UNOFFICIAL COPY 23 RS BR 1705 Page 1 of 2 XXXX 2/20/2023 5:20 PM Jacketed AN ACT relating to disaster response. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘Section 1. KRS 39A.030 is amended to read as follows: 3 The General Assembly recognizes that the rationale and purpose of the comprehensive 4 emergency management program of the Commonwealth has evolved from a program for 5 response to threats to national security, enemy attack, and other national defense needs, to 6 a program for response to all hazards, but primarily, domestic hazards and threats 7 including natural, man-made, technological, industrial, or environmental emergencies or 8 disasters, for which civil government is primarily responsible. Because of major changes 9 in the rationale and necessity for emergency management capabilities, as well as the 10 urgent requirement for multiagency participation and inter-agency coordination to ensure 11 timely, effective, and appropriate disaster and emergency response in the 12 Commonwealth, and to otherwise modernize and improve the administration, 13 effectiveness, and relevance of the comprehensive emergency management program for 14 the contemporary needs of the citizens of the Commonwealth, the General Assembly 15 declares: 16 (1) A Division of Emergency Management is[ hereby] created as the emergency 17 management agency of state government which shall develop the comprehensive 18 emergency management program of the Commonwealth on behalf of the Governor, 19 and in consultation with the cabinet secretaries of state government, other 20 appropriate state agency heads, local elected chief executives, local emergency 21 management directors, and local emergency planning committees, for the purpose 22 of developing and enhancing comprehensive emergency management program 23 policies, plans, or procedures to provide for a coordinated responsive, and 24 integrated emergency management system in the Commonwealth; 25 (2) The division may accept on behalf of the Commonwealth any grant, contribution, or 26 fund, federal or otherwise, made to assist in meeting the costs of carrying out the 27 UNOFFICIAL COPY 23 RS BR 1705 Page 2 of 2 XXXX 2/20/2023 5:20 PM Jacketed provisions and purposes of KRS Chapters 39A to 39F, and fully comply with all 1 funding requirements imposed by the receipt and use of the grant, contribution, or 2 fund; and 3 (3) The term "Division of Emergency Management" shall constitute and designate the 4 official name of the emergency management agency of state government created 5 pursuant to subsection (1) of this section and "Division of Emergency 6 Management," in the exact order or form as specified in this subsection, shall not be 7 utilized by or assigned to any other agency of state or local government, or other 8 state or local entity, or any political subdivision of the Commonwealth to constitute 9 or designate the official name of any such agency, entity, or political subdivision. 10
