A RESOLUTION urging President Joe Biden to repel the invasion at the United 1
States' southern border. 2
WHEREAS, the United States is a union of sovereign states, Hinderlider v. La 3
Plata River & Cherry Creek Ditch Co, 304 U.S. 92 (1938); and 4
WHEREAS, "before the adoption of the constitution of the United States," each 5
state had the authority to "prevent [itself] from being burdened by an influx of persons" 6
Mayor of New York v. Miln, 36 U.S. 102, 132-133 (1837); and 7
WHEREAS, the United States Constitution does not strip the states of the authority 8
to prevent itself from being burdened by an influx of people; and 9
WHEREAS, the Biden Administration refuses to enforce federal immigration law; 10
and 11
WHEREAS, Article 4, Section 4 of the United States Constitution guarantees that 12
the federal government "shall protect each [State] against invasion"; and 13
WHEREAS, the Texas National Guard is performing the duty that President Joe 14
Biden has intentionally deserted; and 15
WHEREAS, Article 1, Section 10, Clause 3 of the United States Constitution 16
allows states to repel invasions; and 17
WHEREAS, nothing Texas has done conflicts with any federal immigration law; 18
and 19
WHEREAS, illegal immigration affects all Americans, including the people of the 20
Commonwealth of Kentucky; 21
NOW, THEREFORE, 22
Be it resolved by the House of Representatives of the General Assembly of the 23
Commonwealth of Kentucky: 24
Section 1. The Kentucky General Assembly commits its unequivocal support to 25
the people of Texas, the Texas National Guard, the Texas Department of Public Safety, 26

southern border. 1
Section 2. The Kentucky General Assembly calls upon President Joe Biden to 2
bring home American National Guardsmen and women from undeclared wars so that 3
they may be committed to defending the United States' southern border. 4
Section 3. The Kentucky General Assembly calls upon President Joe Biden to 5
fulfill his Article 4 duty to repel the invasion the United States faces at its southern 6
border. 7
Section 4. The Clerk of the House of Representatives is directed to transmit a 8
copy of this Resolution to President of the United States, Joe Biden. 9
