UNOFFICIAL COPY 23 RS BR 1222 Page 1 of 2 XXXX 2/20/2023 9:36 AM Jacketed A CONCURRENT RESOLUTION urging Congress to repeal the REAL ID Act of 1 2005. 2 WHEREAS, the people of the Commonwealth recognize the Constitution of the 3 United States as our charter of liberty and that the Bill of Rights enshrines the 4 fundamental and inalienable rights of Americans, including the right to privacy; and 5 WHEREAS, it is the duty, and the privilege, of the elected representatives of the 6 people of the Commonwealth to ensure that their interest in privacy is zealously 7 safeguarded; and 8 WHEREAS, the Commonwealth has continually shown its hesitancy to participate 9 in or comply with implementation of the federal REAL ID Act of 2005, as one of the last 10 states to start issuing REAL ID cards; and 11 WHEREAS, the REAL ID Act of 2005 mandates an unfunded national 12 identification card on the people of the Commonwealth and was passed without a public 13 hearing, careful deliberation by the federal government, or any regard for the sanctity of 14 states' rights; and 15 WHEREAS, residents of the Commonwealth have spent $7,090,232 on 16 identification cards that are compliant with the REAL ID Act of 2005; and 17 WHEREAS, fewer than 18.2 percent of citizens of the Commonwealth have chosen 18 a state identification card that is compliant with the REAL ID Act of 2005; and 19 WHEREAS, the REAL ID Act of 2005 national database invites the theft of 20 identity and invasion of privacy of all those who hold conforming identification cards; 21 and 22 WHEREAS, the REAL ID Act of 2005 national database would facilitate the 23 tracking of data on individuals by federal and state governments; and 24 WHEREAS, the REAL ID Act of 2005 is an affront to the concept of federalism 25 enshrined in the Tenth Amendment to the United States Constitution; and 26 WHEREAS, implementation of the REAL ID Act of 2005 has proved so unwieldy 27 UNOFFICIAL COPY 23 RS BR 1222 Page 2 of 2 XXXX 2/20/2023 9:36 AM Jacketed and difficult that the federal government has been obligated, multiple times, to delay its 1 full implementation of the law until May 7, 2025, nearly 20 years after its passage; 2 NOW, THEREFORE, 3 Be it resolved by the Senate of the General Assembly of the Commonwealth of 4 Kentucky, the House of Representatives concurring therein: 5 Section 1. The Kentucky General Assembly respectfully urges and requests that 6 the Congress of the United States repeal the REAL ID Act of 2005. 7 Section 2. The Clerk of the Senate shall send copies of this Concurrent 8 Resolution to the Clerk of the House of Representatives of the United States, the Clerk of 9 the Senate of the United States, and each member of the Kentucky Congressional 10 delegation. 11
