AN ACT relating to federal law. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 156 IS CREATED TO 3
READ AS FOLLOWS: 4
Notwithstanding any statute to the contrary, the Kentucky Department of Education 5
shall not comply with a provision of any administrative regulation promulgated or 6
guidance issued by the United States Department of Education under the authority of 7
20 U.S.C. sec. 1681 et seq. that equates gender identity with biological sex within the 8
provisions of that chapter. This requirement shall also be applicable to all school 9
districts, public schools, and public charter schools, and any other elementary or 10
secondary educational institution operated by the Commonwealth. The withholding of 11
any federal funds shall not negate this section. 12
SECTION 2. A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO 13
READ AS FOLLOWS: 14
Notwithstanding any statute to the contrary, including KRS 164.370, the Council on 15
Postsecondary Education shall not comply with a provision of any administrative 16
regulation promulgated or guidance issued by the United States Department of 17
Education under the authority of 20 U.S.C. sec. 1681 et seq. that equates gender 18
identity with biological sex within the provisions of that chapter. This requirement 19
shall also be applicable to all public postsecondary institutions and any affiliated 20
corporation or agent acting on behalf of a public postsecondary institution. The 21
withholding of any federal funds shall not negate this section. 22
