6+students who transfer to homeschooling or nonaccredited private
7+schools from the alternative calculation of graduation rates for virtual
8+schools; amending K.S.A. 2024 Supp. 72-3713 and repealing the
9+existing section.
610 Be it enacted by the Legislature of the State of Kansas:
7-New Section 1. For purposes of accreditation by the state board,
8-the four-year adjusted cohort graduation rate for each school district
9-and any schools operated by such school district, including any virtual
10-school, shall be determined by excluding any student who:
11-(a) Had not earned sufficient credits to be expected to graduate in
12-the same school year as such student's cohort at the time that such
13-student transferred to and enrolled in such school or school district; or
14-(b) was enrolled in such school or school district but subsequently
15-transferred to a nonaccredited private school in Kansas or another state.
16-Sec. 2. K.S.A. 2024 Supp. 72-3713 is hereby amended to read as

1813 supervision of the state board. The state board may adopt any rules and
19-regulations relating to virtual schools that the state board deems
20-necessary to administer and enforce the virtual school act.
21-(b) For purposes of accreditation by the state board, the four-year
22-adjusted cohort graduation rate for a virtual school shall be determined
23-by only including those students enrolled in such virtual school who
24-had earned sufficient credits to be expected to graduate in the same
25-school year as such student's cohort at the time such student first
26-enrolled in such virtual school. The virtual school's four-year adjusted
27-cohort graduation rate shall be determined in addition to the graduation
28-rates determined for the school district that operates the virtual school
29-and any other high schools operated by the school district.
30-(c) No virtual school shall offer or provide any financial incentive
31-for a student to enroll in a virtual school.
32-(d)(c) As used in this section, "financial incentive" means any
33-monetary payment or award that is intended to encourage, entice or
34-motivate a student to enroll in a virtual school.
35-Sec. 3. K.S.A. 2024 Supp. 72-3713 is hereby repealed. Substitute for SENATE BILL No. 45—page 2
36-Sec. 4. This act shall take effect and be in force from and after its
14+regulations relating to virtual schools that the state board deems necessary
15+to administer and enforce the virtual school act.
16+(b) (1) For purposes of accreditation by the state board, the four-year
17+adjusted cohort graduation rate for a virtual school shall be determined by:
18+(A) Only including those students enrolled in such virtual school who
19+had earned sufficient credits to be expected to graduate in the same school
20+year as such student's cohort at the time such student first enrolled in such
21+virtual school; and
22+(B) excluding those students who were enrolled in such virtual school
23+but transferred to homeschooling or a nonaccredited private school in
24+Kansas or another state.
25+(2) The virtual school's four-year adjusted cohort graduation rate shall
26+be determined in addition to the graduation rates determined for the school
27+district that operates the virtual school and any other high schools operated
28+by the school district.
29+(c) No virtual school shall offer or provide any financial incentive for
30+a student to enroll in a virtual school.
31+(d) As used in this section, "financial incentive" means any monetary
32+payment or award that is intended to encourage, entice or motivate a
33+student to enroll in a virtual school.
