AN ACT relating to judicial supervision of a custody decree or agreement. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 403.330 is amended to read as follows: 3
(1) Except as otherwise agreed by the parties in writing at the time of the custody 4
decree, joint custodians[the custodian] may jointly determine the child's 5
upbringing, including his or her education, health care, and religious training, 6
unless the court after hearing, finds, upon motion by [the ]either 7
custodian[noncustodial parent], that in the absence of a specific limitation of the 8
other custodian's authority, the child's physical health would be endangered or his 9
or her emotional development significantly impaired. 10
(2) If[ both parents or all contestants agree to the order, or if] the court finds that in the 11
absence of an[the] order the child's physical health would be endangered or his or 12
her emotional development significantly impaired, the court shall[may] issue an 13
order in the child's best interests. 14
(3) The court may order an[the local probation, another] appropriate local entity, or if 15
currently involved in the case, the child welfare department to exercise continuing 16
supervision over the case to assure that the custodial or visitation terms of the 17
decree or other court orders regarding the child are carried out. 18
