AN ACT relating to nonsubstantive review of certificate of need. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 216B IS CREATED TO 3
READ AS FOLLOWS: 4
Any city, county, charter county, urban-county government, consolidated local 5
government, or unified local government which is located in an area development 6
district which borders two (2) states, where neither state requires a certificate of need 7
for one (1) or more services, may elect to have every service not requiring a certificate 8
of need in the neighboring states granted a nonsubstantive review pursuant to KRS 9
216B.095 and have the certificate of need approved within thirty (30) days of receipt of 10
submission for nonsubstantive review. 11
Section 2. The following KRS section is repealed: 12
