A CONCURRENT RESOLUTION establishing the Support Education Excellence 1 
in Kentucky (SEEK) Task Force. 2 
WHEREAS, the SEEK formula was established to ensure substantially equal 3 
common school educational opportunities across the state; and 4 
WHEREAS, more than $3 billion was allocated and paid out through the SEEK 5 
program each year of the 2022 biennial State/Executive Branch Budget; and 6 
WHEREAS, the changing economy and demographics of the state necessitates a 7 
thorough review of all aspects of the SEEK formula; 8 
NOW, THEREFORE, 9 
Be it resolved by the House of Representatives of the General Assembly of the 10 
Commonwealth of Kentucky, the Senate concurring therein: 11 
Section 1.   (1) The Legislative Research Commission is hereby directed to 12 
establish the Support Education Excellence in Kentucky (SEEK) Task Force to: 13 
(a) Determine if the SEEK base per pupil amount provides adequate funding; 14 
(b) Determine if the current required local effort of 30 cents for each $100 of 15 
taxable property assessment is appropriate; 16 
(c) Determine whether the SEEK base should continue to be calculated on 17 
student average daily attendance or by some other calculation, such as: 18 
1. Average daily membership; 19 
2. A single day count of attendance; 20 
3. The use of multiple day counts to determine attendance, such as fall and 21 
spring; and 22 
4. The use of enrollment or attendance counts over multiple periods or days; 23 
(d) Determine if the SEEK add-on weights for students with unique needs is 24 
sufficient. In addition, determine if there are other add-ons that need to be established, 25 
such as foster care students, small schools or districts, or rural districts; 26 
(e) Review Tier 1 to determine if the allowed 15 percent increase on the SEEK 27  UNOFFICIAL COPY  	24 RS BR 1832

base and add-ons needs to be adjusted, and review the state equalization of 150 percent of 1 
the statewide average per-pupil property assessment to determine if change is needed; 2 
(f) Review Tier 2 funding to determine if districts are receiving more than 30 3 
percent of the SEEK base, add-ons, and Tier 1 funding and determine the effect of 4 
equalizing Tier 2 funding; 5 
(g) Review state funds provided to districts outside of the SEEK formula to 6 
determine if those funds should be included in the SEEK formula, including but not 7 
limited to extended school services, preschool grants, safe schools, gifted and talented, 8 
local and state operated vocational centers, Kentucky Education Technology System 9 
(KETS), and the School Facilities Construction Commission (SFCC); and 10 
(h) Compile and submit any recommendations for changes the task force may 11 
adopt relating to the Support Education Excellence in Kentucky formula to the 12 
Legislative Research Commission by December 1, 2024. 13 
(2) The Support Education Excellence in Kentucky (SEEK) Task Force shall be 14 
composed of the following members, with final membership of the task force being 15 
subject to the consideration and approval of the Legislative Research Commission: 16 
(a) Three members of the House of Representatives to be appointed by the 17 
Speaker of the House, one of whom shall be designated to serve as co-chair; 18 
(b) Three members of the Senate to be appointed by the President of the Senate, 19 
one of whom shall be designated to serve as co-chair; 20 
(c) One member of the House of Representatives to be appointed by the Minority 21 
Floor Leader of the House; 22 
(d) One member of the Senate to be appointed by the Minority Floor Leader of 23 
the Senate; 24 
(e) The commissioner of the Kentucky Department of Education or designee; and 25 
(f) The co-chairs may appoint up to six non-legislative ex officio non-voting 26 
members with expertise necessary for the operation of the task force, subject to joint 27  UNOFFICIAL COPY  	24 RS BR 1832

approval by the Senate President and Speaker of the House; 1 
Section 2. The co-chairs may recommend to the Legislative Research 2 
Commission the retaining of one or more consultants for assistance with research and 3 
completion of a briefing report.  The retaining of a consultant shall require the approval 4 
of the Legislative Research Commission following a Request for Proposal process. 5 
Section 3.   Provisions of this Resolution to the contrary notwithstanding, the 6 
Legislative Research Commission shall have the authority to alternatively assign the 7 
issues identified herein to an interim joint committee or subcommittee thereof, and to 8 
designate a study completion date. 9
