AN ACT relating to public employees. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 61 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) For the purposes of this section:  5 
(a) "Public agency" means every: 6 
1. State office, department, officer, bureau, board, commission, and 7 
authority; 8 
2. Legislative board, commission, committee, and officer; or 9 
3. County and city governing body, council, school district board, special 10 
district board, municipal corporation, or any board, department, 11 
committee, subcommittee, ad hoc committee, council, or agency 12 
thereof; and 13 
(b) "Telework" or "telecommuting" means to use the Internet, e-mail, or 14 
telephone to perform work duties at a location other than an assigned 15 
primary work station. 16 
(2) (a) Except when the Governor declares an emergency, a public agency shall 17 
not permit any of its employees to telework. 18 
(b) When the Governor declares an emergency, and he or she decides that 19 
employees should be allowed to telework during the emergency, he or she 20 
shall specifically state that teleworking is allowed and which employees 21 
shall be permitted to telework. 22 
(3) The Administrative Office of the Courts shall not permit any of its employees to 23 
telework. 24 
(4) This section shall not apply to: 25 
(a) Justices of the Supreme Court; 26

(c) Department of Kentucky State Police; 1 
(d) Any employee of state government involved in the following professions: 2 
1. Motor vehicle enforcement; 3 
2. Plumbing inspector; 4 
3. Health inspector; and 5 
4. Building inspector; or 6 
(e) Any employee of state government whose job responsibilities require them 7 
to be away from their primary work station at least fifty percent (50%) of the 8 
time. 9
