AN ACT relating to peace officer certification. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS 15.380 TO 15.404 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) A law enforcement agency, or other unit of government listed in KRS 15.380 that 5 
employs a peace officer may petition the department for a special accommodation 6 
certification of a person for a peace officer position. If granted, that person shall 7 
possess certification status as defined in KRS 15.386 upon the completion of the 8 
training requirements set out in this section. Upon employment, and during 9 
training, that person shall possess precertification status as defined in KRS 10 
15.386. 11 
(2) The department shall grant a special accommodation certification to a person if: 12 
(a) The law enforcement agency, or other unit of government listed in KRS 13 
15.380 asserts that it has: 14 
1. Had a peace officer vacancy to fill in the agency or other unit of 15 
government for greater than six (6) months at the time of petition; 16 
2. Actively sought to fill the vacancy using traditional or common means 17 
of seeking candidates to fill the vacancy; 18 
3. Not created the vacancy solely to justify a petition under this section; 19 
and 20 
4. At the time of application, no other peace officer employed under a 21 
special accommodation certification; and 22 
(b) The person: 23 
1. Has successfully completed a law enforcement training academy in 24 
another state that is sanctioned in that state, whether or not the person 25 
at the time of application was actively certified by that state at the time 26

2. Meets the minimum requirements set out in subsections (1) to (15) and 1 
(17) of KRS 15.382; and 2 
3. Was not subject in the state of original certification to any of the 3 
conditions that would warrant the revocation of certification in the 4 
Commonwealth as set out in KRS 15.391(3)(a). 5 
(3) A person granted a special accommodation certification shall only be required to 6 
complete the training set out in KRS 15.386(3)(b)2., and, during the second year 7 
of employment and every year thereafter, the in-service training as required by 8 
KRS 15.404. 9 
(4) A special accommodation certification shall only be granted while the person is 10 
employed with the law enforcement agency or other unit of government listed in 11 
KRS 15.380 making the petition under this section. A person who departs 12 
employment with the law enforcement agency or other unit of government and 13 
loses a special accommodation certification may seek to join another law 14 
enforcement agency or other unit of government, but the agency or other unit of 15 
government hiring that person shall be required to petition for a special 16 
accommodation certification for that person, or the person shall otherwise follow 17 
the procedures for initial certification under the provisions of KRS 15.380 to 18 
15.404 appropriate for his or her status as determined by the department. The 19 
department shall not grant special accommodation certification if the person has 20 
his or her special accommodation certification revoked under KRS 15.391. 21
