AN ACT relating to juvenile justice and making an appropriation therefor. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 15A IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) There is hereby created in the Department of Juvenile Justice a trust and agency 5 
account to be known as the juvenile services fund. The fund shall consist of 6 
moneys received from state appropriations, gifts, grants, and federal funds. 7 
(2) The fund shall be administered by the Department of Juvenile Justice. 8 
(3) Amounts deposited in the fund shall be used for: 9 
(a) Delinquency prevention and early intervention services for youth; 10 
(b) Providing individualized, community-based wraparound services for justice-11 
involved youth and their families; 12 
(c) Alternatives to detention; and 13 
(d) Re-entry programs and facilities. 14 
(4) Notwithstanding KRS 45.229, fund amounts not expended at the close of a fiscal 15 
year shall not lapse but shall be carried forward into the next fiscal year. 16 
(5) Any interest earnings of the fund shall become a part of the fund and shall not 17 
lapse. 18 
(6) Moneys deposited in the fund are hereby appropriated for the purposes set forth 19 
in this section and shall not be appropriated or transferred by the General 20 
Assembly for any other purposes. 21 
(7) The General Assembly recognizes that expenditures on delinquency prevention, 22 
wraparound services, reentry, and alternatives to detention reduce juvenile 23 
delinquency, recidivism, and involvement in the adult justice system, and 24 
therefore finds that: 25 
(a) The fund established by this section should receive significant funding, 26 
indicative of the Commonwealth's commitment to the future of our youth; 27  UNOFFICIAL COPY  	23 RS BR 1274

(b) The General Assembly should shift the funding priorities in juvenile justice 2 
to reduce the incarceration of children and increase the use of supportive 3 
programming. 4 
Section 2.   There is hereby appropriated General Fund moneys in the amount of 5 
$9,600,000 in fiscal year 2023-2024 to the fund created in Section 1 of this Act. 6
