5	5	AN ACT concerning industrial hemp; relating to hemp-derived
6	6	cannabinoid products; prohibiting the transfer of such products to any
7	7	person under the age of 21; establishing packaging and labeling
8	8	requirements for such products; amending the definition of industrial
9	9	hemp and hemp products; amending K.S.A. 2-3908 and K.S.A. 2024
10	10	Supp. 2-3901, 21-5701 and 65-4101 and repealing the existing sections.
11	11	Be it enacted by the Legislature of the State of Kansas:
12	12	New Section 1. (a) As used in this section:
13	13	(1) "Approved source" means:
14	14	(A) A person authorized to produce industrial hemp under a state or
15	15	federal plan in accordance with 7 U.S.C. § 1621 et seq., and amendments
16	16	thereto;
17	17	(B) a person registered as an industrial hemp processor by the state
18	18	fire marshal; or
19	19	(C) a person authorized by another state to process industrial hemp or
20	20	manufacture hemp products if such state has been approved by the Kansas
21	21	department of agriculture as having equivalent state standards for
22	22	processing, laboratory testing and labeling requirements;
23	23	(2) "cartoon" means any drawing or other depiction of an object,
24	24	person, animal, creature or any similar caricature that satisfies any of the
25	25	following criteria:
26	26	(A) The use of comically exaggerated features;
27	27	(B) the attribution of human characteristics to animals, plants or other
28	28	objects, or the similar use of anthropomorphic technique; or
29	29	(C) the attribution of unnatural or extra-human abilities, such as
30	30	imperviousness to pain or injury, X-ray vision, tunneling at very high
31	31	speeds or transformation;
32	32	(3) "child-resistant" means packaging that is:
33	33	(A) Designed or constructed to be significantly difficult for children
34	34	under five years of age to open yet not difficult for adults to use properly;
35	35	and
36	36	(B) resealable for any product intended for more than a single use or
37	37	containing multiple servings;
38	38	(4) "cosmetic" means the same as defined in K.S.A. 65-656, and
39	39	amendments thereto;

76	76	(5) "department" means the Kansas department of agriculture;
77	77	(6) "hemp-derived cannabinoid product" means an ingestible,
78	78	inhalable or cosmetic product that is processed or derived from industrial
79	79	hemp; and
80	80	(7) "industrial hemp" means the same as defined in K.S.A. 2-3901,
81	81	and amendments thereto.
82	82	(b) All hemp-derived cannabinoid products sold in a retail
83	83	establishment shall:
84	84	(1) Be from an approved source;
85	85	(2) be packaged and labeled in accordance with this section; and
86	86	(3) have a valid printed certificate of analysis available upon request.
87	87	(c) A hemp-derived cannabinoid product, excluding cosmetics, shall
88	88	not be sold, gifted or otherwise transferred to any person under the age of
89	89	21.
90	90	(d) (1) Each hemp-derived cannabinoid product sold or otherwise
91	91	distributed in the state shall bear labeling to allow the consumer to access
92	92	information on the product, including a certificate of analysis for the
93	93	product, the location where the hemp was grown and the address and
94	94	phone number of the manufacturer or distributor. Such labeling shall
95	95	utilize the following:
96	96	(A) A scanning bar code, including the batch number or serial
97	97	number of the product;
98	98	(B) a quick-response code; or
99	99	(C) a web address linked to a document or website.
100	100	(2) No product labeling or advertising material for any hemp-derived
101	101	cannabinoid product sold or otherwise distributed in the state shall bear
102	102	any claims stating that the product can diagnose, treat, cure or prevent any
103	103	disease.
104	104	(3) Each container or package of hemp-derived cannabinoid product,
105	105	excluding cosmetics, shall:
106	106	(A) Have a tamper-evident seal; and
107	107	(B) be in child-resistant packaging.
108	108	(4) Each container or package of hemp-derived cannabinoid product
109	109	that is a cosmetic shall have a tamper-evident seal.
110	110	(5) Hemp-derived cannabinoid product packaging shall not include:
111	111	(A) Any cartoon images;
112	112	(B) likeness to images, characters or phrases that are popularly used
113	113	to advertise to children;
114	114	(C) likeness to or imitation of any commercially available candy,
115	115	snack, baked good or beverage packaging or labeling;
116	116	(D) the terms "candy" or "candies", or any variation in the spelling of
117	117	these words; or
118	118	(E) the logo of the department, or any seal, flag, crest, coat of arms or

162	162	other insignia that could reasonably mislead any person to believe the
163	163	product has been endorsed, manufactured or used by any state, county, or
164	164	municipality or any agency thereof, excluding the use of seals associated
165	165	with state or federal programs used in accordance with state or federal law.
166	166	Sec. 2. K.S.A. 2024 Supp. 2-3901 is hereby amended to read as
167	167	follows: 2-3901. (a) K.S.A. 2-3901 et seq., and amendments thereto, shall
168	168	be known and may be cited as the commercial industrial hemp act.
169	169	(b) As used in the commercial industrial hemp act:
170	170	(1) "Commercial" means the cultivation or production of industrial
171	171	hemp for any purpose authorized under K.S.A 2-3906, and amendments
172	172	thereto.
173	173	(2) "Delta-9 tetrahydrocannabinol concentration" means the
174	174	combined percentage of delta-9 tetrahydrocannabinol and its optical
175	175	isomers, their salts and acids, and salts of their acids, reported as free
176	176	THC:
177	177	(A) On a dry weight basis, of any part of the plant cannabis sativa L.;
178	178	or
179	179	(B) on a percentage by weight basis in hemp products, waste or
180	180	substances resulting from the production or processing of industrial hemp.
181	181	(3) "Effective disposal" includes, but is not limited to:
182	182	(A) Destruction; or
183	183	(B) any other method of disposing of industrial hemp or hemp
184	184	products found to be in violation of this act that is permitted under the
185	185	provisions of 7 U.S.C. § 1621 et seq. and any rules and regulations
186	186	adopted thereunder.
187	187	(4) "Hemp products" means all products made from industrial hemp,
188	188	including, but not limited to, cloth, cordage, fiber, food, fuel, hemp-
189	189	derived cannabinoid products, paint, paper, particleboard, plastics, seed,
190	190	seed meal and seed oil for consumption and any extract from industrial
191	191	hemp intended for further processing. Final "hemp products" may contain
192	192	a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a
193	193	dry weight basis. As used in this paragraph, "tetrahydrocannabinol
194	194	concentration" means the same as in K.S.A. 65-6235(b)(3), and
195	195	amendments thereto.
196	196	(5) "Hemp producer" means any individual, licensed or otherwise,
197	197	engaging in the cultivation or production of industrial hemp for
198	198	commercial purposes pursuant to K.S.A. 2-3906, and amendments thereto.
199	199	(6) "Hemp processor" means a person registered under K.S.A. 2-
200	200	3907, and amendments thereto, to process and manufacture industrial
201	201	hemp and hemp products.
202	202	(7) "Industrial hemp" or "hemp" means all parts and varieties of the
203	203	plant cannabis sativa L., and any part of that plant, including the seeds
204	204	thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts,

248	248	and salts of isomers, whether growing or not, that contain with a delta-9
249	249	tetrahydrocannabinol concentration of not more than 0.3% on a dry weight
250	250	basis.
251	251	(8) "Person" means an individual, corporation, partnership,
252	252	association, joint stock company, trust, unincorporated organization or any
253	253	similar entity or any combination of the foregoing acting in concert.
254	254	(9) "State educational institution" means the university of Kansas,
255	255	Kansas state university, Wichita state university, Emporia state university,
256	256	Pittsburg state university, Fort Hays state university, or any other
257	257	accredited college, university, technical college or community college
258	258	within Kansas.
259	259	(10) "Authorized seed or clone plants" means a source of industrial
260	260	hemp seeds or clone plants that:
261	261	(A) Has been certified by a certifying agency, as defined by K.S.A. 2-
262	262	1415, and amendments thereto;
263	263	(B) has been produced from plants that were tested during the active
264	264	growing season and were found to produce industrial hemp having a
265	265	tetrahydrocannabinol concentration that does not exceed 0.3% on a dry
266	266	weight basis and has been certified in writing by the grower or distributor
267	267	of such seeds or clone plants to possess such qualities; or
268	268	(C) meets any other authorized standards approved by the Kansas
269	269	department of agriculture through rules and regulations, except that no
270	270	seed or clone plants shall be considered authorized seed or clone plants if
271	271	they do not meet any standard adopted by the United States department of
272	272	agriculture pursuant to 7 U.S.C. § 1621 et seq., and amendments thereto.
273	273	(11) "Hemp employee" means a person who has applied for
274	274	employment or is currently employed with the Kansas department of
275	275	agriculture who oversees or regulates industrial hemp.
276	276	(12) "Applicant" means a person who has submitted an application
277	277	for licensure as a hemp producer or registration as a hemp processor.
278	278	(13) "Hemp destruction employee" means an employee or agent of
279	279	the Kansas department of agriculture who participates in the effective
280	280	disposal of industrial hemp.
281	281	Sec. 3. K.S.A. 2-3908 is hereby amended to read as follows: 2-3908.
282	282	(a) (1) It shall be unlawful for any of the following hemp products product
283	283	to be manufactured, marketed, sold or distributed by any person in the
284	284	state of Kansas:
285	285	(A) Cigarettes containing industrial hemp;
286	286	(B) cigars containing industrial hemp;
287	287	(C) chew, dip or other smokeless material containing industrial hemp;
288	288	(D) teas containing industrial hemp;
289	289	(E) liquids, solids or gases containing industrial hemp for use in
290	290	vaporizing devices; and

334	334	(F) any other hemp product that is intended for human or animal
335	335	consumption containing any ingredient derived from industrial hemp that
336	336	is prohibited pursuant to the Kansas food, drug and cosmetic act, K.S.A.
337	337	65-636 et seq., and amendments thereto, and the commercial feeding stuffs
338	338	act, K.S.A. 2-1001 et seq., and amendments thereto. This subparagraph
339	339	shall not otherwise prohibit the use of any such ingredient, including
340	340	cannabidiol oil, in such hemp products.
341	341	(2) A dietary supplement, food, beverage or cosmetic product is not
342	342	adulterated by the inclusion of industrial hemp as long as the industrial
343	343	hemp in such product meets the requirements in K.S.A. 2-3901 et seq., and
344	344	amendments thereto. The sale of a dietary supplement, food, beverage or
345	345	cosmetic that includes industrial hemp shall not be restricted or prohibited
346	346	based solely on the inclusion of industrial hemp, provided that the
347	347	industrial hemp in the product meets the requirements in K.S.A. 2-3901 et
348	348	seq., and amendments thereto.
349	349	(2)(3) As used in this subsection:
350	350	(A) "Human or animal consumption" means:
351	351	(i) Ingested orally; or
352	352	(ii) applied by any means such that an ingredient derived from
353	353	industrial hemp enters the human or animal body.
354	354	(B) "Intended for human or animal consumption" means:
355	355	(i) Designed by the manufacturer for human or animal consumption;
356	356	(ii) marketed for human or animal consumption; or
357	357	(iii) distributed with the intent that it be used for human or animal
358	358	consumption.
359	359	(b) (1) It shall be unlawful for any of the following hemp products to
360	360	be marketed, sold or distributed to any person in Kansas who is not
361	361	registered as a hemp processor pursuant to K.S.A. 2-3907, and
362	362	amendments thereto, or who does not possess a license by the Kansas
363	363	department of agriculture under any commercial plan established pursuant
364	364	to K.S.A. 2-3906, and amendments thereto, or the research program
365	365	established pursuant to K.S.A. 2-3902, and amendments thereto:
366	366	(A) Industrial hemp buds;
367	367	(B) ground industrial hemp floral material;
368	368	(C) ground industrial hemp leaf material; or
369	369	(D) any extract from industrial hemp with a delta-9
370	370	tetrahydrocannabinol concentration greater than 0.3% that will be further
371	371	processed.
372	372	(2) No license or registration shall be required for the transport of
373	373	hemp products described in paragraph (1) if such products are transported
374	374	between hemp producers and hemp processors or between more than one
375	375	hemp processor. Any such transportation of hemp products shall be subject
376	376	to rules and regulations promulgated by the state fire marshal pursuant to

421	421	(c) (1) Upon a first conviction for a violation of this section, a person
422	422	shall be guilty of a class A nonperson misdemeanor.
423	423	(2) On a second or subsequent conviction for a violation of this
424	424	section, a person shall be guilty of a severity level 9, nonperson felony.
425	425	(d) Nothing in this section shall prohibit:
426	426	(1) The use of any hemp product for research purposes by a state
427	427	educational institution or affiliated entity; or
428	428	(2) the production, use or sale of any hemp product that is otherwise
429	429	not prohibited by state or federal law.
430	430	(e) This section shall be a part of and supplemental to the commercial
431	431	industrial hemp act, K.S.A. 2-3901 et seq., and amendments thereto.
432	432	Sec. 4. K.S.A. 2024 Supp. 21-5701 is hereby amended to read as
433	433	follows: 21-5701. As used in K.S.A. 21-5701 through 21-5717, and
434	434	amendments thereto:
435	435	(a) "Controlled substance" means any drug, substance or immediate
436	436	precursor included in any of the schedules designated in K.S.A. 65-4105,
437	437	65-4107, 65-4109, 65-4111 and 65-4113, and amendments thereto.
438	438	(b) (1) "Controlled substance analog" means a substance that is
439	439	intended for human consumption, and at least one of the following:
440	440	(A) The chemical structure of the substance is substantially similar to
441	441	the chemical structure of a controlled substance listed in or added to the
442	442	schedules designated in K.S.A. 65-4105 or 65-4107, and amendments
443	443	thereto;
444	444	(B) the substance has a stimulant, depressant or hallucinogenic effect
445	445	on the central nervous system substantially similar to the stimulant,
446	446	depressant or hallucinogenic effect on the central nervous system of a
447	447	controlled substance included in the schedules designated in K.S.A. 65-
448	448	4105 or 65-4107, and amendments thereto; or
449	449	(C) with respect to a particular individual, such individual represents
450	450	or intends the substance to have a stimulant, depressant or hallucinogenic
451	451	effect on the central nervous system substantially similar to the stimulant,
452	452	depressant or hallucinogenic effect on the central nervous system of a
453	453	controlled substance included in the schedules designated in K.S.A. 65-
454	454	4105 or 65-4107, and amendments thereto.
455	455	(2) "Controlled substance analog" does not include:
456	456	(A) A controlled substance;
457	457	(B) a substance for which there is an approved new drug application;
458	458	or
459	459	(C) a substance with respect to which an exemption is in effect for
460	460	investigational use by a particular person under section 505 of the federal
461	461	food, drug, and cosmetic act, 21 U.S.C. § 355, to the extent conduct with
462	462	respect to the substance is permitted by the exemption.

506	506	(c) "Cultivate" means the planting or promotion of growth of five or
507	507	more plants that contain or can produce controlled substances.
508	508	(d) "Distribute" means the actual, constructive or attempted transfer
509	509	from one person to another of some item whether or not there is an agency
510	510	relationship. "Distribute" includes, but is not limited to, sale, offer for sale
511	511	or any act that causes some item to be transferred from one person to
512	512	another. "Distribute" does not include acts of administering, dispensing or
513	513	prescribing a controlled substance as authorized by the pharmacy act of the
514	514	state of Kansas, the uniform controlled substances act or otherwise
515	515	authorized by law.
516	516	(e) (1) "Drug" means:
517	517	(A) Substances recognized as drugs in the official United States
518	518	pharmacopeia, official homeopathic pharmacopoeia of the United States or
519	519	official national formulary or any supplement to any of them;
520	520	(B) substances intended for use in the diagnosis, cure, mitigation,
521	521	treatment or prevention of disease in humans or animals;
522	522	(C) substances, other than food, intended to affect the structure or any
523	523	function of the body of humans or animals; and
524	524	(D) substances intended for use as a component of any article
525	525	specified in subparagraph (A), (B) or (C).
526	526	(2) "Drug" does not include devices or their components, parts or
527	527	accessories.
528	528	(f) (1) "Drug paraphernalia" means all equipment and materials of
529	529	any kind that are used, or primarily intended or designed for use in
530	530	planting, propagating, cultivating, growing, harvesting, manufacturing,
531	531	compounding, converting, producing, processing, preparing, testing,
532	532	analyzing, packaging, repackaging, storing, containing, concealing,
533	533	injecting, ingesting, inhaling or otherwise introducing into the human body
534	534	a controlled substance and in violation of this act.
535	535	(2) "Drug paraphernalia" includes, but is not limited to:
536	536	(A) Kits used or intended for use in planting, propagating, cultivating,
537	537	growing or harvesting any species of plant that is a controlled substance or
538	538	from which a controlled substance can be derived;
539	539	(B) kits used or intended for use in manufacturing, compounding,
540	540	converting, producing, processing or preparing controlled substances;
541	541	(C) isomerization devices used or intended for use in increasing the
542	542	potency of any species of plant that is a controlled substance;
543	543	(D) testing equipment used or intended for use in identifying or in
544	544	analyzing the strength, effectiveness or purity of controlled substances;
545	545	(E) scales and balances used or intended for use in weighing or
546	546	measuring controlled substances;
547	547	(F) diluents and adulterants, including, but not limited to, quinine
548	548	hydrochloride, mannitol, mannite, dextrose and lactose that are used or

593	593	(G) separation gins and sifters used or intended for use in removing
594	594	twigs and seeds from or otherwise cleaning or refining marijuana;
595	595	(H) blenders, bowls, containers, spoons and mixing devices used or
596	596	intended for use in compounding controlled substances;
597	597	(I) capsules, balloons, envelopes, bags and other containers used or
598	598	intended for use in packaging small quantities of controlled substances;
599	599	(J) containers and other objects used or intended for use in storing or
600	600	concealing controlled substances;
601	601	(K) hypodermic syringes, needles and other objects used or intended
602	602	for use in parenterally injecting controlled substances into the human
603	603	body;
604	604	(L) objects used or primarily intended or designed for use in
605	605	ingesting, inhaling or otherwise introducing marijuana, cocaine, hashish,
606	606	hashish oil, phencyclidine (PCP), methamphetamine or amphetamine into
607	607	the human body, such as:
608	608	(i) Metal, wooden, acrylic, glass, stone, plastic or ceramic pipes with
609	609	or without screens, permanent screens, hashish heads or punctured metal
610	610	bowls;
611	611	(ii) water pipes, bongs or smoking pipes designed to draw smoke
612	612	through water or another cooling device;
613	613	(iii) carburetion pipes, glass or other heat-resistant tubes or any other
614	614	device used, intended to be used or designed to be used to cause
615	615	vaporization of a controlled substance for inhalation;
616	616	(iv) smoking and carburetion masks;
617	617	(v) roach clips, objects used to hold burning material, such as a
618	618	marijuana cigarette, that has become too small or too short to be held in
619	619	the hand;
620	620	(vi) miniature cocaine spoons and cocaine vials;
621	621	(vii) chamber smoking pipes;
622	622	(viii) carburetor smoking pipes;
623	623	(ix) electric smoking pipes;
624	624	(x) air-driven smoking pipes;
625	625	(xi) chillums;
626	626	(xii) bongs;
627	627	(xiii) ice pipes or chillers;
628	628	(xiv) any smoking pipe manufactured to disguise its intended
629	629	purpose;
630	630	(xv) wired cigarette papers; or
631	631	(xvi) cocaine freebase kits.
632	632	(3) "Drug paraphernalia" does not include:
633	633	(A) Any products, chemicals or materials described in K.S.A. 21-
634	634	5709(a), and amendments thereto; or

684	684	(28), (b)(35), (b)(42), (b)(43), (b)(44), (b)(45), (b)(48), (b)(50), (b)(54), (b)
685	685	(55), (b)(56), (b)(57), (b)(58), (b)(59), (b)(68), (b)(70), (b)(71), (b)(72), (b)
686	686	(73), (b)(74), (b)(75), (b)(76), (b)(77), (b)(78), (b)(79), (b)(80), (b)(81), (b)

691	691	(h) "Immediate precursor" means a substance that the state board of
692	692	pharmacy has found to be and by rules and regulations designates as being
693	693	the principal compound commonly used or produced primarily for use and
694	694	that is an immediate chemical intermediary used or likely to be used in the
695	695	manufacture of a controlled substance, the control of which is necessary to
696	696	prevent, curtail or limit manufacture.
697	697	(i) "Isomer" means all enantiomers and diastereomers.
698	698	(j) "Manufacture" means the production, preparation, propagation,
699	699	compounding, conversion or processing of or placing into pill or capsule
700	700	form a controlled substance either directly or indirectly or by extraction
701	701	from substances of natural origin or independently by means of chemical
702	702	synthesis or by a combination of extraction and chemical synthesis.
703	703	"Manufacture" does not include:
704	704	(1) The preparation or compounding of a controlled substance by an
705	705	individual for the individual's own lawful use or the preparation,
706	706	compounding, packaging or labeling of a controlled substance:
707	707	(A) By a practitioner or the practitioner's agent pursuant to a lawful
708	708	order of a practitioner as an incident to the practitioner's administering or
709	709	dispensing of a controlled substance in the course of the practitioner's
710	710	professional practice; or
711	711	(B) by a practitioner or by the practitioner's authorized agent under
712	712	such practitioner's supervision for the purpose of or as an incident to
713	713	research, teaching or chemical analysis or by a pharmacist or medical care
714	714	facility as an incident to dispensing of a controlled substance; or
715	715	(2) the addition of diluents or adulterants, including, but not limited
716	716	to, quinine hydrochloride, mannitol, mannite, dextrose or lactose that are
717	717	intended for use in cutting a controlled substance.
718	718	(k) "Marijuana" means all parts of all varieties of the plant Cannabis
719	719	whether growing or not, the seeds thereof, the resin extracted from any
720	720	part of the plant and every compound, manufacture, salt, derivative,

765	765	include:
766	766	(1) The mature stalks of the plant, fiber produced from the stalks, oil
767	767	or cake made from the seeds of the plant, any other compound,
768	768	manufacture, salt, derivative, mixture or preparation of the mature stalks,
769	769	except the resin extracted therefrom, fiber, oil or cake or the sterilized seed
770	770	of the plant that is incapable of germination;
771	771	(2) any substance listed in schedules II through V of the uniform
772	772	controlled substances act;
773	773	(3) drug products approved by the United States food and drug
774	774	administration as of the effective date of this act;
775	775	(4) cannabidiol (other trade name: 2-[(3-methyl-6-(1-methylethenyl)-
776	776	2-cyclohexen-1-yl]-5-pentyl-1,3-benzenediol); or
777	777	(5) industrial hemp as defined in K.S.A. 2-3901, and amendments
778	778	thereto, when cultivated, produced, possessed or used for activities
779	779	authorized by the commercial industrial hemp act.
780	780	(l) "Minor" means a person under 18 years of age.
781	781	(m) "Narcotic drug" means any of the following whether produced
782	782	directly or indirectly by extraction from substances of vegetable origin or
783	783	independently by means of chemical synthesis or by a combination of
784	784	extraction and chemical synthesis:
785	785	(1) Opium and opiate and any salt, compound, derivative or
786	786	preparation of opium or opiate;
787	787	(2) any salt, compound, isomer, derivative or preparation thereof that
788	788	is chemically equivalent or identical with any of the substances referred to
789	789	in paragraph (1) but not including the isoquinoline alkaloids of opium;
790	790	(3) opium poppy and poppy straw;
791	791	(4) coca leaves and any salt, compound, derivative or preparation of
792	792	coca leaves and any salt, compound, isomer, derivative or preparation
793	793	thereof that is chemically equivalent or identical with any of these
794	794	substances, but not including decocainized coca leaves or extractions of
795	795	coca leaves that do not contain cocaine or ecgonine.
796	796	(n) "Opiate" means any substance having an addiction-forming or
797	797	addiction-sustaining liability similar to morphine or being capable of
798	798	conversion into a drug having addiction-forming or addiction-sustaining
799	799	liability. "Opiate" does not include, unless specifically designated as
800	800	controlled under K.S.A. 65-4102, and amendments thereto, the
801	801	dextrorotatory isomer of 3-methoxy-n-methylmorphinan and its salts
802	802	(dextromethorphan). "Opiate" does include its racemic and levorotatory
803	803	forms.
804	804	(o) "Opium poppy" means the plant of the species Papaver
805	805	somniferum l. except its seeds.
806	806	(p) "Person" means an individual, corporation, government or

851	851	partnership, association or any other legal entity.
852	852	(q) "Poppy straw" means all parts, except the seeds, of the opium
853	853	poppy, after mowing.
854	854	(r) "School property" means property upon which is located a
855	855	structure used by a unified school district or an accredited nonpublic
856	856	school for student instruction or attendance or extracurricular activities of
857	857	pupils enrolled in kindergarten or any of the grades one through 12. This
858	858	definition shall not be construed as requiring that school be in session or
859	859	that classes are actually being held at the time of the offense or that
860	860	children must be present within the structure or on the property during the
861	861	time of any alleged criminal act. If the structure or property meets the
862	862	above definition, the actual use of that structure or property at the time
863	863	alleged shall not be a defense to the crime charged or the sentence
864	864	imposed.
865	865	(s) "Simulated controlled substance" means any product that
866	866	identifies itself by a common name or slang term associated with a
867	867	controlled substance and that indicates on its label or accompanying
868	868	promotional material that the product simulates the effect of a controlled
869	869	substance.
870	870	Sec. 5. K.S.A. 2024 Supp. 65-4101 is hereby amended to read as
871	871	follows: 65-4101. As used in this act:
872	872	(a) "Administer" means the direct application of a controlled
873	873	substance, whether by injection, inhalation, ingestion or any other means,
874	874	to the body of a patient or research subject by:
875	875	(1) A practitioner or pursuant to the lawful direction of a practitioner;
876	876	or
877	877	(2) the patient or research subject at the direction and in the presence
878	878	of the practitioner.
879	879	(b) "Agent" means an authorized person who acts on behalf of or at
880	880	the direction of a manufacturer, distributor or dispenser. "Agent" does not
881	881	include a common carrier, public warehouseman or employee of the carrier
882	882	or warehouseman.
883	883	(c) "Application service provider" means an entity that sells
884	884	electronic prescription or pharmacy prescription applications as a hosted
885	885	service where the entity controls access to the application and maintains
886	886	the software and records on its server.
887	887	(d) "Board" means the state board of pharmacy.
888	888	(e) "Bureau" means the bureau of narcotics and dangerous drugs,
889	889	United States department of justice, or its successor agency.
890	890	(f) "Controlled substance" means any drug, substance or immediate
891	891	precursor included in any of the schedules designated in K.S.A. 65-4105,
892	892	65-4107, 65-4109, 65-4111 and 65-4113, and amendments thereto.

936	936	(g) (1) "Controlled substance analog" means a substance that is
937	937	intended for human consumption, and at least one of the following:
938	938	(A) The chemical structure of the substance is substantially similar to
939	939	the chemical structure of a controlled substance listed in or added to the
940	940	schedules designated in K.S.A. 65-4105 or 65-4107, and amendments
941	941	thereto;
942	942	(B) the substance has a stimulant, depressant or hallucinogenic effect
943	943	on the central nervous system substantially similar to the stimulant,
944	944	depressant or hallucinogenic effect on the central nervous system of a
945	945	controlled substance included in the schedules designated in K.S.A. 65-
946	946	4105 or 65-4107, and amendments thereto; or
947	947	(C) with respect to a particular individual, such individual represents
948	948	or intends the substance to have a stimulant, depressant or hallucinogenic
949	949	effect on the central nervous system substantially similar to the stimulant,
950	950	depressant or hallucinogenic effect on the central nervous system of a
951	951	controlled substance included in the schedules designated in K.S.A. 65-
952	952	4105 or 65-4107, and amendments thereto.
953	953	(2) "Controlled substance analog" does not include:
954	954	(A) A controlled substance;
955	955	(B) a substance for which there is an approved new drug application;
956	956	or
957	957	(C) a substance with respect to which an exemption is in effect for
958	958	investigational use by a particular person under section 505 of the federal
959	959	food, drug and cosmetic act, 21 U.S.C. § 355, to the extent conduct with
960	960	respect to the substance is permitted by the exemption.
961	961	(h) "Counterfeit substance" means a controlled substance that, or the
962	962	container or labeling of which, without authorization bears the trademark,
963	963	trade name or other identifying mark, imprint, number or device or any
964	964	likeness thereof of a manufacturer, distributor or dispenser other than the
965	965	person who in fact manufactured, distributed or dispensed the substance.
966	966	(i) "Cultivate" means the planting or promotion of growth of five or
967	967	more plants that contain or can produce controlled substances.
968	968	(j) "DEA" means the U.S. department of justice, drug enforcement
969	969	administration.
970	970	(k) "Deliver" or "delivery" means the actual, constructive or
971	971	attempted transfer from one person to another of a controlled substance,
972	972	whether or not there is an agency relationship.
973	973	(l) "Dispense" means to deliver a controlled substance to an ultimate
974	974	user or research subject by or pursuant to the lawful order of a practitioner,
975	975	including the packaging, labeling or compounding necessary to prepare the
976	976	substance for that delivery, or pursuant to the prescription of a mid-level
977	977	practitioner.
978	978	(m) "Dispenser" means a practitioner or pharmacist who dispenses, or

1024	1024	(n) "Distribute" means to deliver other than by administering or
1025	1025	dispensing a controlled substance.
1026	1026	(o) "Distributor" means a person who distributes.
1027	1027	(p) (1) "Drug" means substances:
1028	1028	(A) Recognized as drugs in the official United States pharmacopeia,
1029	1029	official homeopathic pharmacopoeia of the United States or official
1030	1030	national formulary or any supplement to any of them;
1031	1031	(B) intended for use in the diagnosis, cure, mitigation, treatment or
1032	1032	prevention of disease in human or animals;
1033	1033	(C) other than food intended to affect the structure or any function of
1034	1034	the body of human or animals; and
1035	1035	(D) intended for use as a component of any article specified in
1036	1036	subparagraph (A), (B) or (C).
1037	1037	(2) "Drug" does not include devices or their components, parts or
1038	1038	accessories.
1039	1039	(q) "Immediate precursor" means a substance that the board has
1040	1040	found to be and by rule and regulation designates as being the principal
1041	1041	compound commonly used or produced primarily for use and that is an
1042	1042	immediate chemical intermediary used or likely to be used in the
1043	1043	manufacture of a controlled substance, the control of which is necessary to
1044	1044	prevent, curtail or limit manufacture.
1045	1045	(r) "Electronic prescription" means an electronically prepared
1046	1046	prescription that is authorized and transmitted from the prescriber to the
1047	1047	pharmacy by means of electronic transmission.
1048	1048	(s) "Electronic prescription application" means software that is used
1049	1049	to create electronic prescriptions and that is intended to be installed on the
1050	1050	prescriber's computers and servers where access and records are controlled
1051	1051	by the prescriber.
1052	1052	(t) "Electronic signature" means a confidential personalized digital
1053	1053	key, code, number or other method for secure electronic data transmissions
1054	1054	that identifies a particular person as the source of the message,
1055	1055	authenticates the signatory of the message and indicates the person's
1056	1056	approval of the information contained in the transmission.
1057	1057	(u) "Electronic transmission" means the transmission of an electronic
1058	1058	prescription, formatted as an electronic data file, from a prescriber's
1059	1059	electronic prescription application to a pharmacy's computer, where the
1060	1060	data file is imported into the pharmacy prescription application.
1061	1061	(v) "Electronically prepared prescription" means a prescription that is
1062	1062	generated using an electronic prescription application.
1063	1063	(w) "Facsimile transmission" or "fax transmission" means the
1064	1064	transmission of a digital image of a prescription from the prescriber or the

1109	1109	is not limited to, transmission of a written prescription between the
1110	1110	prescriber's fax machine and the pharmacy's fax machine; transmission of
1111	1111	an electronically prepared prescription from the prescriber's electronic
1112	1112	prescription application to the pharmacy's fax machine, computer or
1113	1113	printer; or transmission of an electronically prepared prescription from the
1114	1114	prescriber's fax machine to the pharmacy's fax machine, computer or
1115	1115	printer.
1116	1116	(x) "Intermediary" means any technology system that receives and
1117	1117	transmits an electronic prescription between the prescriber and the
1118	1118	pharmacy.
1119	1119	(y) "Isomer" means all enantiomers and diastereomers.
1120	1120	(z) "Manufacture" means the production, preparation, propagation,
1121	1121	compounding, conversion or processing of a controlled substance either
1122	1122	directly or indirectly or by extraction from substances of natural origin or
1123	1123	independently by means of chemical synthesis or by a combination of
1124	1124	extraction and chemical synthesis and includes any packaging or
1125	1125	repackaging of the substance or labeling or relabeling of its container,
1126	1126	except that this term does not include the preparation or compounding of a
1127	1127	controlled substance by an individual for the individual's own lawful use
1128	1128	or the preparation, compounding, packaging or labeling of a controlled
1129	1129	substance:
1130	1130	(1) By a practitioner or the practitioner's agent pursuant to a lawful
1131	1131	order of a practitioner as an incident to the practitioner's administering or
1132	1132	dispensing of a controlled substance in the course of the practitioner's
1133	1133	professional practice; or
1134	1134	(2) by a practitioner or by the practitioner's authorized agent under
1135	1135	such practitioner's supervision for the purpose of or as an incident to
1136	1136	research, teaching or chemical analysis or by a pharmacist or medical care
1137	1137	facility as an incident to dispensing of a controlled substance.
1138	1138	(aa) "Marijuana" means all parts of all varieties of the plant Cannabis

1200	1200	term in K.S.A. 65-425, and amendments thereto.
1201	1201	(cc) "Mid-level practitioner" means a certified nurse-midwife
1202	1202	engaging in the independent practice of midwifery under the independent
1203	1203	practice of midwifery act, an advanced practice registered nurse issued a
1204	1204	license pursuant to K.S.A. 65-1131, and amendments thereto, who has
1205	1205	authority to prescribe drugs under K.S.A. 65-1130, and amendments
1206	1206	thereto, or a physician assistant licensed under the physician assistant
1207	1207	licensure act who has authority to prescribe drugs pursuant to a written
1208	1208	agreement with a supervising physician under K.S.A. 65-28a08, and
1209	1209	amendments thereto.
1210	1210	(dd) "Narcotic drug" means any of the following whether produced
1211	1211	directly or indirectly by extraction from substances of vegetable origin or
1212	1212	independently by means of chemical synthesis or by a combination of
1213	1213	extraction and chemical synthesis:

1282	1282	(ii) "Pharmacist intern" means: (1) A student currently enrolled in an
1283	1283	accredited pharmacy program; (2) a graduate of an accredited pharmacy
1284	1284	program serving such person's internship; or (3) a graduate of a pharmacy
1285	1285	program located outside of the United States that is not accredited and who
1286	1286	had successfully passed equivalency examinations approved by the board.
1287	1287	(jj) "Pharmacy prescription application" means software that is used
1288	1288	to process prescription information, is installed on a pharmacy's computers
1289	1289	and servers, and is controlled by the pharmacy.
1290	1290	(kk) "Poppy straw" means all parts, except the seeds, of the opium
1291	1291	poppy, after mowing.
1292	1292	(ll) "Practitioner" means a person licensed to practice medicine and
1293	1293	surgery, dentist, podiatrist, veterinarian, optometrist, or scientific
1294	1294	investigator or other person authorized by law to use a controlled
1295	1295	substance in teaching or chemical analysis or to conduct research with
1296	1296	respect to a controlled substance.
1297	1297	(mm) "Prescriber" means a practitioner or a mid-level practitioner.
1298	1298	(nn) "Production" includes the manufacture, planting, cultivation,
1299	1299	growing or harvesting of a controlled substance.
1300	1300	(oo) "Readily retrievable" means that records kept by automatic data
1301	1301	processing applications or other electronic or mechanized recordkeeping
1302	1302	systems can be separated out from all other records within a reasonable
1303	1303	time not to exceed 48 hours of a request from the board or other authorized
1304	1304	agent or that hard-copy records are kept on which certain items are
1305	1305	asterisked, redlined or in some other manner visually identifiable apart
1306	1306	from other items appearing on the records.
1307	1307	(pp) "Ultimate user" means a person who lawfully possesses a
1308	1308	controlled substance for such person's own use or for the use of a member
1309	1309	of such person's household or for administering to an animal owned by
1310	1310	such person or by a member of such person's household.
1311	1311	Sec. 6. K.S.A. 2-3908 and K.S.A. 2024 Supp. 2-3901, 21-5701 and
1312	1312	65-4101 are hereby repealed.
1313	1313	Sec. 7. This act shall take effect and be in force from and after its
1314	1314	publication in the statute book.
