AN ACT relating to homicide. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 507.020 is amended to read as follows: 3
(1) A person is guilty of murder when: 4
(a) With intent to cause the death of another person, he causes the death of such 5
person or of a third person; except that in any prosecution a person shall not 6
be guilty under this subsection if he acted under the influence of extreme 7
emotional disturbance for which there was a reasonable explanation or 8
excuse, the reasonableness of which is to be determined from the viewpoint of 9
a person in the defendant's situation under the circumstances as the defendant 10
believed them to be. However, nothing contained in this section shall 11
constitute a defense to a prosecution for or preclude a conviction of 12
manslaughter in the first degree or any other crime;[ or ] 13
(b) He or she unlawfully administers, delivers, distributes, or sells a controlled 14
substance as defined in KRS 218A.010 to another, and any person's death is 15
caused by the injection, inhalation, absorption, or ingestion of any amount 16
of that controlled substance; or 17
(c) Including, but not limited to, the operation of a motor vehicle under 18
circumstances manifesting extreme indifference to human life, he wantonly 19
engages in conduct which creates a grave risk of death to another person and 20
thereby causes the death of another person. 21
(2) Murder is a capital offense. 22
