AN ACT relating to motor vehicles. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 186A IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "ASE certified mechanic" means a mechanic certified by the National 6
Institute for Automotive Service Excellence; 7
(b) "Inoperable" means any vehicle where the engine, transmission, wheels, or 8
other parts have been removed, or on which the engine, wheels, 9
transmission, or other parts have been altered or damaged so that the 10
vehicle is incapable of being driven under its own power, but shall not 11
include any vehicle rendered temporarily incapable of being driven under 12
its own power in order to perform ordinary service or repair operations; and 13
(c) "Unsafe to drive" means any vehicle which has not been wrecked, 14
destroyed, or damaged, but is not in a condition to safely operate upon the 15
highways of the Commonwealth due to mechanical defect or other unsafe 16
conditions. This definition shall not apply to a vehicle that is unsafe to drive 17
when presented to a mechanic for repair or a vehicle which is in the process 18
of being repaired. 19
(2) If an ASE certified mechanic deems a motor vehicle unsafe to drive or 20
inoperable, he or she shall provide notification to the motor vehicle owner. 21
(3) If the owner of a motor vehicle is given notice that his or her motor vehicle is 22
unsafe to drive or inoperable, the owner shall not sell the vehicle without 23
notifying any prospective buyer of the findings in subsection (2) of this section. 24
