AN ACT relating to the Kentucky Indigent Persons' Burial Program. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 213 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) There is hereby established the Kentucky Indigent Persons' Burial Program and 5
there is hereby created in the State Treasury a fund entitled the Kentucky 6
indigent person burial trust fund to provide funds to defray the costs of funeral 7
expenses for indigent persons in the Commonwealth of Kentucky. The fund may 8
receive state appropriations, gifts, grants, federal funds, and any other funds both 9
public and private. Moneys deposited in the fund shall be disbursed by the State 10
Treasurer upon the warrant of the secretary or his or her representative. Any 11
unallocated or unencumbered balances in the fund shall be invested as provided 12
in KRS 42.500(9), and any income earned from the investments along with the 13
unallotted or unencumbered balances in the fund shall not lapse and shall be 14
deemed a trust and agency account and made available solely for the purposes 15
and benefits of the Kentucky Indigent Persons' Burial Program. 16
(2) The cabinet shall use the fund to defray up to six hundred dollars ($600) of 17
funeral expenses by allocating the funds to pay for the burial or cremation of an 18
indigent person in the Commonwealth of Kentucky to the: 19
(a) Family of the indigent person if the family demonstrates to the cabinet that 20
it does not have the financial means to pay the full cost of burial or 21
cremation; or 22
(b) Licensed funeral home or crematory that provides burial or cremation 23
services at the request of a coroner who has possession of a dead body 24
pursuant to KRS Chapter 72. 25
(3) The cabinet shall oversee the Kentucky Indigent Persons' Burial Program and 26

(4) The cabinet shall promulgate administrative regulations in accordance with KRS 1
Chapter 13A to implement this section within ninety (90) days of the effective date 2
of this Act. 3
