AN ACT relating to teachers. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 158.060 is amended to read as follows: 3 
(1) Twenty (20) school days, or days in which teachers are actually employed in the 4 
schoolroom, shall constitute a school month in the common schools. 5 
(2) (a) Each full-time teacher shall be provided the equivalent of fifty-five (55) 6 
minutes of non-instructional planning time each school day which shall be 7 
used at the teacher's discretion and may include but is not limited to 8 
grading, instructional planning, curriculum development, and outreach 9 
activities involving his or her students. 10 
(b) Each full-time teacher shall be provided with a duty-free lunch period each 11 
day during the regularly scheduled student lunch period in addition to the 12 
fifty-five (55) minutes of noninstructional planning time as described in 13 
paragraph(a) of this subsection. The duty-free lunch period shall be not less 14 
than the length of the lunch period specified in the school calendar approved 15 
by the chief state school officer.  16 
(c) Each full-time teacher shall receive additional compensation at one and 17 
one-half (1-1/2) their usual hourly rate of pay for any time they are required 18 
to supervise or provide instruction to children during his or her 19 
noninstructional planning or duty-free lunch, except that a full-time teacher 20 
may be assigned to lunch room duty during the regularly scheduled student 21 
lunch period without additional compensation for any scheduled [only for an 22 
amount of time equal to the ] noninstructional time in excess of the fifty-five 23 
(55) minutes required by subsection (2)(a) of this section[included in the 24 
teacher's daily schedule]. 25 
(d) The calculation of a teacher's noninstructional time shall not include the 26

prior to the start of the student's instructional day, or the time teachers are 1 
required to remain at school after the students are dismissed. 2 
(3) Except for children with disabilities and children attending the primary school 3 
program who may attend a program of less than six (6) hours per day under policy 4 
adopted by the local school district board of education and approved by the 5 
commissioner of education and children attending a school district where the local 6 
board has approved a schedule that provides at least the equivalent of six (6) hours 7 
of daily instruction during the school year, a minimum of six (6) hours of actual 8 
school work shall constitute a school day. Kindergarten programs may be operated 9 
for less than six (6) hours without state board approval. The Kentucky Board of 10 
Education, upon recommendation of the chief state school officer, shall develop and 11 
approve regulations governing make up by school districts of whole days missed 12 
due to emergencies, or partial days missed as a result of shortening regularly 13 
scheduled school days due to emergencies. 14 
(4) Teachers shall be provided additional time for district- or school- required 15 
nonteaching activities. This[The] nonteaching time shall be used to provide teachers 16 
opportunities for district- or school- required professional development activities 17 
as provided in KRS 156.095, instructional planning, school-based decision making 18 
as provided in KRS 160.345, curriculum development, and outreach activities 19 
involving their students' families and the community. 20 
(5) Character education programs and activities shall be considered valuable and 21 
legitimate components of the actual school work constituting a school day under 22 
subsection (3) of this section. 23
