AN ACT relating to privacy. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 15 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) No federal, state, or local law enforcement agency or regulatory agency shall be 5 
granted in-person or drone access to private lands for any inspection, visit, 6 
surveillance, or installation of surveillance devices without immediate probable 7 
cause, a warrant, or landowner permission. 8 
(2) This protection extends to the entire parcel of land, not just any dwelling and 9 
curtilage surrounding it, notwithstanding any common law open fields doctrine.  10 
(3) Landowner permission for agency access can be requested in person, by phone, 11 
electronic communication, or mail, and must contain the date or range of dates, 12 
location, and purpose of the access. Such requests shall be logged by the agency 13 
and shall be available for inspection pursuant to the Kentucky Open Records Act 14 
as set forth in KRS 61.870 to 61.884. 15
