AN ACT relating to employer liability. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 336 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) Notwithstanding KRS 342.690, 342.700, or any other provision of law to the 5
contrary, any private employer that institutes a mandatory workplace vaccination 6
policy as a condition of employment shall not be entitled to statutory liability 7
protections, including the exclusive remedy of workers' compensation established 8
in KRS Chapter 342. 9
(2) Any employee who sustains damages by any act in violation of this section shall 10
have a civil cause of action in Circuit Court to enjoin further violations and to 11
recover actual and punitive damages, court costs, and reasonable attorney's fees. 12
