Within the Office of the Secretary, there shall be an Office 1 of the Ombudsman and Administrative Review, an Office of Legal Services, an 2 Office of Inspector General, an Office of Public Affairs, an Office of Human 3 Resource Management, an Office of Finance and Budget, an Office of Legislative 4 and Regulatory Affairs, an Office of Administrative Services, [and ]an Office of 5 Application Technology Services, and an Office of Data Analytics, as follows: 6 (a) The Office of the Ombudsman and Administrative Review shall be headed by 7 an executive director who shall be appointed by the secretary with the 8 approval of the Governor under KRS 12.050 and shall: 9 1. Investigate, upon complaint or on its own initiative, any administrative 10 act of an organizational unit, employee, or contractor of the cabinet, 11 without regard to the finality of the administrative act. Organizational 12 units, employees, or contractors of the cabinet shall not willfully 13 obstruct an investigation, restrict access to records or personnel, or 14 retaliate against a complainant or cabinet employee; 15 2. Make recommendations that resolve citizen complaints and improve 16 governmental performance and may require corrective action when 17 policy violations are identified; 18 3. Provide evaluation and information analysis of cabinet performance and 19 compliance with state and federal law; 20 4. Place an emphasis on research and best practices, program 21 accountability, quality service delivery, and improved governmental 22 performance; 23 5. Provide information on how to contact the office for public posting at all 24 offices where Department for Community Based Services employees or 25 contractors work, at any facility where a child in the custody of the 26 cabinet resides, and to all cabinet or contracted foster parents; 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 17 of 27 SB013310.100 - 1649 - XXXX GA 6. Report to the Office of Inspector General for review and investigation 1 any charge or case against an employee of the Cabinet for Health and 2 Family Services where it has cause to believe the employee has engaged 3 in dishonest, unethical, or illegal conduct or practices related to his or 4 her job duties; or any violation of state law or administrative regulation 5 by any organization or individual regulated by, or contracted with the 6 cabinet; 7 7. Compile a report of all citizen complaints about programs or services of 8 the cabinet and a summary of resolution of the complaints and submit 9 the report upon request to the Child Welfare Oversight and Advisory 10 Committee established in KRS 6.943, and the Interim Joint Committee 11 on Health and Welfare and Family Services; 12 8. Include oversight of administrative hearings; and 13 9. Provide information to the Office of the Attorney General, when 14 requested, related to substantiated violations of state law against an 15 employee, a contractor of the cabinet, or a foster or adoptive parent; 16 (b) The Office of Legal Services shall provide legal advice and assistance to all 17 units of the cabinet in any legal action in which it may be involved. The Office 18 of Legal Services shall employ all attorneys of the cabinet who serve the 19 cabinet in the capacity of attorney, giving legal advice and opinions 20 concerning the operation of all programs in the cabinet. The Office of Legal 21 Services shall be headed by a general counsel who shall be appointed by the 22 secretary with the approval of the Governor under KRS 12.050 and 12.210. 23 The general counsel shall be the chief legal advisor to the secretary and shall 24 be directly responsible to the secretary. The Attorney General, on the request 25 of the secretary, may designate the general counsel as an assistant attorney 26 general under the provisions of KRS 15.105; 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 18 of 27 SB013310.100 - 1649 - XXXX GA (c) The Office of Inspector General shall be headed by an inspector general who 1 shall be appointed by the secretary with the approval of the Governor. The 2 inspector general shall be directly responsible to the secretary. The Office of 3 Inspector General shall be responsible for: 4 1. The conduct of audits and investigations for detecting the perpetration of 5 fraud or abuse of any program by any client, or by any vendor of 6 services with whom the cabinet has contracted; and the conduct of 7 special investigations requested by the secretary, commissioners, or 8 office heads of the cabinet into matters related to the cabinet or its 9 programs; 10 2. Licensing and regulatory functions as the secretary may delegate; 11 3. Review of health facilities participating in transplant programs, as 12 determined by the secretary, for the purpose of determining any 13 violations of KRS 311.1911 to 311.1959, 311.1961, and 311.1963; 14 4. The duties, responsibilities, and authority pertaining to the certificate of 15 need functions and the licensure appeals functions, pursuant to KRS 16 Chapter 216B;[ and] 17 5. The notification and forwarding of any information relevant to possible 18 criminal violations to the appropriate prosecuting authority; 19 6. The oversight of the operations of the Kentucky Health Information 20 Exchange; and 21 7. The support and guidance to health care providers related to 22 telehealth services including the development of policy, standards, 23 resources, and education to expand telehealth services across the 24 Commonwealth; 25 (d) The Office of Public Affairs shall be headed by an executive director 26 appointed by the secretary with the approval of the Governor in accordance 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 19 of 27 SB013310.100 - 1649 - XXXX GA with KRS 12.050. The office shall provide information to the public and news 1 media about the programs, services, and initiatives of the cabinet; 2 (e) The Office of Human Resource Management shall be headed by an executive 3 director appointed by the secretary with the approval of the Governor in 4 accordance with KRS 12.050. The office shall coordinate, oversee, and 5 execute all personnel, training, and management functions of the cabinet. The 6 office shall focus on the oversight, development, and implementation of 7 quality improvement services; curriculum development and delivery of 8 instruction to staff; the administration, management, and oversight of training 9 operations; health, safety, and compliance training; and equal employment 10 opportunity compliance functions; 11 (f) The Office of Finance and Budget shall be headed by an executive director 12 appointed by the secretary with the approval of the Governor in accordance 13 with KRS 12.050. The office shall provide central review and oversight of 14 budget, contract, and cabinet finances. The office shall provide coordination, 15 assistance, and support to program departments and independent review and 16 analysis on behalf of the secretary; 17 (g) The Office of Legislative and Regulatory Affairs shall be headed by an 18 executive director appointed by the secretary with the approval of the 19 Governor in accordance with KRS 12.050. The office shall provide central 20 review and oversight of legislation, policy, and administrative regulations. 21 The office shall provide coordination, assistance, and support to program 22 departments and independent review and analysis on behalf of the secretary; 23 (h) The Office of Administrative Services shall be headed by an executive 24 director appointed by the secretary with the approval of the Governor in 25 accordance with KRS 12.050. The office shall provide central review and 26 oversight of procurement, general accounting including grant monitoring, and 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 20 of 27 SB013310.100 - 1649 - XXXX GA facility management. The office shall provide coordination, assistance, and 1 support to program departments and independent review and analysis on 2 behalf of the secretary;[ and] 3 (i) The Office of Application Technology Services shall be headed by an 4 executive director appointed by the secretary with the approval of the 5 Governor in accordance with KRS 12.050. The office shall provide 6 application technology services including central review and oversight. The 7 office shall provide coordination, assistance, and support to program 8 departments and independent review and analysis on behalf of the secretary 9 and 10 (j) The Office of Data Analytics shall be headed by an executive director who 11 shall be appointed by the secretary with the approval of the Governor under 12 KRS 12.050 and shall identify and innovate strategic initiatives to inform 13 public policy initiatives and provide opportunities for improved health 14 outcomes for all Kentuckians through data analytics. The office shall 15 provide leadership in the redesign of the health care delivery system using 16 electronic information technology to improve patient care and reduce 17 medical errors and duplicative services; 18 (2) Department for Medicaid Services. The Department for Medicaid Services shall 19 serve as the single state agency in the Commonwealth to administer Title XIX of the 20 Federal Social Security Act. The Department for Medicaid Services shall be headed 21 by a commissioner for Medicaid services, who shall be appointed by the secretary 22 with the approval of the Governor under KRS 12.050. The commissioner for 23 Medicaid services shall be a person who by experience and training in 24 administration and management is qualified to perform the duties of this office. The 25 commissioner for Medicaid services shall exercise authority over the Department 26 for Medicaid Services under the direction of the secretary and shall only fulfill those 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 21 of 27 SB013310.100 - 1649 - XXXX GA responsibilities as delegated by the secretary; 1 (3) Department for Public Health. The Department for Public Health shall develop and 2 operate all programs of the cabinet that provide health services and all programs for 3 assessing the health status of the population for the promotion of health and the 4 prevention of disease, injury, disability, and premature death. This shall include but 5 not be limited to oversight of the Division of Women's Health. The Department for 6 Public Health shall be headed by a commissioner for public health who shall be 7 appointed by the secretary with the approval of the Governor under KRS 12.050. 8 The commissioner for public health shall be a duly licensed physician who by 9 experience and training in administration and management is qualified to perform 10 the duties of this office. The commissioner shall advise the head of each major 11 organizational unit enumerated in this section on policies, plans, and programs 12 relating to all matters of public health, including any actions necessary to safeguard 13 the health of the citizens of the Commonwealth. The commissioner shall serve as 14 chief medical officer of the Commonwealth. The commissioner for public health 15 shall exercise authority over the Department for Public Health under the direction of 16 the secretary and shall only fulfill those responsibilities as delegated by the 17 secretary; 18 (4) Department for Behavioral Health, Developmental and Intellectual Disabilities. The 19 Department for Behavioral Health, Developmental and Intellectual Disabilities shall 20 develop and administer programs for the prevention of mental illness, intellectual 21 disabilities, brain injury, developmental disabilities, and substance use[abuse] 22 disorders and shall develop and administer an array of services and support for the 23 treatment, habilitation, and rehabilitation of persons who have a mental illness or 24 emotional disability, or who have an intellectual disability, brain injury, 25 developmental disability, or a substance use[abuse] disorder. The Department for 26 Behavioral Health, Developmental and Intellectual Disabilities shall be headed by a 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 22 of 27 SB013310.100 - 1649 - XXXX GA commissioner for behavioral health, developmental and intellectual disabilities who 1 shall be appointed by the secretary with the approval of the Governor under KRS 2 12.050. The commissioner for behavioral health, developmental and intellectual 3 disabilities shall be by training and experience in administration and management 4 qualified to perform the duties of the office. The commissioner for behavioral 5 health, developmental and intellectual disabilities shall exercise authority over the 6 department under the direction of the secretary, and shall only fulfill those 7 responsibilities as delegated by the secretary; 8 (5) Office for Children with Special Health Care Needs. The duties, responsibilities, 9 and authority set out in KRS 200.460 to 200.490 shall be performed by the office. 10 The office shall advocate the rights of children with disabilities and, to the extent 11 that funds are available, shall ensure the administration of services for children with 12 disabilities as are deemed appropriate by this office pursuant to Title V of the Social 13 Security Act. The office may promulgate administrative regulations under KRS 14 Chapter 13A as may be necessary to implement and administer its responsibilities. 15 The duties, responsibilities, and authority of the Office for Children with Special 16 Health Care Needs shall be performed through the office of the executive director. 17 The executive director shall be appointed by the secretary with the approval of the 18 Governor under KRS 12.050; 19 (6) Department for Family Resource Centers and Volunteer Services. The Department 20 for Family Resource Centers and Volunteer Services shall streamline the various 21 responsibilities associated with the human services programs for which the cabinet 22 is responsible. This shall include, but not be limited to, oversight of the Division of 23 Family Resource and Youth Services Centers and Serve Kentucky. The Department 24 for Family Resource Centers and Volunteer Services shall be headed by a 25 commissioner who shall be appointed by the secretary with the approval of the 26 Governor under KRS 12.050. The commissioner for family resource centers and 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 23 of 27 SB013310.100 - 1649 - XXXX GA volunteer services shall be by training and experience in administration and 1 management qualified to perform the duties of the office, shall exercise authority 2 over the department under the direction of the secretary, and shall only fulfill those 3 responsibilities as delegated by the secretary; 4 (7) [The Office of Health Data and Analytics shall identify and innovate strategic 5 initiatives to inform public policy initiatives and provide opportunities for improved 6 health outcomes for all Kentuckians through data analytics. The office shall provide 7 leadership in the redesign of the health care delivery system using electronic 8 information technology as a means to improve patient care and reduce medical 9 errors and duplicative services. The office shall facilitate the purchase of individual 10 and small business health insurance coverage for Kentuckians. The office shall be 11 headed by an executive director appointed by the secretary with the approval of the 12 Governor under KRS 12.050; 13 (8) ]Department for Community Based Services. The Department for Community 14 Based Services shall administer and be responsible for child and adult protection, 15 violence prevention resources, foster care and adoption, permanency, and services 16 to enhance family self-sufficiency, including child care, social services, public 17 assistance, and family support. The department shall be headed by a commissioner 18 appointed by the secretary with the approval of the Governor in accordance with 19 KRS 12.050; 20 (8)[(9)] Department for Income Support. The Department for Income Support shall be 21 responsible for child support enforcement and disability determination. The 22 department shall serve as the state unit as required by Title II and Title XVI of the 23 Social Security Act, and shall have responsibility for determining eligibility for 24 disability for those citizens of the Commonwealth who file applications for 25 disability with the Social Security Administration. The department shall be headed 26 by a commissioner appointed by the secretary with the approval of the Governor in 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 24 of 27 SB013310.100 - 1649 - XXXX GA accordance with KRS 12.050; and 1 (9)[(10)] Department for Aging and Independent Living. The Department for Aging and 2 Independent Living shall serve as the state unit as designated by the Administration 3 on Aging Services under the Older Americans Act and shall have responsibility for 4 administration of the federal community support services, in-home services, meals, 5 family and caregiver support services, elder rights and legal assistance, senior 6 community services employment program, the state health insurance assistance 7 program, state home and community based services including home care, 8 Alzheimer's respite services and the personal care attendant program, certifications 9 of assisted living facilities, the state Council on Alzheimer's Disease and other 10 related disorders, and guardianship services. The department shall also administer 11 the Long-Term Care Ombudsman Program and the Medicaid Home and 12 Community Based Waivers Participant Directed Services Option (PDS) Program. 13 The department shall serve as the information and assistance center for aging and 14 disability services and administer multiple federal grants and other state initiatives. 15 The department shall be headed by a commissioner appointed by the secretary with 16 the approval of the Governor in accordance with KRS 12.050. 17 Section 3. KRS 194A.101 is amended to read as follows: 18 (1) The Office[Division] of Data Analytics is hereby created in the Office of the 19 Secretary[Health Data and Analytics]. The office[division] shall provide oversight 20 and strategic direction and be responsible for coordinating the data analysis 21 initiatives for the various departments that regulate health care and social services to 22 ensure that policy is consistent with the long-term goals across the Commonwealth. 23 (2) The office[division] shall have the authority to review all data requests received by 24 the cabinet from the public, review the requests for content to determine the 25 cabinet's response, and approve the release of the requested information. The 26 office[division] shall review data analyses conducted by the departments within the 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 25 of 27 SB013310.100 - 1649 - XXXX GA cabinet to ensure the consistency, quality, and validity of the analysis prior to its use 1 in operational and policy decisions. The office[division] shall facilitate the process 2 of data integration by initiating and maintaining data-sharing agreements in order to 3 improve inter-agency and cross-cabinet collaboration. 4 (3) The Office of [Health ]Data [and ]Analytics shall promulgate administrative 5 regulations in accordance with KRS Chapter 13A to implement this section. 6 Section 4. KRS 194A.103 is amended to read as follows: 7 (1) The Division of Kentucky Health Information Exchange is hereby created in the 8 Office of Inspector General[Health Data and Analytics]. The division shall provide 9 leadership in the redesign of the health care delivery system using electronic 10 information technology as a means to improve patient care and reduce medical 11 errors and duplicative services. 12 (2) The Office of Inspector General[Health Data and Analytics] shall promulgate 13 administrative regulations in accordance with KRS Chapter 13A to implement the 14 provisions of this section. 15 Section 5. KRS 194A.105 is amended to read as follows: 16 There is hereby created a Division of Telehealth Services within the Office of Inspector 17 General[Health Data and Analytics] to be headed by a director appointed by the secretary 18 pursuant to KRS 12.050. The division shall: 19 (1) Provide guidance and direction to healthcare providers delivering care using 20 telehealth; 21 (2) Develop guidance, resources, and education to help promote access to healthcare 22 services in the Commonwealth; 23 (3) Assist the Cabinet for Health and Family Services with the implementation of KRS 24 211.334; and 25 (4) Provide the Department for Medicaid Services with any additional information 26 deemed relevant by the division for inclusion in the report required by KRS 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 26 of 27 SB013310.100 - 1649 - XXXX GA 211.334(3). 1 Section 6. KRS 211.334 is amended to read as follows: 2 (1) The cabinet, in consultation with the Division of Telehealth Services within the 3 Office of Inspector General[Health Data and Analytics] as established in KRS 4 194A.105, shall: 5 (a) Provide guidance and direction to providers delivering health care services 6 using telehealth or digital health; 7 (b) Promote access to health care services provided via telehealth or digital 8 health; 9 (c) Maintain an online telehealth provider directory for consumer use; and 10 (d) No later than thirty (30) days after June 29, 2021, promulgate administrative 11 regulations in accordance with KRS Chapter 13A to: 12 1. Establish a glossary of telehealth terminology to provide standard 13 definitions for all healthcare providers who deliver health care services 14 via telehealth, all state agencies authorized or required to promulgate 15 administrative regulations relating to telehealth, and all payors; 16 2. Establish minimum requirements for the proper use and security of 17 telehealth, including requirements for confidentiality and data integrity, 18 privacy and security, informed consent, privileging and credentialing, 19 reimbursement, and technology; 20 3. Establish minimum requirements to prevent waste, fraud, and abuse 21 related to telehealth; and 22 4. Maintain the discretion of state agencies authorized or required to 23 promulgate administrative regulations relating to telehealth to establish 24 requirements to authorize, prohibit, or otherwise govern the use of 25 telehealth in accordance with the state agencies' respective jurisdictions. 26 (2) In order to comply with the deadline for the promulgation of administrative 27 UNOFFICIAL COPY 22 RS SB 133/GA Page 27 of 27 SB013310.100 - 1649 - XXXX GA regulations established in subsection (1)(d) of this section, the cabinet may 1 promulgate emergency administrative regulations in accordance with KRS 13A.190. 2 (3) The cabinet, in consultation with the Department for Medicaid Services and any 3 managed care organization with whom the department contracts for the delivery of 4 Medicaid services, shall study the impact of telehealth on the health care delivery 5 system in Kentucky and shall submit an annual report to the Legislative Research 6 Commission no later than December 1 of each year. This report shall include 7 analysis of: 8 (a) The economic impact of telehealth on the Medicaid budget, including any 9 costs or savings as a result of decreased transportation expenditures and office 10 or emergency room visits; 11 (b) The quality of care as a result of telehealth services; 12 (c) Reimbursement and delivery of telehealth among all managed care 13 organizations with whom the department contracts for the delivery of 14 Medicaid services; and 15 (d) Any other issues deemed relevant by the cabinet, including any issues or 16 information deemed relevant by the Division of Telehealth Services pursuant 17 to KRS 194A.105(4). 18
