UNOFFICIAL COPY 23 RS BR 246 Page 1 of 2 XXXX 1/4/2023 2:43 PM Jacketed AN ACT relating to the Legislative Research Commission. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS CHAPTER 7 IS CREATED TO 3 READ AS FOLLOWS: 4 As used in Sections 1 to 3 of this Act: 5 (1) "Federal action" means any: 6 (a) Federal law; 7 (b) Federal agency rule, policy, or standard; 8 (c) Executive order of the President of the United States; 9 (d) Order or decision of a federal court; or 10 (e) Making or enforcing of a treaty; 11 (2) "Global organization action" means an action by the United Nations, World 12 Health Organization, World Economic Forum, World Bank Group, International 13 Monetary Fund, or any other international organization to which the United 14 States is a member; and 15 (3) "Subcommittee" means the Committee on Constitutional Enforcement. 16 SECTION 2. A NEW SECTION OF KRS CHAPTER 7 IS CREATED TO 17 READ AS FOLLOWS: 18 (1) There is hereby created a permanent subcommittee of the Legislative Research 19 Commission to be known as the Committee on Constitutional Enforcement. 20 (2) The subcommittee shall be composed of twelve (12) members appointed as 21 follows: 22 (a) Four (4) members of the Senate appointed by the President of the Senate; 23 (b) Two (2) members of the minority party in the Senate appointed by the 24 Minority Floor Leader of the Senate; 25 (c) Four (4) members of the House of Representatives appointed by the Speaker 26 of the House of Representatives; and 27 UNOFFICIAL COPY 23 RS BR 246 Page 2 of 2 XXXX 1/4/2023 2:43 PM Jacketed (d) Two (2) members of the minority party of the House of Representatives 1 appointed by the Minority Floor Leader of the House of Representatives. 2 (3) The members of the subcommittee shall serve for terms of two (2) years, and the 3 President of the Senate and the Speaker of the House of Representatives shall 4 each designate a member from his or her respective chamber to serve as co-chair. 5 (4) Any vacancy that may occur in the membership of the subcommittee shall be 6 filled by the same appointing authority who made the original appointment. 7 (5) A majority of the membership of the subcommittee shall constitute a quorum, and 8 all actions of the subcommittee shall be by a vote of a majority of its membership. 9 (6) Any professional, clerical, or other employees required by the subcommittee shall 10 be provided in accordance with the provisions of KRS 7.090(4) and (5). 11 SECTION 3. A NEW SECTION OF KRS CHAPTER 7 IS CREATED TO 12 READ AS FOLLOWS: 13 (1) The Committee on Constitutional Enforcement may review and comment upon 14 any federal action or global organization action. 15 (2) If the subcommittee, in its review, determines a federal action or global 16 organization action violates the Kentucky Constitution and the sovereign power 17 of the people of the Commonwealth of Kentucky to regulate the affairs of 18 Kentucky, the subcommittee shall: 19 (a) Refer the federal action or global organization action to the Attorney 20 General; or 21 (b) Make a recommendation at the next regular session of the General 22 Assembly to adopt a resolution urging Congress to take action to resolve the 23 unconstitutional federal action or global organization action. 24
