AN ACT relating to coal-derived carbon and making an appropriation therefor. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 152 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) As used in this section, "CAER" means the University of Kentucky Center for 5 
Applied Energy Research. 6 
(2) CAER shall establish a research, development, and demonstration program for 7 
carbon engineering solutions to enable new uses for coal-derived carbon, 8 
including the use and conversion of raw coal and processed coal products in all 9 
phases for: 10 
(a) Commercial purposes; 11 
(b) Industrial purposes; 12 
(c) Defense and military purposes; 13 
(d) Agricultural purposes, including soil amendments and fertilizers; 14 
(e) Medical and pharmaceutical applications; 15 
(f) Construction and building applications; 16 
(g) Energy applications; and 17 
(h) Production of critical minerals. 18 
(3) On or before December 1, 2022, and each December 1 thereafter, CAER shall 19 
submit a report to the Legislative Research Commission that: 20 
(a) Describes the progress and results of the program; and 21 
(b) Includes an analysis of the feasibility of the new uses for coal-derived 22 
carbon researched, developed, and demonstrated under subsection (2) of 23 
this section. 24 
Section 2.   (1) As used in this section, "eligible company" means a 25 
renewable chemical company that: 26 
(a) Extracts valuable products from coal combustion waste using a standardized 27  UNOFFICIAL COPY  	22 RS BR 2137

modular plant structure; 1 
(b) Uses innovative sequencing and chemical formulas and processes to deliver 2 
marketable commodities; and 3 
(c) Recovers materials that are in demand within the production of fertilizer, 4 
industrial additives, cement, and specialty filler products. 5 
(2) CAER, acting jointly with an eligible company, shall conduct a study to 6 
determine the feasibility of, and opportunities for, the commercialization of coal fly ash 7 
and coal-derived carbon products. On or before December 1, 2022, CAER shall file a 8 
report with the Legislative research Commission detailing the results of the study and 9 
making recommendations for the establishment of a coal-carbon products center of 10 
excellence in a major coal-producing region of eastern Kentucky. 11 
(3) On or before January 1, 2023, CAER shall, in partnership with an eligible 12 
company, commence a two-year pilot and demonstration program in a coal-producing 13 
county of eastern Kentucky for the purpose of accelerating the commercial deployment of 14 
coal-carbon fly ash. There is hereby appropriated General Fund moneys in the amount of 15 
$10,000,000 to the University of Kentucky in fiscal year 2022-2023 to accomplish the 16 
purposes of this subsection. 17 
(4) There is hereby appropriated General Fund moneys in the amount of 18 
$10,000,000 to the University of Kentucky in fiscal year 2022-2023 to establish the 19 
program created in Section 1 of this Act and to carry out the study described in subsection 20 
(2) of this section. 21 
Section 3.   This Act may be cited as the Coal Fly Ash Act of 2022. 22
