| 9 | 9 | | each account of the state general fund that is appropriated for the fiscal |

| 10 | 10 | | year ending June 30, 2026, by the amount of the salaries and wages for |
|---|
| 11 | 11 | | such abolished positions. |
|---|
| 12 | 12 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 13 | 13 | | Section 1. (a) On or before June 30, 2025, the head of each state |
|---|
| 14 | 14 | | agency and the director of the budget shall consult and jointly certify to the |
|---|
| 15 | 15 | | secretary of administration the number of vacant positions in each such |
|---|
| 16 | 16 | | state agency paid from appropriations from the state general fund that have |
|---|
| 17 | 17 | | been vacant for more than 180 calendar days as of June 30, 2025. Upon |
|---|
| 18 | 18 | | receipt of each such certification, the secretary of administration shall |
|---|
| 19 | 19 | | abolish the certified vacant positions on July 1, 2025. Such abolished |
|---|
| 20 | 20 | | positions shall be deleted from the budget documents and reports prepared |
|---|
| 21 | 21 | | by the director of the budget, the governor or the legislative research |
|---|
| 22 | 22 | | department, including all related legislative reports and measures |
|---|
| 23 | 23 | | submitted to the legislature. |

| 24 | 24 | | (b) On July 1, 2025, the amount in each account of the state general |
|---|
| 25 | 25 | | fund of each state agency that is appropriated for the fiscal year ending |
|---|
| 26 | 26 | | June 30, 2026, by any appropriation act of the 2025 regular session of the |
|---|
| 27 | 27 | | legislature, and that is budgeted for payment of salaries and wages, |
|---|
| 28 | 28 | | including associated fringe benefits, of such abolished vacant positions, as |
|---|
| 29 | 29 | | certified by the director of the budget to the director of accounts and |
|---|
| 30 | 30 | | reports for fiscal year 2026, is hereby lapsed from each such account. |
|---|
| 31 | 31 | | When the director of the budget transmits each such certification to the |
|---|
| 32 | 32 | | director of accounts and reports pursuant to this section, the director of the |
|---|
| 33 | 33 | | budget shall transmit a copy of such certification to the director of |
|---|
| 34 | 34 | | legislative research. |
|---|
| 35 | 35 | | (c) As used in this section, "state agency" means any state agency |
|---|
| 36 | 36 | | named in an appropriation act of the 2025 regular session of the |
|---|
| 37 | 37 | | legislature. |
|---|
| 38 | 38 | | Sec. 2. This act shall take effect and be in force from and after its |
|---|
| 39 | 39 | | publication in the Kansas register. |
