11 | 11 | | Be it enacted by the Legislature of the State of Kansas: |
---|
12 | 12 | | New Section 1. (a) As used in this section: |
---|
13 | 13 | | (1) "Approved source" means: |
---|
14 | 14 | | (A) A person authorized to produce industrial hemp under a state or |
---|
15 | 15 | | federal plan in accordance with 7 U.S.C. § 1621 et seq., and amendments |
---|
16 | 16 | | thereto; |
---|
17 | 17 | | (B) a person registered as an industrial hemp processor by the state |
---|
18 | 18 | | fire marshal; or |
---|
19 | 19 | | (C) a person authorized by another state to process industrial hemp or |
---|
20 | 20 | | manufacture hemp products if such state has been approved by the Kansas |
---|
21 | 21 | | department of agriculture as having equivalent state standards for |
---|
22 | 22 | | processing, laboratory testing and labeling requirements; |
---|
23 | 23 | | (2) "cartoon" means any drawing or other depiction of an object, |
---|
24 | 24 | | person, animal, creature or any similar caricature that satisfies any of the |
---|
25 | 25 | | following criteria: |
---|
26 | 26 | | (A) The use of comically exaggerated features; |
---|
27 | 27 | | (B) the attribution of human characteristics to animals, plants or other |
---|
28 | 28 | | objects, or the similar use of anthropomorphic technique; or |
---|
29 | 29 | | (C) the attribution of unnatural or extra-human abilities, such as |
---|
30 | 30 | | imperviousness to pain or injury, X-ray vision, tunneling at very high |
---|
31 | 31 | | speeds or transformation; |
---|
32 | 32 | | (3) "child-resistant" means packaging that is: |
---|
33 | 33 | | (A) Designed or constructed to be significantly difficult for children |
---|
34 | 34 | | under five years of age to open yet not difficult for adults to use properly; |
---|
35 | 35 | | and |
---|
36 | 36 | | (B) resealable for any product intended for more than a single use or |
---|
37 | 37 | | containing multiple servings; |
---|
38 | 38 | | (4) "cosmetic" means the same as defined in K.S.A. 65-656, and |
---|
39 | 39 | | amendments thereto; |

76 | 76 | | (5) "department" means the Kansas department of agriculture; |
---|
77 | 77 | | (6) "hemp-derived cannabinoid product" means an ingestible, |
---|
78 | 78 | | inhalable or cosmetic product that is processed or derived from industrial |
---|
79 | 79 | | hemp; and |
---|
80 | 80 | | (7) "industrial hemp" means the same as defined in K.S.A. 2-3901, |
---|
81 | 81 | | and amendments thereto. |
---|
82 | 82 | | (b) All hemp-derived cannabinoid products sold in a retail |
---|
83 | 83 | | establishment shall: |
---|
84 | 84 | | (1) Be from an approved source; |
---|
85 | 85 | | (2) be packaged and labeled in accordance with this section; and |
---|
86 | 86 | | (3) have a valid printed certificate of analysis available upon request. |
---|
87 | 87 | | (c) A hemp-derived cannabinoid product, excluding cosmetics, shall |
---|
88 | 88 | | not be sold, gifted or otherwise transferred to any person under the age of |
---|
89 | 89 | | 21. |
---|
90 | 90 | | (d) (1) Each hemp-derived cannabinoid product sold or otherwise |
---|
91 | 91 | | distributed in the state shall bear labeling to allow the consumer to access |
---|
92 | 92 | | information on the product, including a certificate of analysis for the |
---|
93 | 93 | | product, the location where the hemp was grown and the address and |
---|
94 | 94 | | phone number of the manufacturer or distributor. Such labeling shall |
---|
95 | 95 | | utilize the following: |
---|
96 | 96 | | (A) A scanning bar code, including the batch number or serial |
---|
97 | 97 | | number of the product; |
---|
98 | 98 | | (B) a quick-response code; or |
---|
99 | 99 | | (C) a web address linked to a document or website. |
---|
100 | 100 | | (2) No product labeling or advertising material for any hemp-derived |
---|
101 | 101 | | cannabinoid product sold or otherwise distributed in the state shall bear |
---|
102 | 102 | | any claims stating that the product can diagnose, treat, cure or prevent any |
---|
103 | 103 | | disease. |
---|
104 | 104 | | (3) Each container or package of hemp-derived cannabinoid product, |
---|
105 | 105 | | excluding cosmetics, shall: |
---|
106 | 106 | | (A) Have a tamper-evident seal; and |
---|
107 | 107 | | (B) be in child-resistant packaging. |
---|
108 | 108 | | (4) Each container or package of hemp-derived cannabinoid product |
---|
109 | 109 | | that is a cosmetic shall have a tamper-evident seal. |
---|
110 | 110 | | (5) Hemp-derived cannabinoid product packaging shall not include: |
---|
111 | 111 | | (A) Any cartoon images; |
---|
112 | 112 | | (B) likeness to images, characters or phrases that are popularly used |
---|
113 | 113 | | to advertise to children; |
---|
114 | 114 | | (C) likeness to or imitation of any commercially available candy, |
---|
115 | 115 | | snack, baked good or beverage packaging or labeling; |
---|
116 | 116 | | (D) the terms "candy" or "candies", or any variation in the spelling of |
---|
117 | 117 | | these words; or |
---|
118 | 118 | | (E) the logo of the department, or any seal, flag, crest, coat of arms or |
---|

163 | 163 | | product has been endorsed, manufactured or used by any state, county, or |

164 | 164 | | municipality or any agency thereof, excluding the use of seals associated |

165 | 165 | | with state or federal programs used in accordance with state or federal law. |
---|
166 | 166 | | Sec. 2. K.S.A. 2024 Supp. 2-3901 is hereby amended to read as |
---|
167 | 167 | | follows: 2-3901. (a) K.S.A. 2-3901 et seq., and amendments thereto, shall |
---|
168 | 168 | | be known and may be cited as the commercial industrial hemp act. |
---|
169 | 169 | | (b) As used in the commercial industrial hemp act: |
---|
170 | 170 | | (1) "Commercial" means the cultivation or production of industrial |
---|
171 | 171 | | hemp for any purpose authorized under K.S.A 2-3906, and amendments |
---|
172 | 172 | | thereto. |
---|
173 | 173 | | (2) "Delta-9 tetrahydrocannabinol concentration" means the |
---|
174 | 174 | | combined percentage of delta-9 tetrahydrocannabinol and its optical |
---|
175 | 175 | | isomers, their salts and acids, and salts of their acids, reported as free |
---|
176 | 176 | | THC: |
---|
177 | 177 | | (A) On a dry weight basis, of any part of the plant cannabis sativa L.; |
---|
178 | 178 | | or |
---|
179 | 179 | | (B) on a percentage by weight basis in hemp products, waste or |
---|
180 | 180 | | substances resulting from the production or processing of industrial hemp. |
---|
181 | 181 | | (3) "Effective disposal" includes, but is not limited to: |
---|
182 | 182 | | (A) Destruction; or |
---|
183 | 183 | | (B) any other method of disposing of industrial hemp or hemp |
---|
184 | 184 | | products found to be in violation of this act that is permitted under the |
---|
185 | 185 | | provisions of 7 U.S.C. § 1621 et seq. and any rules and regulations |
---|
186 | 186 | | adopted thereunder. |
---|
187 | 187 | | (4) "Hemp products" means all products made from industrial hemp, |
---|
188 | 188 | | including, but not limited to, cloth, cordage, fiber, food, fuel, hemp- |
---|
189 | 189 | | derived cannabinoid products, paint, paper, particleboard, plastics, seed, |
---|
190 | 190 | | seed meal and seed oil for consumption and any extract from industrial |
---|
191 | 191 | | hemp intended for further processing. Final "hemp products" may contain |
---|
192 | 192 | | a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a |
---|
193 | 193 | | dry weight basis. As used in this paragraph, "tetrahydrocannabinol |
---|
194 | 194 | | concentration" means the same as in K.S.A. 65-6235(b)(3), and |
---|
195 | 195 | | amendments thereto. |
---|
196 | 196 | | (5) "Hemp producer" means any individual, licensed or otherwise, |
---|
197 | 197 | | engaging in the cultivation or production of industrial hemp for |
---|
198 | 198 | | commercial purposes pursuant to K.S.A. 2-3906, and amendments thereto. |
---|
199 | 199 | | (6) "Hemp processor" means a person registered under K.S.A. 2- |
---|
200 | 200 | | 3907, and amendments thereto, to process and manufacture industrial |
---|
201 | 201 | | hemp and hemp products. |
---|
202 | 202 | | (7) "Industrial hemp" or "hemp" means all parts and varieties of the |
---|
203 | 203 | | plant cannabis sativa L., and any part of that plant, including the seeds |
---|
204 | 204 | | thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, |
---|

251 | 251 | | (8) "Person" means an individual, corporation, partnership, |
---|
252 | 252 | | association, joint stock company, trust, unincorporated organization or any |
---|
253 | 253 | | similar entity or any combination of the foregoing acting in concert. |
---|
254 | 254 | | (9) "State educational institution" means the university of Kansas, |
---|
255 | 255 | | Kansas state university, Wichita state university, Emporia state university, |
---|
256 | 256 | | Pittsburg state university, Fort Hays state university, or any other |
---|
257 | 257 | | accredited college, university, technical college or community college |
---|
258 | 258 | | within Kansas. |
---|
259 | 259 | | (10) "Authorized seed or clone plants" means a source of industrial |
---|
260 | 260 | | hemp seeds or clone plants that: |
---|
261 | 261 | | (A) Has been certified by a certifying agency, as defined by K.S.A. 2- |
---|
262 | 262 | | 1415, and amendments thereto; |
---|
263 | 263 | | (B) has been produced from plants that were tested during the active |
---|
264 | 264 | | growing season and were found to produce industrial hemp having a |
---|
265 | 265 | | tetrahydrocannabinol concentration that does not exceed 0.3% on a dry |
---|
266 | 266 | | weight basis and has been certified in writing by the grower or distributor |
---|
267 | 267 | | of such seeds or clone plants to possess such qualities; or |
---|
268 | 268 | | (C) meets any other authorized standards approved by the Kansas |
---|
269 | 269 | | department of agriculture through rules and regulations, except that no |
---|
270 | 270 | | seed or clone plants shall be considered authorized seed or clone plants if |
---|
271 | 271 | | they do not meet any standard adopted by the United States department of |
---|
272 | 272 | | agriculture pursuant to 7 U.S.C. § 1621 et seq., and amendments thereto. |
---|
273 | 273 | | (11) "Hemp employee" means a person who has applied for |
---|
274 | 274 | | employment or is currently employed with the Kansas department of |
---|
275 | 275 | | agriculture who oversees or regulates industrial hemp. |
---|
276 | 276 | | (12) "Applicant" means a person who has submitted an application |
---|
277 | 277 | | for licensure as a hemp producer or registration as a hemp processor. |
---|
278 | 278 | | (13) "Hemp destruction employee" means an employee or agent of |
---|
279 | 279 | | the Kansas department of agriculture who participates in the effective |
---|
280 | 280 | | disposal of industrial hemp. |
---|
281 | 281 | | Sec. 3. K.S.A. 2-3908 is hereby amended to read as follows: 2-3908. |
---|
282 | 282 | | (a) (1) It shall be unlawful for any of the following hemp products product |
---|
283 | 283 | | to be manufactured, marketed, sold or distributed by any person in the |
---|
284 | 284 | | state of Kansas: |
---|
285 | 285 | | (A) Cigarettes containing industrial hemp; |
---|
286 | 286 | | (B) cigars containing industrial hemp; |
---|
287 | 287 | | (C) chew, dip or other smokeless material containing industrial hemp; |
---|
288 | 288 | | (D) teas containing industrial hemp; |
---|
289 | 289 | | (E) liquids, solids or gases containing industrial hemp for use in |
---|
290 | 290 | | vaporizing devices; and |
---|

---|
335 | 335 | | consumption containing any ingredient derived from industrial hemp that |
---|
336 | 336 | | is prohibited pursuant to the Kansas food, drug and cosmetic act, K.S.A. |
---|
337 | 337 | | 65-636 et seq., and amendments thereto, and the commercial feeding stuffs |
---|
338 | 338 | | act, K.S.A. 2-1001 et seq., and amendments thereto. This subparagraph |
---|
339 | 339 | | shall not otherwise prohibit the use of any such ingredient, including |
---|
340 | 340 | | cannabidiol oil, in such hemp products. |
---|
341 | 341 | | (2) A dietary supplement, food, beverage or cosmetic product is not |
---|
342 | 342 | | adulterated by the inclusion of industrial hemp as long as the industrial |
---|
343 | 343 | | hemp in such product meets the requirements in K.S.A. 2-3901 et seq., and |
---|
344 | 344 | | amendments thereto. The sale of a dietary supplement, food, beverage or |
---|
345 | 345 | | cosmetic that includes industrial hemp shall not be restricted or prohibited |
---|
346 | 346 | | based solely on the inclusion of industrial hemp, provided that the |
---|
347 | 347 | | industrial hemp in the product meets the requirements in K.S.A. 2-3901 et |
---|
348 | 348 | | seq., and amendments thereto. |
---|
349 | 349 | | (2)(3) As used in this subsection: |
---|
350 | 350 | | (A) "Human or animal consumption" means: |
---|
351 | 351 | | (i) Ingested orally; or |
---|
352 | 352 | | (ii) applied by any means such that an ingredient derived from |
---|
353 | 353 | | industrial hemp enters the human or animal body. |
---|
354 | 354 | | (B) "Intended for human or animal consumption" means: |
---|
355 | 355 | | (i) Designed by the manufacturer for human or animal consumption; |
---|
356 | 356 | | (ii) marketed for human or animal consumption; or |
---|
357 | 357 | | (iii) distributed with the intent that it be used for human or animal |
---|
358 | 358 | | consumption. |
---|
359 | 359 | | (b) (1) It shall be unlawful for any of the following hemp products to |
---|
360 | 360 | | be marketed, sold or distributed to any person in Kansas who is not |
---|
361 | 361 | | registered as a hemp processor pursuant to K.S.A. 2-3907, and |
---|
362 | 362 | | amendments thereto, or who does not possess a license by the Kansas |
---|
363 | 363 | | department of agriculture under any commercial plan established pursuant |
---|
364 | 364 | | to K.S.A. 2-3906, and amendments thereto, or the research program |
---|
365 | 365 | | established pursuant to K.S.A. 2-3902, and amendments thereto: |
---|
366 | 366 | | (A) Industrial hemp buds; |
---|
367 | 367 | | (B) ground industrial hemp floral material; |
---|
368 | 368 | | (C) ground industrial hemp leaf material; or |
---|
369 | 369 | | (D) any extract from industrial hemp with a delta-9 |
---|
370 | 370 | | tetrahydrocannabinol concentration greater than 0.3% that will be further |
---|
371 | 371 | | processed. |
---|
372 | 372 | | (2) No license or registration shall be required for the transport of |
---|
373 | 373 | | hemp products described in paragraph (1) if such products are transported |
---|
374 | 374 | | between hemp producers and hemp processors or between more than one |
---|
375 | 375 | | hemp processor. Any such transportation of hemp products shall be subject |
---|
376 | 376 | | to rules and regulations promulgated by the state fire marshal pursuant to |
---|

421 | 421 | | (c) (1) Upon a first conviction for a violation of this section, a person |
---|
422 | 422 | | shall be guilty of a class A nonperson misdemeanor. |
---|

430 | 430 | | (e) This section shall be a part of and supplemental to the commercial |

431 | 431 | | industrial hemp act, K.S.A. 2-3901 et seq., and amendments thereto. |
---|
432 | 432 | | Sec. 4. K.S.A. 2024 Supp. 21-5701 is hereby amended to read as |
---|
433 | 433 | | follows: 21-5701. As used in K.S.A. 21-5701 through 21-5717, and |
---|

435 | 435 | | (a) "Controlled substance" means any drug, substance or immediate |

---|

444 | 444 | | (B) the substance has a stimulant, depressant or hallucinogenic effect |
---|
445 | 445 | | on the central nervous system substantially similar to the stimulant, |

446 | 446 | | depressant or hallucinogenic effect on the central nervous system of a |

447 | 447 | | controlled substance included in the schedules designated in K.S.A. 65- |
---|
448 | 448 | | 4105 or 65-4107, and amendments thereto; or |
---|
449 | 449 | | (C) with respect to a particular individual, such individual represents |
---|
450 | 450 | | or intends the substance to have a stimulant, depressant or hallucinogenic |

---|
452 | 452 | | depressant or hallucinogenic effect on the central nervous system of a |

517 | 517 | | (A) Substances recognized as drugs in the official United States |

518 | 518 | | pharmacopeia, official homeopathic pharmacopoeia of the United States or |

519 | 519 | | official national formulary or any supplement to any of them; |
---|
520 | 520 | | (B) substances intended for use in the diagnosis, cure, mitigation, |
---|
521 | 521 | | treatment or prevention of disease in humans or animals; |
---|
522 | 522 | | (C) substances, other than food, intended to affect the structure or any |
---|
523 | 523 | | function of the body of humans or animals; and |
---|
524 | 524 | | (D) substances intended for use as a component of any article |

525 | 525 | | specified in subparagraph (A), (B) or (C). |
---|
526 | 526 | | (2) "Drug" does not include devices or their components, parts or |
---|

528 | 528 | | (f) (1) "Drug paraphernalia" means all equipment and materials of |
---|
529 | 529 | | any kind that are used, or primarily intended or designed for use in |

530 | 530 | | planting, propagating, cultivating, growing, harvesting, manufacturing, |

531 | 531 | | compounding, converting, producing, processing, preparing, testing, |
---|

---|
535 | 535 | | (2) "Drug paraphernalia" includes, but is not limited to: |

536 | 536 | | (A) Kits used or intended for use in planting, propagating, cultivating, |

---|
538 | 538 | | from which a controlled substance can be derived; |
---|

865 | 865 | | (s) "Simulated controlled substance" means any product that |
---|
866 | 866 | | identifies itself by a common name or slang term associated with a |

867 | 867 | | controlled substance and that indicates on its label or accompanying |

868 | 868 | | promotional material that the product simulates the effect of a controlled |
---|
869 | 869 | | substance. |

870 | 870 | | Sec. 5. K.S.A. 2024 Supp. 65-4101 is hereby amended to read as |

884 | 884 | | electronic prescription or pharmacy prescription applications as a hosted |

885 | 885 | | service where the entity controls access to the application and maintains |

887 | 887 | | (d) "Board" means the state board of pharmacy. |

888 | 888 | | (e) "Bureau" means the bureau of narcotics and dangerous drugs, |

---|
953 | 953 | | (2) "Controlled substance analog" does not include: |
---|
954 | 954 | | (A) A controlled substance; |
---|
955 | 955 | | (B) a substance for which there is an approved new drug application; |
---|

957 | 957 | | (C) a substance with respect to which an exemption is in effect for |
---|
958 | 958 | | investigational use by a particular person under section 505 of the federal |
---|
959 | 959 | | food, drug and cosmetic act, 21 U.S.C. § 355, to the extent conduct with |

960 | 960 | | respect to the substance is permitted by the exemption. |
---|
961 | 961 | | (h) "Counterfeit substance" means a controlled substance that, or the |
---|
962 | 962 | | container or labeling of which, without authorization bears the trademark, |
---|
963 | 963 | | trade name or other identifying mark, imprint, number or device or any |
---|
964 | 964 | | likeness thereof of a manufacturer, distributor or dispenser other than the |
---|
965 | 965 | | person who in fact manufactured, distributed or dispensed the substance. |
---|
966 | 966 | | (i) "Cultivate" means the planting or promotion of growth of five or |
---|
967 | 967 | | more plants that contain or can produce controlled substances. |
---|
968 | 968 | | (j) "DEA" means the U.S. department of justice, drug enforcement |
---|
969 | 969 | | administration. |
---|
970 | 970 | | (k) "Deliver" or "delivery" means the actual, constructive or |
---|
971 | 971 | | attempted transfer from one person to another of a controlled substance, |
---|
972 | 972 | | whether or not there is an agency relationship. |

973 | 973 | | (l) "Dispense" means to deliver a controlled substance to an ultimate |
---|
974 | 974 | | user or research subject by or pursuant to the lawful order of a practitioner, |

---|

1035 | 1035 | | (D) intended for use as a component of any article specified in |

1036 | 1036 | | subparagraph (A), (B) or (C). |
---|
1037 | 1037 | | (2) "Drug" does not include devices or their components, parts or |
---|
1038 | 1038 | | accessories. |
---|
1039 | 1039 | | (q) "Immediate precursor" means a substance that the board has |
---|
1040 | 1040 | | found to be and by rule and regulation designates as being the principal |
---|
1041 | 1041 | | compound commonly used or produced primarily for use and that is an |
---|
1042 | 1042 | | immediate chemical intermediary used or likely to be used in the |
---|
1043 | 1043 | | manufacture of a controlled substance, the control of which is necessary to |
---|
1044 | 1044 | | prevent, curtail or limit manufacture. |
---|
1045 | 1045 | | (r) "Electronic prescription" means an electronically prepared |
---|
1046 | 1046 | | prescription that is authorized and transmitted from the prescriber to the |
---|
1047 | 1047 | | pharmacy by means of electronic transmission. |
---|
1048 | 1048 | | (s) "Electronic prescription application" means software that is used |
---|
1049 | 1049 | | to create electronic prescriptions and that is intended to be installed on the |
---|
1050 | 1050 | | prescriber's computers and servers where access and records are controlled |
---|
1051 | 1051 | | by the prescriber. |
---|
1052 | 1052 | | (t) "Electronic signature" means a confidential personalized digital |
---|
1053 | 1053 | | key, code, number or other method for secure electronic data transmissions |
---|
1054 | 1054 | | that identifies a particular person as the source of the message, |
---|
1055 | 1055 | | authenticates the signatory of the message and indicates the person's |
---|
1056 | 1056 | | approval of the information contained in the transmission. |
---|
1057 | 1057 | | (u) "Electronic transmission" means the transmission of an electronic |
---|
1058 | 1058 | | prescription, formatted as an electronic data file, from a prescriber's |
---|
1059 | 1059 | | electronic prescription application to a pharmacy's computer, where the |
---|
1060 | 1060 | | data file is imported into the pharmacy prescription application. |

1061 | 1061 | | (v) "Electronically prepared prescription" means a prescription that is |
