters used or intended for use in removing
594594 twigs and seeds from or otherwise cleaning or refining marijuana;
595595 (H) blenders, bowls, containers, spoons and mixing devices used or
596596 intended for use in compounding controlled substances;
597597 (I) capsules, balloons, envelopes, bags and other containers used or
598598 intended for use in packaging small quantities of controlled substances;
599599 (J) containers and other objects used or intended for use in storing or
600600 concealing controlled substances;
601601 (K) hypodermic syringes, needles and other objects used or intended
602602 for use in parenterally injecting controlled substances into the human
603603 body;
604604 (L) objects used or primarily intended or designed for use in
605605 ingesting, inhaling or otherwise introducing marijuana, cocaine, hashish,
606606 hashish oil, phencyclidine (PCP), methamphetamine or amphetamine into
607607 the human body, such as:
608608 (i) Metal, wooden, acrylic, glass, stone, plastic or ceramic pipes with
609609 or without screens, permanent screens, hashish heads or punctured metal
610610 bowls;
611611 (ii) water pipes, bongs or smoking pipes designed to draw smoke
612612 through water or another cooling device;
613613 (iii) carburetion pipes, glass or other heat-resistant tubes or any other
614614 device used, intended to be used or designed to be used to cause
615615 vaporization of a controlled substance for inhalation;
616616 (iv) smoking and carburetion masks;
617617 (v) roach clips, objects used to hold burning material, such as a
618618 marijuana cigarette, that has become too small or too short to be held in
619619 the hand;
620620 (vi) miniature cocaine spoons and cocaine vials;
621621 (vii) chamber smoking pipes;
622622 (viii) carburetor smoking pipes;
623623 (ix) electric smoking pipes;
624624 (x) air-driven smoking pipes;
625625 (xi) chillums;
626626 (xii) bongs;
627627 (xiii) ice pipes or chillers;
628628 (xiv) any smoking pipe manufactured to disguise its intended
629629 purpose;
630630 (xv) wired cigarette papers; or
631631 (xvi) cocaine freebase kits.
632632 (3) "Drug paraphernalia" does not include:
633633 (A) Any products, chemicals or materials described in K.S.A. 21-
634634 5709(a), and amendments thereto; or

678678 (B) any materials used or intended for use to test a substance for the
679679 presence of fentanyl, a fentanyl analog, ketamine or gamma
680680 hydroxybutyric acid.
681681 (g) "Fentanyl-related controlled substance" means any substance
682682 designated in K.S.A. 65-4105(b)(1), (b)(2), (b)(4), (b)(10), (b)(11), (b)
683683 (12), (b)(15), (b)(16), (b)(17), (b)(20), (b)(21), (b)(24), (b)(26), (b)(27), (b)
684684 (28), (b)(35), (b)(42), (b)(43), (b)(44), (b)(45), (b)(48), (b)(50), (b)(54), (b)
685685 (55), (b)(56), (b)(57), (b)(58), (b)(59), (b)(68), (b)(70), (b)(71), (b)(72), (b)
686686 (73), (b)(74), (b)(75), (b)(76), (b)(77), (b)(78), (b)(79), (b)(80), (b)(81), (b)
687687 (82), (b)(83), (b)(84), (b)(85), (b)(91), (b)(97), (b)(98), (b)(99), (b)(103),
688688 (b)(104), (g)(1) or (g)(2) or 65-4107(c)(1), (c)(6), (c)(9), (c)(26), (c)(28),
689689 (c)(30), (f)(3)(A) or (f)(3)(B), and amendments thereto, or any analog
690690 thereof.
691691 (h) "Immediate precursor" means a substance that the state board of
692692 pharmacy has found to be and by rules and regulations designates as being
693693 the principal compound commonly used or produced primarily for use and
694694 that is an immediate chemical intermediary used or likely to be used in the
695695 manufacture of a controlled substance, the control of which is necessary to
696696 prevent, curtail or limit manufacture.
697697 (i) "Isomer" means all enantiomers and diastereomers.
698698 (j) "Manufacture" means the production, preparation, propagation,
699699 compounding, conversion or processing of or placing into pill or capsule
700700 form a controlled substance either directly or indirectly or by extraction
701701 from substances of natural origin or independently by means of chemical
702702 synthesis or by a combination of extraction and chemical synthesis.
703703 "Manufacture" does not include:
704704 (1) The preparation or compounding of a controlled substance by an
705705 individual for the individual's own lawful use or the preparation,
706706 compounding, packaging or labeling of a controlled substance:
707707 (A) By a practitioner or the practitioner's agent pursuant to a lawful
708708 order of a practitioner as an incident to the practitioner's administering or
709709 dispensing of a controlled substance in the course of the practitioner's
710710 professional practice; or
711711 (B) by a practitioner or by the practitioner's authorized agent under
712712 such practitioner's supervision for the purpose of or as an incident to
713713 research, teaching or chemical analysis or by a pharmacist or medical care
714714 facility as an incident to dispensing of a controlled substance; or
715715 (2) the addition of diluents or adulterants, including, but not limited
716716 to, quinine hydrochloride, mannitol, mannite, dextrose or lactose that are
717717 intended for use in cutting a controlled substance.
718718 (k) "Marijuana" means all parts of all varieties of the plant Cannabis
719719 whether growing or not, the seeds thereof, the resin extracted from any
720720 part of the plant and every compound, manufacture, salt, derivative,

765765 include:
766766 (1) The mature stalks of the plant, fiber produced from the stalks, oil
767767 or cake made from the seeds of the plant, any other compound,
768768 manufacture, salt, derivative, mixture or preparation of the mature stalks,
769769 except the resin extracted therefrom, fiber, oil or cake or the sterilized seed
770770 of the plant that is incapable of germination;
771771 (2) any substance listed in schedules II through V of the uniform
772772 controlled substances act;
773773 (3) drug products approved by the United States food and drug
774774 administration as of the effective date of this act;
775775 (4) cannabidiol (other trade name: 2-[(3-methyl-6-(1-methylethenyl)-
776776 2-cyclohexen-1-yl]-5-pentyl-1,3-benzenediol); or
777777 (5) industrial hemp as defined in K.S.A. 2-3901, and amendments
778778 thereto, when cultivated, produced, possessed or used for activities
779779 authorized by the commercial industrial hemp act.
780780 (l) "Minor" means a person under 18 years of age.
781781 (m) "Narcotic drug" means any of the following whether produced
782782 directly or indirectly by extraction from substances of vegetable origin or
783783 independently by means of chemical synthesis or by a combination of
784784 extraction and chemical synthesis:
785785 (1) Opium and opiate and any salt, compound, derivative or
786786 preparation of opium or opiate;
787787 (2) any salt, compound, isomer, derivative or preparation thereof that
788788 is chemically equivalent or identical with any of the substances referred to
789789 in paragraph (1) but not including the isoquinoline alkaloids of opium;
790790 (3) opium poppy and poppy straw;
791791 (4) coca leaves and any salt, compound, derivative or preparation of
792792 coca leaves and any salt, compound, isomer, derivative or preparation
793793 thereof that is chemically equivalent or identical with any of these
794794 substances, but not including decocainized coca leaves or extractions of
795795 coca leaves that do not contain cocaine or ecgonine.
796796 (n) "Opiate" means any substance having an addiction-forming or
797797 addiction-sustaining liability similar to morphine or being capable of
798798 conversion into a drug having addiction-forming or addiction-sustaining
799799 liability. "Opiate" does not include, unless specifically designated as
800800 controlled under K.S.A. 65-4102, and amendments thereto, the
801801 dextrorotatory isomer of 3-methoxy-n-methylmorphinan and its salts
802802 (dextromethorphan). "Opiate" does include its racemic and levorotatory
803803 forms.
804804 (o) "Opium poppy" means the plant of the species Papaver
805805 somniferum l. except its seeds.
806806 (p) "Person" means an individual, corporation, government or

850850 governmental subdivision or agency, business trust, estate, trust,
851851 partnership, association or any other legal entity.
852852 (q) "Poppy straw" means all parts, except the seeds, of the opium
853853 poppy, after mowing.
854854 (r) "School property" means property upon which is located a
855855 structure used by a unified school district or an accredited nonpublic
856856 school for student instruction or attendance or extracurricular activities of
857857 pupils enrolled in kindergarten or any of the grades one through 12. This
858858 definition shall not be construed as requiring that school be in session or
859859 that classes are actually being held at the time of the offense or that
860860 children must be present within the structure or on the property during the
861861 time of any alleged criminal act. If the structure or property meets the
862862 above definition, the actual use of that structure or property at the time
863863 alleged shall not be a defense to the crime charged or the sentence
864864 imposed.
865865 (s) "Simulated controlled substance" means any product that
866866 identifies itself by a common name or slang term associated with a
867867 controlled substance and that indicates on its label or accompanying
868868 promotional material that the product simulates the effect of a controlled
869869 substance.
870870 Sec. 5. K.S.A. 2024 Supp. 65-4101 is hereby amended to read as
871871 follows: 65-4101. As used in this act:
872872 (a) "Administer" means the direct application of a controlled
873873 substance, whether by injection, inhalation, ingestion or any other means,
874874 to the body of a patient or research subject by:
875875 (1) A practitioner or pursuant to the lawful direction of a practitioner;
876876 or
877877 (2) the patient or research subject at the direction and in the presence
878878 of the practitioner.
879879 (b) "Agent" means an authorized person who acts on behalf of or at
880880 the direction of a manufacturer, distributor or dispenser. "Agent" does not
881881 include a common carrier, public warehouseman or employee of the carrier
882882 or warehouseman.
883883 (c) "Application service provider" means an entity that sells
884884 electronic prescription or pharmacy prescription applications as a hosted
885885 service where the entity controls access to the application and maintains
886886 the software and records on its server.
887887 (d) "Board" means the state board of pharmacy.
888888 (e) "Bureau" means the bureau of narcotics and dangerous drugs,
889889 United States department of justice, or its successor agency.
890890 (f) "Controlled substance" means any drug, substance or immediate
891891 precursor included in any of the schedules designated in K.S.A. 65-4105,
892892 65-4107, 65-4109, 65-4111 and 65-4113, and amendments thereto.

936936 (g) (1) "Controlled substance analog" means a substance that is
937937 intended for human consumption, and at least one of the following:
938938 (A) The chemical structure of the substance is substantially similar to
939939 the chemical structure of a controlled substance listed in or added to the
940940 schedules designated in K.S.A. 65-4105 or 65-4107, and amendments
941941 thereto;
942942 (B) the substance has a stimulant, depressant or hallucinogenic effect
943943 on the central nervous system substantially similar to the stimulant,
944944 depressant or hallucinogenic effect on the central nervous system of a
945945 controlled substance included in the schedules designated in K.S.A. 65-
946946 4105 or 65-4107, and amendments thereto; or
947947 (C) with respect to a particular individual, such individual represents
948948 or intends the substance to have a stimulant, depressant or hallucinogenic
949949 effect on the central nervous system substantially similar to the stimulant,
950950 depressant or hallucinogenic effect on the central nervous system of a
951951 controlled substance included in the schedules designated in K.S.A. 65-
952952 4105 or 65-4107, and amendments thereto.
953953 (2) "Controlled substance analog" does not include:
954954 (A) A controlled substance;
955955 (B) a substance for which there is an approved new drug application;
956956 or
957957 (C) a substance with respect to which an exemption is in effect for
958958 investigational use by a particular person under section 505 of the federal
959959 food, drug and cosmetic act, 21 U.S.C. § 355, to the extent conduct with
960960 respect to the substance is permitted by the exemption.
961961 (h) "Counterfeit substance" means a controlled substance that, or the
962962 container or labeling of which, without authorization bears the trademark,
963963 trade name or other identifying mark, imprint, number or device or any
964964 likeness thereof of a manufacturer, distributor or dispenser other than the
965965 person who in fact manufactured, distributed or dispensed the substance.
966966 (i) "Cultivate" means the planting or promotion of growth of five or
967967 more plants that contain or can produce controlled substances.
968968 (j) "DEA" means the U.S. department of justice, drug enforcement
969969 administration.
970970 (k) "Deliver" or "delivery" means the actual, constructive or
971971 attempted transfer from one person to another of a controlled substance,
972972 whether or not there is an agency relationship.
973973 (l) "Dispense" means to deliver a controlled substance to an ultimate
974974 user or research subject by or pursuant to the lawful order of a practitioner,
975975 including the packaging, labeling or compounding necessary to prepare the
976976 substance for that delivery, or pursuant to the prescription of a mid-level
977977 practitioner.
978978 (m) "Dispenser" means a practitioner or pharmacist who dispenses, or

10231023 in accordance with K.S.A. 65-28a08(b), and amendments thereto.
10241024 (n) "Distribute" means to deliver other than by administering or
10251025 dispensing a controlled substance.
10261026 (o) "Distributor" means a person who distributes.
10271027 (p) (1) "Drug" means substances:
10281028 (A) Recognized as drugs in the official United States pharmacopeia,
10291029 official homeopathic pharmacopoeia of the United States or official
10301030 national formulary or any supplement to any of them;
10311031 (B) intended for use in the diagnosis, cure, mitigation, treatment or
10321032 prevention of disease in human or animals;
10331033 (C) other than food intended to affect the structure or any function of
10341034 the body of human or animals; and
10351035 (D) intended for use as a component of any article specified in
10361036 subparagraph (A), (B) or (C).
10371037 (2) "Drug" does not include devices or their components, parts or
10381038 accessories.
10391039 (q) "Immediate precursor" means a substance that the board has
10401040 found to be and by rule and regulation designates as being the principal
10411041 compound commonly used or produced primarily for use and that is an
10421042 immediate chemical intermediary used or likely to be used in the
10431043 manufacture of a controlled substance, the control of which is necessary to
10441044 prevent, curtail or limit manufacture.
10451045 (r) "Electronic prescription" means an electronically prepared
10461046 prescription that is authorized and transmitted from the prescriber to the
10471047 pharmacy by means of electronic transmission.
10481048 (s) "Electronic prescription application" means software that is used
10491049 to create electronic prescriptions and that is intended to be installed on the
10501050 prescriber's computers and servers where access and records are controlled
10511051 by the prescriber.
10521052 (t) "Electronic signature" means a confidential personalized digital
10531053 key, code, number or other method for secure electronic data transmissions
10541054 that identifies a particular person as the source of the message,
10551055 authenticates the signatory of the message and indicates the person's
10561056 approval of the information contained in the transmission.
10571057 (u) "Electronic transmission" means the transmission of an electronic
10581058 prescription, formatted as an electronic data file, from a prescriber's
10591059 electronic prescription application to a pharmacy's computer, where the
10601060 data file is imported into the pharmacy prescription application.
10611061 (v) "Electronically prepared prescription" means a prescription that is
10621062 generated using an electronic prescription application.
10631063 (w) "Facsimile transmission" or "fax transmission" means the
10641064 transmission of a digital image of a prescription from the prescriber or the

11091109 is not limited to, transmission of a written prescription between the
11101110 prescriber's fax machine and the pharmacy's fax machine; transmission of
11111111 an electronically prepared prescription from the prescriber's electronic
11121112 prescription application to the pharmacy's fax machine, computer or
11131113 printer; or transmission of an electronically prepared prescription from the
11141114 prescriber's fax machine to the pharmacy's fax machine, computer or
11151115 printer.
11161116 (x) "Intermediary" means any technology system that receives and
11171117 transmits an electronic prescription between the prescriber and the
11181118 pharmacy.
11191119 (y) "Isomer" means all enantiomers and diastereomers.
11201120 (z) "Manufacture" means the production, preparation, propagation,
11211121 compounding, conversion or processing of a controlled substance either
11221122 directly or indirectly or by extraction from substances of natural origin or
11231123 independently by means of chemical synthesis or by a combination of
11241124 extraction and chemical synthesis and includes any packaging or
11251125 repackaging of the substance or labeling or relabeling of its container,
11261126 except that this term does not include the preparation or compounding of a
11271127 controlled substance by an individual for the individual's own lawful use
11281128 or the preparation, compounding, packaging or labeling of a controlled
11291129 substance:
11301130 (1) By a practitioner or the practitioner's agent pursuant to a lawful
11311131 order of a practitioner as an incident to the practitioner's administering or
11321132 dispensing of a controlled substance in the course of the practitioner's
11331133 professional practice; or
11341134 (2) by a practitioner or by the practitioner's authorized agent under
11351135 such practitioner's supervision for the purpose of or as an incident to
11361136 research, teaching or chemical analysis or by a pharmacist or medical care
11371137 facility as an incident to dispensing of a controlled substance.
11381138 (aa) "Marijuana" means all parts of all varieties of the plant Cannabis

11971197 thereto, when cultivated, produced, possessed or used for activities
11981198 authorized by the commercial industrial hemp act.
11991199 (bb) "Medical care facility" shall have the meaning ascribed to that
12001200 term in K.S.A. 65-425, and amendments thereto.
12011201 (cc) "Mid-level practitioner" means a certified nurse-midwife
12021202 engaging in the independent practice of midwifery under the independent
12031203 practice of midwifery act, an advanced practice registered nurse issued a
12041204 license pursuant to K.S.A. 65-1131, and amendments thereto, who has
12051205 authority to prescribe drugs under K.S.A. 65-1130, and amendments
12061206 thereto, or a physician assistant licensed under the physician assistant
12071207 licensure act who has authority to prescribe drugs pursuant to a written
12081208 agreement with a supervising physician under K.S.A. 65-28a08, and
12091209 amendments thereto.
12101210 (dd) "Narcotic drug" means any of the following whether produced
12111211 directly or indirectly by extraction from substances of vegetable origin or
12121212 independently by means of chemical synthesis or by a combination of
12131213 extraction and chemical synthesis:
12141214 (1) Opium and opiate and any salt, compound, derivative or
12151215 preparation of opium or opiate;
12161216 (2) any salt, compound, isomer, derivative or preparation thereof that
12171217 is chemically equivalent or identical with any of the substances referred to

12801280 (hh) "Pharmacist" means any natural person licensed under K.S.A.
12811281 65-1625 et seq., and amendments thereto, to practice pharmacy.
12821282 (ii) "Pharmacist intern" means: (1) A student currently enrolled in an
12831283 accredited pharmacy program; (2) a graduate of an accredited pharmacy
12841284 program serving such person's internship; or (3) a graduate of a pharmacy
12851285 program located outside of the United States that is not accredited and who
12861286 had successfully passed equivalency examinations approved by the board.
12871287 (jj) "Pharmacy prescription application" means software that is used
12881288 to process prescription information, is installed on a pharmacy's computers
12891289 and servers, and is controlled by the pharmacy.
12901290 (kk) "Poppy straw" means all parts, except the seeds, of the opium
12911291 poppy, after mowing.
12921292 (ll) "Practitioner" means a person licensed to practice medicine and
12931293 surgery, dentist, podiatrist, veterinarian, optometrist, or scientific
12941294 investigator or other person authorized by law to use a controlled
12951295 substance in teaching or chemical analysis or to conduct research with
12961296 respect to a controlled substance.
12971297 (mm) "Prescriber" means a practitioner or a mid-level practitioner.
12981298 (nn) "Production" includes the manufacture, planting, cultivation,
12991299 growing or harvesting of a controlled substance.
13001300 (oo) "Readily retrievable" means that records kept by automatic data
13011301 processing applications or other electronic or mechanized recordkeeping
13021302 systems can be separated out from all other records within a reasonable
13031303 time not to exceed 48 hours of a request from the board or other authorized
13041304 agent or that hard-copy records are kept on which certain items are
13051305 asterisked, redlined or in some other manner visually identifiable apart
13061306 from other items appearing on the records.
13071307 (pp) "Ultimate user" means a person who lawfully possesses a
13081308 controlled substance for such person's own use or for the use of a member
13091309 of such person's household or for administering to an animal owned by
13101310 such person or by a member of such person's household.
13111311 Sec. 6. K.S.A. 2-3908 and K.S.A. 2024 Supp. 2-3901, 21-5701 and
13121312 65-4101 are hereby repealed.
13131313 Sec. 7. This act shall take effect and be in force from and after its
13141314 publication in the statute book.
