KRS 18A.035 is amended to read as follows: 3 (1) The secretary may from time to time designate in writing an employee of the 4 cabinet to act for him or her in case of his or her absence or inability from any 5 cause to discharge the powers and duties of his or her position. In this case, the 6 powers and duties of the secretary shall devolve upon his or her designee. 7 (2) The secretary may request appropriate persons, including officers and employees in 8 the state service, to assist in the preparation and rating of tests. Department heads 9 shall cooperate to the fullest extent possible in making the services of their 10 employees available for such work. 11 (3) (a) The secretary may enter into written agreements with an appointing authority 12 which would provide for the delegation of his or her authority and power to 13 the appointing authority. The secretary is prohibited from delegating any 14 powers or authority pertaining to disciplinary actions, lay-offs, or registers. 15 (b) All written agreements delegating the secretary's power and authority as 16 provided in paragraph (a) of this subsection shall be specific in nature and 17 renewed annually. 18 (c) A copy of the written agreements shall be forwarded to the Personnel Board. 19 (4) The secretary shall serve ex officio as a member of the board of trustees of the 20 Kentucky Employees Retirement System. 21
