2-AN ACT concerning traffic regulations; relating to the duty of drivers approaching

59 Be it enacted by the Legislature of the State of Kansas:
6-New Section 1. (a) The driver of a motor vehicle, upon
7-approaching a stopped, standing or parked vehicle that is displaying
8-hazard warning signal lamps, road flares or caution signals, including
9-traffic cones, caution signs or reflective triangles, shall do either of the
10-following:

14-due caution and, if possible and with due regard to the road, weather
15-and traffic conditions, shall change lanes into a lane that is not adjacent
16-to that of the stationary vehicle; or
17-(2) if the driver is not traveling on a highway of a type described
18-in paragraph (1), or if the driver is traveling on a highway of that type
19-but it is not possible to change lanes or if to do so would be unsafe, the
20-driver shall proceed with due caution, reduce the speed of the motor
21-vehicle and maintain a safe speed for the road, weather and traffic
22-conditions.
23-(b) This section shall be a part of and supplemental to the uniform
24-act regulating traffic on highways.
25-Sec. 2. K.S.A. 8-2118 is hereby amended to read as follows: 8-
26-2118. (a) A person charged with a traffic infraction shall, except as
27-provided in subsection (b), appear at the place and time specified in the
28-notice to appear. If the person enters an appearance, waives right to
29-trial, pleads guilty or no contest, the fine shall be no greater than that
30-specified in the uniform fine schedule in subsection (c) and court costs
31-shall be taxed as provided by law.

3234 (b) Prior to the time specified in the notice to appear, a person
3335 charged with a traffic infraction may enter a written appearance, waive
34-right to trial, plead guilty or no contest and pay the fine for the violation
35-as specified in the uniform fine schedule in subsection (c) and court
36-costs provided by law. Payment may be made in any manner accepted
37-by the court. The traffic citation shall not have been complied with if
38-the payment is not honored for any reason, or if the fine and court costs
39-are not paid in full. When a person charged with a traffic infraction
40-makes payment without executing a written waiver of right to trial and
41-plea of guilty or no contest, the payment shall be deemed such an
42-appearance, waiver of right to trial and plea of no contest.

399781 (d) Traffic offenses classified as traffic infractions by this section
400-shall be classified as ordinance traffic infractions by those cities
401-adopting ordinances prohibiting the same offenses. A schedule of fines
402-for all ordinance traffic infractions shall be established by the
403-municipal judge in the manner prescribed by K.S.A. 12-4305, and
404-amendments thereto. Such fines may vary from those contained in the
405-uniform fine schedule contained in subsection (c).
406-(e) Fines listed in the uniform fine schedule contained in
407-subsection (c) shall be doubled if a person is convicted of a traffic
408-infraction, which is defined as a moving violation in accordance with
409-rules and regulations adopted pursuant to K.S.A. 8-249, and
410-amendments thereto, committed within any road construction zone as
411-defined in K.S.A. 8-1458a, and amendments thereto.

439-amendments thereto, such person, upon conviction, shall be fined $750
440-for the second violation. For a third and each succeeding violation of
441-K.S.A. 8-1556, and amendments thereto, within five years after two
442-prior convictions of K.S.A. 8-1556, and amendments thereto, such
443-person, upon conviction, shall be fined $1,000 for the third and each
444-succeeding violation.
