AN ACT relating to agricultural land. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 247 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section, "agricultural land" has the same meaning as in 7 U.S.C. 5
sec. 3508. 6
(2) Notwithstanding any other provision of law to the contrary, except as provided in 7
subsection (3) of this section, on or after the effective date of this Act, a 8
nonresident alien, foreign business, agent, trustee, or fiduciary associated with 9
the government of any proscribed country as referenced in 22 C.F.R. sec. 126.1 10
shall be prohibited from: 11
(a) The purchase, lease, or acquisition of any interest in public or private 12
agricultural land located in the Commonwealth of Kentucky; and 13
(b) Participation in programs administered by the Department of Agriculture, 14
Agricultural Development Board, and Kentucky Agricultural Finance 15
Corporation. 16
(3) Nothing in this section shall prohibit an existing foreign-owned business, located 17
within the Commonwealth, from purchasing agricultural land adjacent to the 18
land that the foreign-owned business already owns and operates in order to 19
expand the operation of its business. 20
