AN ACT relating to the New State Capitol campus. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 11.027 is amended to read as follows: 3 
(1) The commission shall meet at least every six (6) months and when called into 4 
session by the chairman at the request of the Governor, of any two (2) or more 5 
members of the commission, or on his own motion. 6 
(2) The commission shall examine the Executive Mansion, the Old Governor's 7 
Mansion, the Vest Lindsey House, and the New State Capitol at least once each 8 
year, and the commission shall have authority over any construction, repairs, 9 
structural restoration, or renovation of these properties. The commission shall 10 
supervise the maintenance of a current inventory of all furnishings in the properties 11 
and the inventory shall be maintained by the Division of Historic Properties in the 12 
Department for Facilities and Support Services in the Finance and Administration 13 
Cabinet. The Division of Historic Properties shall maintain inventory records 14 
relating to all such property of the state and no such property shall be disposed of 15 
except upon recommendation of the director of the Division of Historic Properties 16 
with advice of the Historic Properties Advisory Commission. The proceeds realized 17 
from the sale of any items shall be deposited in the historic properties endowment 18 
fund, established by KRS 11.026, except that the proceeds realized from the sale of 19 
any items derived from, or related to, the Vest Lindsey House shall be deposited in 20 
the separate and distinct Ida Lee Willis-Vest Lindsey House endowment trust fund, 21 
established by KRS 11.026(8). 22 
(3) (a) The commission shall recommend, from time to time, on the needs for 23 
furnishings, maintenance, repair, or renovation of the Executive Mansion, the 24 
Old Governor's Mansion, the Vest Lindsey House, and the New State Capitol; 25 
and the Department for Facilities and Support Services in the Finance and 26 
Administration Cabinet shall, from funds available, take the action 27  UNOFFICIAL COPY  	24 RS BR 303

recommended.  1 
(b) The commission shall have final authority over articles placed in the 2 
properties and moneys spent on the Executive Mansion, the Vest Lindsey 3 
House, and the Old Governor's Mansion[these buildings], except that the 4 
Kentucky Heritage Council shall have final authority over any moneys spent 5 
from the Ida Lee Willis-Vest Lindsey House endowment trust fund.  6 
(c) The commission shall develop criteria for this display of objects on and for 7 
the use of the public areas of the basement and first and second floors of the 8 
New State Capitol and shall be consulted by the director of the Division of 9 
Historic Properties before objects are accepted for or removed from 10 
permanent display in the Capitol. 11 
(d) 1. No statue, monument, or object of art shall be installed or removed 12 
from permanent display in the New State Capitol or on New State 13 
Capitol campus grounds without the approval of the General Assembly 14 
by means of an act or joint resolution explicitly identifying and 15 
authorizing the installation or removal of the statute, monument, or 16 
object. 17 
2. The commission may submit a detailed proposal to the Legislative 18 
Research Commission for referral to the appropriate interim joint or 19 
standing committees, but shall have no authority to add or remove 20 
from permanent display any statute, monument, or object of art from 21 
the New State Capitol or New State Capitol campus grounds without 22 
prior legislative approval. 23 
3. If the Historic Properties Advisory Commission violates this 24 
paragraph, each member shall be jointly and severally liable for any 25 
and all costs to remove or reinstall the applicable statue, monument, 26 
or object of art in the New State Capitol or on Capitol Campus 27  UNOFFICIAL COPY  	24 RS BR 303

grounds. 1 
4. As used in this paragraph, "permanent" means of a long-term or 2 
indefinite period, with the presumed intention that the displayed 3 
statue, monument, or object of art will not be removed for the 4 
foreseeable future. 5 
(4) The commission shall provide coordination and make arrangements for an orderly 6 
transition between outgoing and incoming chief executives. 7
