UNOFFICIAL COPY 23 RS BR 1480 Page 1 of 2 XXXX 2/22/2023 11:22 AM Jacketed A RESOLUTION urging the Department of Alcoholic Beverage Control to 1 encourage its retail alcohol licensees to provide ongoing training to their premises 2 employees regarding best practices in handling intoxicated patrons. 3 WHEREAS, patrons are entitled to their personal physical safety while on the 4 premises of these businesses, including interactions with bouncers employed by the 5 business; and 6 WHEREAS, it is in the interest and safety of all patrons that individuals employed 7 by these businesses maintain order and civility on the premises and receive training on 8 topics intrinsic to safe conflict de-escalation tactics; and 9 WHEREAS, it is crucial that these employees use effective interpersonal 10 communication skills when interacting with patrons and engage in safe conflict de-11 escalation when necessary; and 12 WHEREAS, too many lives across our nation have been needlessly cut short by bar 13 and nightclub employees using more force than was necessary to quell a disturbance; and 14 WHEREAS, there are numerous online and in-person options for bar and nightclub 15 security personnel to gain training and insight related to safely handling intoxicated 16 persons; and 17 WHEREAS, the states of California, Georgia, New York, and Tennessee have 18 passed specific laws regulating the occupation of bouncer, the states of Arizona and 19 North Carolina are working on pending legislation to do so, and many cities have seen 20 the wisdom in standardizing qualifications for employees in these positions; and 21 WHEREAS, no training requirements currently exist in Kentucky for this 22 occupational field; 23 NOW, THEREFORE, 24 Be it resolved by the Senate of the General Assembly of the Commonwealth of 25 Kentucky: 26 Section 1. The members of the Senate hereby urge the Department of Alcoholic 3 Beverage Control to strongly encourage its retail licensees to provide ongoing training for 4 bouncers and bartenders on best current practices for dealing with intoxicated patrons; 5 Section 3. The Clerk of the Senate is directed to transmit a copy of this 6 Resolution to the Department for Alcoholic Beverage Control. 7
