AN ACT relating to school fiscal impact statements. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1. A NEW SECTION OF KRS CHAPTER 6 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) No bill or resolution which relates to any aspect of the common schools or any 5 
service provided thereby and causes a common school to incur a cost shall be 6 
voted on by a standing committee of either chamber of the General Assembly 7 
unless a school fiscal impact statement has been prepared and attached to the bill 8 
pursuant to subsection (2) of this section. 9 
(2) The director of the Legislative Research Commission shall have the school fiscal 10 
impact statement prepared by the Legislative Research Commission or by other 11 
departments or agencies of state government for any bill or resolution introduced 12 
before the General Assembly which relates to any aspect of the common schools 13 
or any service provided thereby and causes a common school to incur a cost. 14 
Departments or agencies of state government so requested by the director shall 15 
comply with the request within seven (7) working days of receipt. The school 16 
fiscal impact statement shall be filed with the clerk in the chamber of the General 17 
Assembly in which the bill was introduced and attached to each copy of the bill. 18 
(3) The Legislative Research Commission may submit to any other departments or 19 
agencies of state government, any part of the common school system, or any 20 
entity that officially represents parts of the common school system any request for 21 
information concerning local fiscal management and fiscal conditions. Each 22 
recipient shall be required to comply with such requests within seven (7) working 23 
days. 24 
(4) A school fiscal impact statement shall state whether the bill or resolution is 25 
determined to be a mandate. Such determination shall be made by the director of 26 
the Legislative Research Commission, except as provided by subsection (5) of this 27  UNOFFICIAL COPY  	22 RS BR 1428

section. If the bill or order is a state mandate, the note shall contain an estimate 1 
of the effect the law will have on expenditures or revenues of local government 2 
for the first full fiscal year the law is to be in effect. 3 
(5) The director, at his or her discretion, may seek a certification from the Attorney 4 
General on the question of whether a bill or resolution constitutes a state 5 
mandate. The Attorney General shall, within seven (7) working days from receipt 6 
of the request, certify to the director that the bill or resolution is or is not a state 7 
mandate. 8 
(6) If any bill or resolution is amended after the preparation of the school fiscal 9 
impact statement, it shall be resubmitted to the person responsible for preparation 10 
of the note, who shall reevaluate the bill or resolution as amended and change 11 
the statement in accordance with the amendment. 12 
(7) Copies of the school fiscal impact statement shall be furnished by the Legislative 13 
Research Commission to any school official upon written request. 14 
(8) The director of the Legislative Research Commission shall establish policies and 15 
procedures to ensure the accurate and timely production of school fiscal impact 16 
statements, including but not limited to: 17 
(a) Establishing a system for collecting, compiling, and analyzing fiscal and 18 
other information from the common school system; 19 
(b) Delegating responsibilities for aspects of the school fiscal impact statements 20 
to the various subdivisions of the Legislative Research Commission; and 21 
(c) Establishing the format and design of the statements. 22 
Section 2.   Section 1 of this Act shall go into effect on January 1, 2024, with the 23 
intent that it be operational for the 2024 Regular Session of the General Assembly. The 24 
Legislative Research Commission shall develop and refine the policies and procedures 25 
necessary for implementation during the 2023 Regular Session. 26
