AN ACT relating to deed restrictions attached to the transfer of property by a health 1
facility. 2
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 381 IS CREATED TO 4
READ AS FOLLOWS: 5
A health facility as defined in KRS 216B.015 holding a certificate of need shall not 6
offer for sale any property that requires, as a condition precedent to the sale, a deed 7
restriction or contractual obligation prohibiting the use of the premises or property as a 8
health facility or for health services as defined in KRS 216B.015 from and after the 9
date of the conveyance. 10
