UNOFFICIAL COPY 24 RS BR 1885 Page 1 of 2 XXXX 1/30/2024 3:58 PM Jacketed AN ACT relating to medical imaging. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 Section 1. KRS 311B.050 is amended to read as follows: 3 The board shall: 4 (1) Administer and enforce this chapter. The board alone shall have this authority; 5 (2) Promulgate administrative regulations to administer and enforce this chapter; 6 (3) Issue and renew the licenses of duly qualified applicants, following procedures 7 established by the board through the promulgation of administrative regulations; 8 (4) Create and enforce policies and procedures that ensure a patient's right to record 9 any procedure performed by an individual who is licensed by the board; 10 (5) Determine and enforce continuing education requirements and establish guidelines 11 for approval of continuing education; 12 (6)[(5)] Approve accredited educational programs of imaging or radiation therapy and 13 monitor compliance with the educational standards established by the individual 14 disciplines, as recognized by the board; 15 (7)[(6)] Designate funds for scholarships, program development, or continued 16 education; 17 (8)[(7)] Investigate suspected or alleged violations of this chapter, conduct hearings 18 and record minutes, resolve the allegations, and, if appropriate, impose sanctions or 19 penalties; and 20 (9)[(8)] Submit an annual report to the Governor and the Legislative Research 21 Commission that provides information concerning the board's work regarding 22 licensure of professionals under this chapter and that lists all hearings conducted by 23 the board and the decisions rendered. 24 Section 2. KRS 311B.110 is amended to read as follows: 25 (1) An applicant for licensure as an advanced imaging professional, medical imaging 26 technologist, radiographer, radiation therapist, nuclear medicine technologist, or 27 UNOFFICIAL COPY 24 RS BR 1885 Page 2 of 2 XXXX 1/30/2024 3:58 PM Jacketed limited X-ray machine operator shall file an application in a format prescribed by 1 the board. 2 (2) Licensees shall display or have available an original current license at any place of 3 employment. It shall be unlawful for any person to display a license in an effort to 4 misrepresent his or her qualifications. An individual who no longer meets the 5 licensure requirements shall not display a license nor purport to have the 6 qualifications. 7 (3) Licensees shall allow a patient to record any procedures the licensee performs 8 upon the patient. 9 (4) Licensees shall meet continuing education requirements. 10 (5)[(4)] Licenses shall be renewed or reinstated in accordance with the requirements 11 set out by the board. 12 (6)[(5)] Licenses may be placed on inactive status for those who are not actively 13 employed, as defined by this chapter. To reactivate an inactive license, the applicant 14 shall submit a new application and required fee and meet all requirements for 15 reactivation. 16 (7)[(6)] The requirements of this section shall be established by the board through the 17 promulgation of administrative regulations. 18
