AN ACT relating to the smoking cessation program, making an appropriation 1 
therefor, and declaring an emergency. 2 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3 
Section 1.   Moneys received in fiscal year 2023-2024, fiscal year 2024-2025, 4 
and fiscal year 2025-2026 as a result of the Final Consent Judgment in Commonwealth of 5 
Kentucky, ex. rel. Daniel Cameron, Attorney General v. Juul Labs, Inc., 22-CI-00942, 6 
shall be used to support the Smoking Cessation Program within the Public Health budget 7 
unit of the Cabinet for Health and Family Services. 8 
Section 2.   There hereby is appropriated General Fund moneys in the amount of 9 
$1,026,000 for fiscal year 2023-2024, $1,024,000 in fiscal year 2024-2025, and 10 
$1,539,000 in fiscal year 2025-2026 to the Department for Public Health to support the 11 
Smoking Cessation Program. 12 
Section 3.   Notwithstanding Section 2 of this Act, if the moneys deposited into 13 
the General Fund as a result of the Final Consent Judgment during any fiscal year are 14 
greater than or less than the amounts appropriated under Section 2 of this Act, the 15 
appropriation for that fiscal year shall equal the amount deposited into the General Fund 16 
as a result of the Final Consent Judgment. 17 
Section 4. Whereas the health and well-being of Kentuckians continues to 18 
decline as a result of smoking nicotine products, an emergency is declared to exist, and 19 
this Act takes effect upon its passage and approval by the Governor or upon its otherwise 20 
becoming a law. 21
