A NEW SECTION OF KRS CHAPTER 162 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section, "single-user toilet facilities" means bathrooms that 5 contain, at the most, one (1) toilet, one (1) urinal, and a lock that is controlled by 6 the user. 7 (2) The chief state school officer shall not approve the plans and specifications for a 8 new public school building contemplated by a board of education or for any 9 addition or alteration of old buildings as required by KRS 162.060 unless the 10 plans and specifications provide single-user toilet facilities available for use by 11 persons of any gender in accordance with Kentucky Board of Education 12 administrative regulations. 13 (3) The Kentucky Board of Education shall promulgate administrative regulations 14 regarding the required number of single-user toilet facilities and distribution of 15 those facilities within each public school building. The regulations shall: 16 (a) Be based upon relevant and appropriate factors, including but not limited to 17 student enrollment, employee population, square footage of the building, 18 floor plan of the building, and age of the building; 19 (b) Include a requirement of at least one (1) single-user toilet facility within 20 each public school building used by students during instructional time; and 21 (c) Include a requirement that the single-user toilet facilities are available for 22 use by students, employees, contractors, visitors, and other guests within the 23 building. 24
