AN ACT proposing an amendment to Section 32 of the Constitution of Kentucky 1 
relating to qualifications of members of the General Assembly. 2 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3 
Section 1. Are you in favor of amending Section 32 of the Constitution of 4 
Kentucky to lower the minimum age requirement to be a member of the Kentucky House 5 
of Representatives from 24 years of age to 21 years of age, to lower the minimum age 6 
requirement to be a member of the Kentucky Senate from 30 years of age to 24 years of 7 
age, and to lower the residency requirement for a member of the Kentucky Senate from 8 
six years to three years, as stated below?  9 
Section 2.   It is proposed that Section 32 of the Constitution of Kentucky be 10 
amended to read as follows: 11 
 No person shall be a Representative who, at the time of his or her election, is not a 12 
citizen of Kentucky, has not attained the age of twenty-one[twenty-four] years, and who 13 
has not resided in this State two years next preceding his or her election, and the last year 14 
thereof in the county, town or city for which he or she may be chosen. No person shall be 15 
a Senator who, at the time of his or her election, is not a citizen of Kentucky, has not 16 
attained the age of twenty-four[thirty] years, and has not resided in this State three[six] 17 
years next preceding his or her election, and the last year thereof in the district for which 18 
he or she may be chosen. 19 
Section 3. This amendment shall be submitted to the voters of the 20 
Commonwealth for their ratification or rejection at the time and in the manner provided 21 
for under Sections 256 and 257 of the Constitution, KRS 118.415, and Sections 4 and 5 22 
of this Act. 23 
Section 4.   Notwithstanding any provision of KRS 118.415 to the contrary, the 24 
Secretary of State shall cause the entirety of the question in Section 1 of this Act and the 25 
entirety of the proposed amendment to the Constitution of Kentucky contained in Section 26 
2 of this Act to be published at least one time in a newspaper of general circulation 27  UNOFFICIAL COPY  	24 RS BR 839

published in this state, and shall also cause to be published at the same time and in the 1 
same manner the fact that the amendment will be submitted to the voters for their 2 
acceptance or rejection at the next regular election at which members of the General 3 
Assembly are to be voted for. The publication required by this section and KRS 118.415 4 
shall be made no later than the first Tuesday in August preceding the election at which 5 
the amendment is to be voted on. 6 
Section 5.   Notwithstanding any provision of KRS 118.415 to the contrary, the 7 
Secretary of State, not later than the second Monday after the second Tuesday in August 8 
preceding the next regular election at which members of the General Assembly are to be 9 
chosen in a year in which there is not an election for President and Vice President of the 10 
United States, or not later than the Thursday after the first Tuesday in September 11 
preceding a regular election in a year in which there is an election for President and Vice 12 
President of the United States, shall certify the entirety of the question in Section 1 of this 13 
Act and the entirety of the proposed amendment to the Constitution of Kentucky 14 
contained in Section 2 of this Act to the county clerk of each county, and the county clerk 15 
shall have the entirety of the question and the amendment, as so certified, indicated on 16 
the ballots provided to the voters in paper or electronic form as applicable to the voting 17 
machines in use in each county or precinct. 18
