AN ACT relating to Medicaid home and community-based waiver residential 1
services. 2
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 205 IS CREATED TO 4
READ AS FOLLOWS: 5
(1) Notwithstanding any provision of law to the contrary and to the extent permitted 6
under federal law, including but not limited to the Health Insurance Portability 7
and Accountability Act of 1996, Pub. L. No. 104-191, the parent, guardian, or 8
limited guardian of an individual who is receiving residential services under a 9
federally approved 1915(c) home and community-based services waiver program, 10
as defined in 907 KAR 7:005 sec. 1(2), shall have the right to install, or cause to 11
be installed, video recording devices in the private residential room of the 12
individual receiving services. 13
(2) The cabinet shall, withing ninety (90) days after the effective date of this Act, 14
promulgate administrative regulations in accordance with KRS Chapter 13A to 15
carry out the provisions of this section. 16
