AN ACT relating to crimes and punishments. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 520.090 is amended to read as follows: 3 
(1) A person is guilty of resisting arrest when he or she intentionally prevents or 4 
attempts to prevent a peace officer, recognized to be acting under color of his or her 5 
official authority, from effecting an arrest of the actor or another by:  6 
(a) Using or threatening to use physical force or violence against the peace officer 7 
or another; or  8 
(b) Using any other means creating a substantial risk of causing physical injury to 9 
the peace officer or another.  10 
(2) Resisting arrest is a Class A misdemeanor. 11
