55 AN ACT concerning the state budget; relating to full-time positions;
66 requiring the head of each state agency to certify the number of full-
77 time positions paid from the state general fund that have been vacant
88 for more than 180 calendar days and abolishing such positions; lapsing
99 each account of the state general fund that is appropriated for the fiscal
1010 year ending June 30, 2026, by the amount of the salaries and wages for
1111 such abolished positions.
1212 Be it enacted by the Legislature of the State of Kansas:
1313 Section 1. (a) On or before June 30, 2025, the head of each state
1414 agency and the director of the budget shall consult and jointly certify to the
1515 secretary of administration the number of vacant positions in each such
1616 state agency paid from appropriations from the state general fund that have
1717 been vacant for more than 180 calendar days as of June 30, 2025. Upon
1818 receipt of each such certification, the secretary of administration shall
1919 abolish the certified vacant positions on July 1, 2025. Such abolished
2020 positions shall be deleted from the budget documents and reports prepared
2121 by the director of the budget, the governor or the legislative research
2222 department, including all related legislative reports and measures
2323 submitted to the legislature.
2424 (b) On July 1, 2025, the amount in each account of the state general
2525 fund of each state agency that is appropriated for the fiscal year ending
2626 June 30, 2026, by any appropriation act of the 2025 regular session of the
2727 legislature, and that is budgeted for payment of salaries and wages,
2828 including associated fringe benefits, of such abolished vacant positions, as
2929 certified by the director of the budget to the director of accounts and
3030 reports for fiscal year 2026, is hereby lapsed from each such account.
3131 When the director of the budget transmits each such certification to the
3232 director of accounts and reports pursuant to this section, the director of the
3333 budget shall transmit a copy of such certification to the director of
3434 legislative research.
3535 (c) As used in this section, "state agency" means any state agency
3636 named in an appropriation act of the 2025 regular session of the
3737 legislature.
3838 Sec. 2. This act shall take effect and be in force from and after its
3939 publication in the Kansas register.
