AN ACT relating to relating to Kentucky Employees Retirement System employers. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 61.526 is amended to read as follows: 3
(1) Upon becoming a member of the Kentucky Employees Retirement System, the 4
County Employees Retirement System, or the State Police Retirement System, the 5
employee and employer may file in the retirement office, in the form and detail as 6
the authority may prescribe, a statement of facts pertaining to the employee and 7
other information the authority may require, including but not limited to a record of 8
military service and previous employment with the employer. 9
(2) If the records of the employer who has employed[employing] the member during 10
the time the service was rendered do not substantiate the statement of facts filed by 11
the member, the member shall be notified of any discrepancy. The member shall be 12
advised that he has the responsibility of supplying verification of any 13
unsubstantiated service. 14
(3) At the request of the member, or the beneficiary if the member is deceased, the 15
Authority's executive director shall arrange a time and place or process to receive 16
additional information in regard to the unsubstantiated service. After filing the 17
request, the member or the beneficiary if the member is deceased, shall have a 18
reasonable time but no more than six (6) months to present the additional 19
information to substantiate the unsubstantiated service. 20
(4) The system may allow a member to retire or obtain a refund without the member 21
submitting a statement of facts pertaining to the member as described by this 22
section. 23
