AN ACT relating to the Cabinet for Health and Family Services. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 199.900 is amended to read as follows: 3 
(1) The secretary for health and family services in coordination with the Personnel 4 
Cabinet is authorized to establish formal training programs within the Cabinet for 5 
Health and Family Services or within any of the divisions or sections of the cabinet 6 
for the training of necessary personnel for the administration of the programs of the 7 
cabinet. When courses of study, applicable to the program processes of the cabinet, 8 
are not available through cabinet instruction, arrangements may be made for the 9 
training of employees in any public or private school or institution having available 10 
facilities for that purpose, and such training shall be deemed to be a part of the 11 
cabinet training program. Training of employees in public or private schools or 12 
institutions for this purpose shall be deemed a part of research assignments to be 13 
completed during the period of study, and these assignments are to relate directly to 14 
the work assignment of the employee. After consulting with the Personnel Cabinet, 15 
position classifications in the research series shall be established for employees on 16 
such work study assignments, and funds of the cabinet may be used to pay salaries 17 
commensurate with the appropriate classification while the employee is receiving 18 
training. 19 
(2) Any employee who is paid a salary while receiving such training shall be required 20 
to enter into a contract, prior to receiving the training, that he or she will complete a 21 
specified work assignment, and that unless he or she continues in the employ of the 22 
cabinet for at least a period equivalent to the training period, immediately following 23 
the completion of training, the state will hold a claim against him or her for the 24 
amount of salary paid during the training period, and he or she will repay to the 25 
cabinet the sum paid to him or her by the cabinet during the period of his or her 26 
training. 27
