AN ACT relating to automated license plate readers. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 189 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "Entity" means any law enforcement agency, unit of local government, or 6
home owner's association who deploys and maintains ALPRs; and 7
(b) "Automated license plate reader" or "ALPR" means a system of one (1) or 8
more mobile or fixed high-speed cameras combined with computer 9
algorithms to convert images of license plates into data that is readable by a 10
computer system. 11
(2) An entity may retain license plate data captured by an ALPR for no more than 12
ninety (90) days, except for when the data: 13
(a) Is being used as evidence in a felony prosecution; or 14
(b) Has become subject to a subpoena duces tecum. 15
(3) An entity shall not sell any recorded images or data captured by an ALPR for any 16
purpose and shall not make the data available except: 17
(a) To a law enforcement officer or agency; or 18
(b) In response to a subpoena duces tecum. 19
