AN ACT relating to aviation and making an appropriation therefor. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 183.525 is amended to read as follows: 3
(1) The "Kentucky Aviation Economic Development Fund" is established in the State 4
Treasury. [Beginning on July 1, 2000, ]All receipts collected under KRS Chapter 5
139 from the sales or use tax on aviation jet fuel shall be deposited in this fund. 6
(2) The fund may also receive state appropriations, gifts, grants, and federal funds and 7
shall include earnings from investments of moneys from the fund. 8
(3) Any fund balance at the close of the fiscal year shall not lapse but shall be carried 9
forward to the next fiscal year. 10
(4) The Transportation Cabinet shall use all moneys deposited in the fund or accruing 11
to the fund for: 12
(a) The development, rehabilitation, and maintenance of publicly owned or 13
operated aviation facilities; 14
(b) Programs supporting aviation education and workforce development; and 15
(c) [for ]Other aviation programs within the Commonwealth that will benefit 16
publicly owned or operated aviation facilities. 17
(5) The cabinet shall be prohibited from expending moneys deposited in the fund for 18
administrative costs incurred by the cabinet or for any purpose other than the uses 19
described in subsection (4) of this section[development, rehabilitation, and 20
maintenance of publicly owned or operated aviation facilities and other aviation 21
programs benefiting publicly owned or operated aviation facilities]. 22
