AN ACT proposing to create a new section of the Constitution of Kentucky relating 1 
to abortion. 2 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3 
SECTION 1.   IT IS PROPOSED THAT A NEW SECTION BE ADDED TO 4 
THE CONSTITUTION OF KENTUCKY TO BE NUMBERED AS 25A AND TO 5 
READ AS FOLLOWS: 6 
Nothing in this Constitution secures or protects a right to abortion or requires the 7 
funding of an abortion. The people retain the right through their elected state 8 
representatives and state senators to enact, amend, or repeal statutes regarding 9 
abortion, including but not limited to circumstances of pregnancy resulting from rape 10 
or incest or when necessary to save the life of the mother. 11 
Section 2. This amendment shall be submitted to the voters of the 12 
Commonwealth for their ratification or rejection at the time and in the manner provided 13 
for under Sections 256 and 257 of the Constitution. The following shall be printed on the 14 
ballot: 15 
"Shall Section 25A of the Constitution of Kentucky be created to read as follows: 16 
Nothing in this Constitution secures or protects a right to abortion or requires the 17 
funding of an abortion. The people retain the right through their elected state 18 
representatives and state senators to enact, amend, or repeal statutes regarding abortion, 19 
including but not limited to circumstances of pregnancy resulting from rape or incest or 20 
when necessary to save the life of the mother."? 21 
Section 3.   Notwithstanding any provision of KRS 118.415 to the contrary, the 22 
Secretary of State shall cause the question relating to the proposed amendment to the 23 
Constitution of Kentucky and the entirety of the proposed amendment to the Constitution 24 
of Kentucky contained in Section 2 of this Act to be published at least one time in a 25 
newspaper of general circulation published in the state, and shall also cause to be 26 
published at the same time and in the same manner the fact that the amendment will be 27  UNOFFICIAL COPY  	23 RS BR 427

submitted to the voters for their acceptance or rejection at the next regular election at 1 
which members of the General Assembly are to be voted for. The publication required by 2 
this section and KRS 118.415 shall be made no later than the first Tuesday in August 3 
preceding the election at which the amendment is to be voted for. 4 
Section 4.   Notwithstanding any provision of KRS 118.415 to the contrary, the 5 
Secretary of State, not later than the second Monday after the second Tuesday in August 6 
preceding the next regular election at which members of the General Assembly are to be 7 
chosen in a year in which there is not an election for President and Vice President of the 8 
United States, or not later than the Thursday after the first Tuesday in September 9 
preceding a regular election in a year in which there is an election for President and Vice 10 
President of the United States, shall certify the entirety of the proposed amendment to the 11 
Constitution of Kentucky and the question relating to the proposed amendment contained 12 
in Section 2 of this Act to the county clerk of each county, and the county clerk shall 13 
have the entirety of the amendment, as so certified, indicated on the ballots provided to 14 
the voters in paper or electronic form as applicable to the voting machines and voting 15 
systems in use in each county or precinct. 16
