UNOFFICIAL COPY 24 RS BR 2398 Page 1 of 3 XXXX 2/26/2024 2:59 PM Jacketed AN ACT relating to terrorist activity. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS CHAPTER 158 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section: 5 (a) "Designated terrorist organization" means an organization that has been 6 designated as a terrorist organization under the Immigration and 7 Nationality Act, 8 U.S.C. sec. 1189; 8 (b) "Material support or resources" has the same meaning as in 18 U.S.C. sec. 9 2339A; and 10 (c) "School" means a public school or public charter school located in 11 Kentucky. 12 (2) A school shall act to protect its Jewish students from credible threats of violence 13 or violence motivated by antisemitism. 14 (3) (a) A school or student organization affiliated with a school shall not provide 15 material support or resources to a designated terrorist organization. 16 (b) If a school determines that an affiliated student organization has provided 17 material support or resources to a designated terrorist organization, the 18 school shall submit a report to the proper authorities and the school shall 19 defund and disband the student organization. 20 SECTION 2. A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO 21 READ AS FOLLOWS: 22 (1) As used in this section: 23 (a) "Designated terrorist organization" means an organization that has been 24 designated as a terrorist organization under the Immigration and 25 Nationality Act, 8 U.S.C. sec. 1189; 26 (b) "Institution" means a public postsecondary institution and includes all 27 UNOFFICIAL COPY 24 RS BR 2398 Page 2 of 3 XXXX 2/26/2024 2:59 PM Jacketed programs, departments, divisions, offices, centers, colleges, student 1 governments, affiliated organizations, and any individual acting in an 2 official capacity on behalf of a public postsecondary institution; 3 (c) "Material support or resources" has the same meaning as in 18 U.S.C. sec. 4 2339A; and 5 (d) "Public funds" has the same meaning as in KRS 446.010. 6 (2) (a) An institution shall act to protect its Jewish students from credible threats of 7 violence or violence motivated by antisemitism. 8 (b) Notwithstanding any statute to the contrary, the General Assembly shall not 9 appropriate any public funds to an institution that the General Assembly 10 determines has not acted to protect its Jewish students from credible threats 11 of violence or violence motivated by antisemitism. 12 (3) An institution or student or faculty organization of the institution shall not 13 provide material support or resources to a designated terrorist organization. If an 14 institution determines that a student or faculty organization has provided 15 material support or resources to a designated terrorist organization, the 16 institution shall: 17 (a) Submit a report to the proper authorities; 18 (b) Defund the student or faculty organization; and 19 (c) Terminate the student or faculty organization's registration or affiliation 20 with the institution. 21 SECTION 3. A NEW SECTION OF KRS CHAPTER 61 IS CREATED TO 22 READ AS FOLLOWS: 23 In addition to considerations of unlawful discrimination on the basis of race, religion, 24 or natural origin, if there is an allegation that an unlawful discriminatory conduct or 25 practice is targeting an individual or group based on any actual or perceived 26 connection to any aspect of Jewish identity, a law enforcement officer shall also 27 UNOFFICIAL COPY 24 RS BR 2398 Page 3 of 3 XXXX 2/26/2024 2:59 PM Jacketed consider whether the alleged unlawful discriminatory conduct or practice was 1 motivated by antisemitic intent. 2 SECTION 4. A NEW SECTION OF KRS CHAPTER 61 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section, "alien" has the same meaning as in 8 U.S.C. sec. 1101. 5 (2) Any alien who endorses or espouses terrorist activity in violation of the 6 Immigration and Nationality Act, including aliens on student or other temporary 7 visas, shall be subject to immediate arrest by a law enforcement officer and 8 transferred to the federal authorities for deportation proceedings. 9
