AN ACT relating to certificates of need. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 216B IS CREATED TO 3
READ AS FOLLOWS: 4
(1) Notwithstanding any law to the contrary, any health services, equipment, 5
programs, centers, facilities, beds, agencies, technologies, or hospitals listed in 6
the state health plan as defined in KRS 216B.015, except nursing facility beds or 7
long-term care beds, shall be granted a nonsubstantive review of a certificate of 8
need application by the Cabinet for Health and Family Services unless otherwise 9
exempt from a certificate of need requirement. 10
(2) The Cabinet for Health and Family Services shall amend the state health plan 11
and any necessary administrative regulations by December 31, 2024, to conform 12
with subsection (1) of this section. 13
